An Amicus Curiae Brief, also known as a Friend of the Court Brief, is a supplementary document submitted to the court from an individual, special interest group, or organization that is not directly named as a party to a particular case. The purpose of this brief is to elicit relevant arguments from the unique perspective of a third-party to ensure the court is appropriately informed with the relevant viewpoints necessary to make a well-considered decision during deliberations.

An Amicus Brief is not intended to simply show support for one party or another, but rather to provide the court with information, alternative perspective, and analysis on the case which may have larger implications for the State beyond just what is specifically stated by the parties directly involved.

Current procedure for filing Amicus Briefs requires that interested parties, when the time comes, first file a petition to inform the court that they would like to file an Amicus Brief to be considered by the court during deliberations. The petition is intended to be a short document outlining an overview of the petitioner, a summary of their intentions, and disclosures that the court should be aware when making a determination on whether to grant the petition or not.

A member of the public may submit a petition on behalf of themselves, a special interest group, or organization using the format below. This petition should be submitted as a reply directly to the docket of the case in question.

Once the provided window of time to file petitions has elapsed, the Supreme Court will review each petition carefully and evaluate the relevance, expertise, and qualifications presented, among other considerations, and shall grant or deny each petition submitted. Granted petitions may then utilize the document below to file the full text of their Amicus Brief for consideration by the court. The brief should be submitted directly as a reply to docket of the case in question.
