A decision was reached in the above case on the 9th day of December, 2024.
Facts
The prosecution at trial proved that an individual seen on CCTV wearing a black t-shirt mask, grayscale urban ski goggles, white gloves, a gray rain jacket with a bullseye on the back, gray pants and shoes. The prosecution also proved that a motorcycle, registered to the defendant, was spotted leaving the scene of the crime.
The defense argued that being in proximity of a crime being committed and similar clothing are not enough to effectively charge and individual.
Verdict
The court finds that the defendant was in possession of similar pants, shoes, a black t-shirt mask, grayscale urban ski goggles, and white gloves at the time of the arrest. The court finds that the probability of an individual randomly having these items, so similar to that of the individual pictured of CCTV, to be too low for a reasonable person to deem the event as a mere happenstance.
The additional evidence of the individuals motorbike, registered to the defendant, being seen fleeing from the bank presents too many coincidences for the court to disregard.
It is with the above considerations that I issue the following verdict:
- On the count of SF07 - Bank Robbery, I find the defendant, Truls Svartlamon, guilty.
The court will not be requiring additional fees from the defendant.
