Narrative:
COMES NOW, Michelle Vespucci, pro se, and would submit the following to the court:
Defendant was stopped while driving westbound from Benny’s. When asked, the Defendant acknowledged driving at 83 kph. The officer stated the stop was due to a lane encroachment but clarified that no citation or charges were being issued. The conversation became casual, with the officer appearing distracted and fanboying, not acting in an official or authoritative manner.

At that point, the Defendant, having not been detained or directed to remain, left the conversation. Immediately, additional police vehicles activated lights and pursued aggressively, including ramming tactics. Under duress and in a state of panic, the Defendant drove erratically. The vehicle eventually crashed, and the Defendant exited and fully complied with arrest.

The Defendant’s actions were not willful evasion but a stress-induced response to unclear communication and an unexpectedly forceful escalation.

DEFENDANT’S MOTION TO PRESERVE AND DISCLOSE BODY CAMERA, DASH CAMERA FOOTAGE, AND RADIO TRAFFIC
COMES NOW the Defendant, Michelle Vespucci, appearing pro se, and respectfully files this Motion to Preserve and Disclose all law enforcement body camera footage, dash camera footage, and radio traffic pertaining to the incident giving rise to the charge of VF01: Evading an Officer. In support of this Motion, the Defendant states the following:
  1. On or about June 19, 2025, the Defendant was pulled over while driving westbound from Benny’s. She admitted to officers that she had been traveling at 83 km/h but was informed that the stop was for a minor lane deviation, not for speeding. She was also told she was not being charged or cited at that time.
  2. Despite this, multiple additional police vehicles arrived on the scene, totaling an estimated ten officers and four or more vehicles, surrounding the Defendant in what appeared to be an excessive and intimidating manner.
  3. The lead officer’s, badge #25424, communication was inconsistent and unclear. At no point was the Defendant told she was being detained. Based on the rapidly escalating show of force, the Defendant, feeling afraid and confused, made the decision to leave the scene.
  4. The Defendant did not leave with the intent to evade arrest or flee justice, but rather out of fear, confusion, and a perceived threat to her safety. Upon departure, officers pursued her, activated emergency lights, and utilized PIT maneuvers, ramming her vehicle multiple times.
  5. After crashing into a wall due to stress and panic, the Defendant immediately surrendered, offered no resistance, and was visibly distressed. This was corroborated by bystanders, one of whom gave her a chocolate bar in an effort to calm her.
  6. The requested footage and audio, including body-worn cameras, dash-mounted cameras, and radio dispatch communications, are essential to demonstrate the tone, escalation, and conduct of officers during the stop and pursuit.
WHEREFORE, the Defendant respectfully requests that this Honorable Court issue an order requiring the preservation and disclosure of all body camera recordings, dash camera footage, and radio transmissions associated with this incident. This evidence is vital to ensure transparency, accountability, and the protection of the Defendant’s rights under San Andreas law.

        Explain what happened, sufficient detail must be given to justify the placed charges, videos could be provided.
        • Whilst on patrol under 21-A-19, Cadet Chucky Nookes conducted a 10-55 on a Pink Terminus on Adams Apple Blvd for improper traffic manoeuvre. The driver and RO was Michelle Vespucci. Before the traffic stop had come to a full conclusion, the driver Michelle Vespucci stated "Are you sure you don't want a little action here", turned on the engine, drove forward and stopped, before then speeding off which began a Pursuit through the city. The pursuit continued for around 3 minutes before the Pink Terminus collided with a wall along North Rockford Drive. The Driver exited the vehicle and complied before being detained and arrested and then transported to DOC.

        Possessions are to be documented individually, examples of documented illegal possessions are "Pistol .50" or "12 grams of Cocaine".     • I will break down interaction from my perspective to hopefully clear this case up.

      Firstly, the stop itself. Due to the nature of my body camera, it was only able to record partial of the interaction, with that being during the traffic stop, and during the arrest procedure. The initial stop was due to the suspect, Michelle Vespucci, taking a turn in front of our cruiser hopping over the curb onto the sidewalk while making the turn. Officer Chucky Nookes was driving our cruiser and initiated the stop on Michelle. When she was stopped, she was talked to by the officers on scene and questioned as to why she was driving rather erratically. During the middle of the traffic stop, the back seat passenger, who was later identified as Hayden Onizuka, began telling Michelle that they should just run. This can be verified in Hayden's arrest report HERE.

      Now, during the traffic stop, Chucky Nookes had mentioned to Michelle that she would not be receiving a citation and would not be going to jail either. However, as seen in the body camera footage provided below, she had not yet been told she was free to leave. When she turned on her vehicle, she drove forward a few feet in a fake evasion scare to the other officers. You can hear in the body camera footage Chucky Nookes telling her no, indicating that she shouldn't do that as she had not been cleared from the traffic stop yet. However, she continued to flee the scene.

      Instead of stopping immediately when she noticed officers pursuing her with their lights and sirens on, she decided that it was best to try and evade officers. After she made an immediate right turn, she crashed into a cruiser in the next intersection. The nature of the wreck is unclear to me as I had not witnessed the wreck directly. However, her vehicle had stalled, to which both her and her passenger had ample time to either surrender or to question why they were being chased. Instead, she turned her vehicle back on and began evading again, driving recklessly throughout the city. During the pursuit, you can hear other officers asking if she had been let go to which it was confirmed that she was in fact, not told she was free to leave yet. She eventually began heading northbound on North Rockford Drive to which she attempted to go off-road and wrecked into some rocks on a hill. This resulted in her vehicle stalling for a second time to which again, both her and her passenger had ample time to exit their vehicles or to wait and follow instructions by officers. Officers attempted to box Michelle in whilst her passenger in the back seat laughed at the situation. She turned her vehicle on again and attempted to ramp her vehicle up the hill and over the other officers. Her vehicle stalled again, and she was successfully boxed in by other officers. She then stated that we, the officers pursuing her, were making her, "crash out." This indicates that she was aware of what she was doing yet still chose to do so given the consequences.

      After Michelle exited the vehicle, she was taken to the side to which she was cuffed by Officer Nookes. He questioned why she evaded, and she said it was because he had said she was free to go. Officer Nookes denied that claim and said that he had never told her she was free to go, which is true from the body camera and that they were in the middle of a conversation. Michelle responded to this stating that the conversation both her and Nookes were having was "boring" and that's her reasoning to leaving the traffic stop early. She said that because she was being pursued by officers, she "might as well go to the beach." This statement implies that she had accepted that she was evading and did not plan on stopping for the officers. She continued to laugh and make light of the situation, completely disregarding the fact that she was evading recklessly and put citizens lives in danger had someone had been on the same roads she had been on during the pursuit.

Given no response was provided to the docket notice filed by the Court on the 17th day of July, 2025, the Court has reviewed the Motion to Compel Discovery, filed by the Defense on the 22nd day of June, 2025 in conjunction with the Motion for Discovery filed by the Prosecution on the 15th day of July, 2025.

Due to a lack of response from the defendant in the above case, the case will now be accepting the plea of guilty from the defendant. The defendant was given ample time to interact with the courts and file availability.
