Narrative:
I was a passenger in a car when an officer asked for our IDs and inquired if there were any illegal items in the vehicle. The driver said no. The officers then asked us to step out of the car. As I reached for the door handle to get out, the driver suddenly drove off. The officers chased us, and the driver crashed into a wall less than a minute later. Once it was safe, I got out of the car to surrender, but the driver pulled out a shotgun, and gunfire started from both the officers and the driver. I ran to find safety. After a while, the gunfire stopped, and I called 911 to report the situation and offer my statement. I learned I was wanted for evading and possession of a class 1 firearm. I never intended to evade or participate in any crime. As soon as it was safe to leave the car, I did, and I was ready to surrender. But when gunshots were exchanged, I chose to hide for my safety.

When trying to reason with the officer who responded to my 911 call, he informed me that this was the law, and the charging officer wasn't available to work things out. My license was suspended, and I was shackled up and thrown into the prison.

        Explain what happened, sufficient detail must be given to justify the placed charges, videos could be provided.
        • PO Rio Castillo responded to a 911 call from Tom Daniels regarding a query of whether he has a warrant for his arrest, and if he does he is willing to turn himself in.
          Once arrived at the location of the call PO Rio Castillo discusses with Tom Daniels and made him aware of the fact there is indeed a warrant for his arrest. He was compliant and did not cause any troubles or inconveniences for PO Rio Castillo. Tom Daniels had some queries regarding his charges and did not think that the evading charge should have been placed on him, as he was a passenger and he got out of the car as soon as he could. I liaised with Lieutenand George Hill. and based on that I advised Tom Daniels to make and IA report, as Detective Tim Havlicek was not on duty anymore to discuss his charges with him.
          Tom Daniels was cuffed, mirandarized, patted down, and escorted to the cruiser. PO Rio Castillo handed Tom Daniels's DOC processing to a DOC guard once arrived at Bolingbroke Penitenciaty.
      EVIDENCE DETAILS
      • Document the possessions confiscated from the arrested suspect.
        Possessions are to be documented individually, examples of documented illegal possessions are "Pistol .50" or "12 grams of Cocaine". Legal possessions that can be categorized may be grouped, eg. "Clothing" to describe all clothing items. Body camera footage/pictures may be attached as an evidence exhibit.

        Where possible, the serial number of each firearm seized as evidence should be noted.

        • Tom Daniels was detained as part of a traffic stop with Kon Xiao who was later arrested following a pursuit after the driver, Kon Xiao, evaded from the traffic stop with Tom Daniels before crashing their Kamacho. They were stopped to be questioned as automatic gunfire was heard in the area they were leaving. Xiao opened fire on Officers after the pursuit ended while Tom Daniels ran away on foot after crashing. Xiao was injured during the exchange of fire between Officers while Daniels fled - a weapon was found in the car matching Tom Daniels' fingerprints.

    • 09/FEB/2025 I resumed my watch under 3-G-20 with Detective Tim and Officer Suki. While on regular patrol, radio callout came by Chief Nash that there was automatic gun fire coming south- southwest from Vespucci police station. As we were close by we started to investigate Vespucci area when we stumbled on two times occupied Kamacho driving south. Our unit initiated traffic stop on said Kamacho. Driver and passanger of vehicle identified them selfs to Detective Tim. They were asked to step out of the vehicle for investigation but said individuals disobeyed order. There was enough time for driver or passanger to step out of the vehicle because they asked multiple times '' why do they need to step out''. And they started to evade. Unit that was behind us started to chase them until they tced with tree. Our unit was not near the scene when that happend. We arrived in time to assist our fellow officer that was being actively shot by Kon Xiao. After Kon was neutralized, we procceded with searching the area and securing it. Scene lasted for good 15minutes and passanger Tom Daniels was no where near, he never showed any interest to come back.

    • - As Detective III Havlicek already said in his warrant report, Mr. Daniels was found in a vehicle along with Kon Xiao in a original traffic stop from where everything came on. After we pulled them over and identified, and asked to step out, driver Kon Xiao decided to fully evade. TAC was being called and after a short pursuit, the suspect heavily crashed into an tree which resulted totaling his vehicle. First officer who arrived on scene was caught in a gunfire from Kon Xiao while Mr. Daniels continued on foot. The officer on the scene was injured and we were second unit arrived. We have successfully neutralized the shooter and stabilized officer's health. Rest of the units who arrived, tried to find Mr. Daniels in area but failed at it. In a vehicle which they both used to evade, we found an illegal pistol. Detective Hawkins checked the prints and it came out that prints are matching the one we have in database from Mr. Daniels.

    • A traffic stop was initiated by my unit comprised of Officer Suki Kingstone, Officer Cain Cooper, and myself, Detective Havlicek, under the callsign of 3-G-20 on Kon Xiao and Tom Daniels. The reason behind the traffic stop was reports of gunfire in the area of Vespucci Beach - an area from which a black Kamacho was seen speeding out of which prompted our response, which was followed by a traffic stop on the mentioned vehicle.

      Kon Xiao and Tom Daniels identified on request during the traffic stop in their black Kamacho but after a verbal exchange and a request for Xiao and Daniels to step out, following some arguing, Xiao sped off as the driver with Daniels as the passenger. The two led units in a pursuit from Vespucci to the area of Vinewood Hills, Richman specifically closer to Eclipse Boulevard before crashing. Officer Zack Armani was the lead unit when the suspects crashed - Xiao stepped out of the crashed Kamacho and began firing toward Officer Armani, injuring him, after which Xiao was injured by returning fire from our unit, 3-G-20. Daniels exited and vehicle and ran in an unknown direction before being lost. A trace was attempted on the request of Detective Havlicek but the phone of Tom Daniels was off.

      Following investigation a weapon was found in the compartment of the vehicle with the prints of Tom Daniels' on it which he was charged for. Xiao was treated, transported, and processed in DOC before Daniels was charged as he was nowhere to be seen and fleeing.

COURT DECISION


IN THE SUPERIOR COURT OF SAN ANDREAS

State of San Andreas v. Tom Daniels

A decision was reached in the above case on the 11th day of July, 2025.


Due to a lack of response from the defendant in the above case, the case will now be accepting the plea of guilty from the defendant. The defendant was given ample time to interact with the courts and file availability. If any of the dates and times did not align with the schedule of the defendant, they were able to contact the courts stating the like. As little to no contact has been made with the courts in the past 3-4 weeks, this case will now be archived and the charges will remain on the record of the defendant.
