DATE AND TIME OF INCIDENT(s): February 13th, 2021
CHARGES BEING APPEALED: SF02 - Murder
DEFENDANTS STORY/OPENING STATEMENTS: On February 13th, 2021, an inmate had escaped containment from solitary and had assaulted two Corrections Guards to the point of serious injury. This inmate had been a major aggression issue for most of the known evening, having already committed to two-three violent attacks previous to this incident. The Defendent in response to a cry for help from the officers, entered the area of operation and by way of force aligning with that of the DOC's Force Matrix, utilized a firearm to neutralize the attacker before any more serious injury could be brought upon the injured guards.
However, the situation escalated when the defendant shot the inmate to the point of death when the force matrix did not call for such action, and the fatality could have been avoided. Upon official inquiry from the correctional Warden Team, in addition to the LSPD's Deputy Chief Philipe Sanchez, it was concluded that this was now a criminal case to be carried out against the Defendent. After a review of the evidence, Deputy Chief Sanchez expressed that by the lines of the Penal Code, the only charge that could be placed in this instance was SF02 - Murder. Deputy Chief Sanchez stated that while a lesser charge was attempted and preferred in this case, the Penal Code could not be budged in this way.
It came to light soon after repetitive CRU meetings, that the defendant had suffered from a chronic, traumatic episode during the incident which was later diagnosed to be PTSD, which served as a catalyst for the February 13th incident. Because of this, the Defendant wishes to take this case to Appeals for an attempt at a reconvention of the case to determine if the charge can be reduced as was once originally intended or expunged from her record, based upon substantial evidence up to and including: Past service record, several witness testimonies/vouches that includes colleagues from both DOC in addition to those in the LSPD, and evidence from the LSEMS of a medical nature.
It is understood that this appeal comes well after the intended 7 day minimum, but based upon the nature of the case, the recommendation of Commissioner Lewis Langley, and the infancy of the Appeals Court opening, an exception is being formally asked for consideration.
