        • Officer Engjell Trey and Leo Larson were responding to a traffic stop of a vehicle. This later turned into a felony stop because the passenger, Cortez Rivera had a warrant for SF07 - Bank Robbery. Mr. Rivera was the registered owner of the vehicle. Detectives had searched the vehicle and found a Pistol.50 with a suppressor. Rivera was then processed at the Department of Corrections. Warrant REF (viewtopic.php?p=838996#p838996)

      Incident:
      • On 20/JUN/2024, a 911 call reported a bank robbery in progress. Officer Hunter Parker, along with multiple units, promptly responded to the scene. Upon arrival, officers reviewed the CCTV footage (Exhibit #01) and observed four armed suspects holding up the bank tellers.
      • Additionally, a GPS device was found on the scene, with the CCTV footage capturing one of the suspects dropping it. The GPS device was examined for fingerprints, which matched Rivera Cortez (Exhibit #02: GPS & Prints).
      • A unit identified the suspects as affiliated with the Shadows gang, based on their distinctive clothing and masks.
      • Shortly after this bank robbery there was another alarm where another bank robbery happened on Route 68 and was reported that it was by the same people. Both banks were a fail robbery as non of the vaults were opened.
      I reached out to Mr Cortez for questioning (Exhibit #03: REACHING OUT)
      On Friday, June 21, Rivera Cortez had an interaction with Samuel Martin querying the reaching out message asking for questioning from a detective. I was unavailable at that time, but Lt. Samuel Martin handled the initial proceedings of communicating with him, not going on with the interrogation. Lt. Martin took photographs of Mr. Cortez in his full gear, which matched the description of the suspect involved in the bank robbery (Exhibit #04: First interaction of Cortez Rivera after incident. )

      Multiple attempts were made to interrogate the suspect, Rivera Cortez. However, due to conflicting schedules of the investigating officer and the suspect, the interrogation did not occur. The purpose of the interrogation was to provide Mr. Cortez an opportunity to prove his innocence. Nonetheless, based on the compelling evidence against him, we were confident in his involvement in the crime and would have proceeded with his arrest following the interrogation. Consequently, a warrant was issued for his arrest, and he has been charged with SF07 - Bank Robbery.

      The evidence is clear that our suspect is Rivera Cortez which include:
      • GPS fingerprint match (Exhibit #02: GPS & Prints) - also refer to (Exhibit #01: BANK CCTV & STILLS) of suspect dropping the GPS
      • Visual match (Exhibit #04: First interaction of Cortez Rivera after incident) also refer below to (Visual evidence expanded) as every bit of clothing item matches the suspect on scene to Cortez Rivera identified by LT Samuel Martin

      Conclusion:
      The evidence against Rivera includes CCTV footage and a GPS device dropped at the scene, with the GPS bearing Rivera's fingerprints (refer to Exhibit #02: GPS & Prints). Furthermore, the CCTV imagery and our initial interaction with Rivera the day after the crime match the suspect precisely.

      A review of Cortez's criminal history clearly indicates his capability to commit such offenses, including bank robbery, armed robbery, and other violent crimes. This history demonstrates that he is fully capable of committing the crime he is currently being charged with.

      Based on this substantial evidence, I believe we have sufficient grounds to keep the charges on Cortez Rivera for SF07 - Bank Robbery.

    Requested Evidence to Suppress:
    The entire exhibit.
    • Detailed Reasoning: The defense requests suppression on this exhibit for two reasons.

      Firstly, the defense puts forward that the text message that was allegedly sent to Mr Rivera on the 21st of Jun, 2024, is irrelevant to the charges placed upon him. While this may help to paint a picture, this picture is far more prejudicial than probative.

      Secondly, the prosecution has failed to provide any evidence that this text message was indeed sent to Mr Rivera, as there is no phone number attached and no phone number mentioned in the exhibit. ((If this can't be provided, a snippet of roleplay to clarify would be sufficient.))

  • Exhibit #7: First interaction of Cortez Rivera after the incident
    Requested Evidence to Suppress:
    Entire exhibit.
    • Detailed Reasoning:

      The prosecution has not provided any evidence to suggest that the individual in the first image, HERE, is in-fact Mr Cortez. Instead, the prosecution has assumed facts that are not in evidence. While the exhibit does mention "Cortez Rivera , identified by LT Samuel Martin", there is no corroborating evidence to suggest this. Additionally, there is no specification in regards to how this individual was identified as Mr Cortez, as Lieutenant Samuel Martin, nor any other officer on scene, have provided a statement of events.

      In summary, this is just a picture of a man that the prosecution are claiming to be Mr Cortez, with no proof beyond a reasonable doubt that this is the case.

    Furthermore, the CCTV imagery and our initial interaction with Rivera the day after the crime match the suspect precisely.

    • Detailed Reasoning: Similarly to the defenses motion to suppress exhibit 7, this exhibit assumes facts that are not in evidence. While I am sure it is convenient for the prosecution to continue addressing this individual as Mr Cortez, the opposing counsel have provided no evidence of the mans identification. Therefore, as far as the evidence and facts provided are concerned, we are connecting the dots between two unidentified men.

The State of San Andreas, by and through the undersigned attorney, filed this Rebuttal, and requests the following to be left;

    Requested Evidence, Rebuttal:
First interaction of Cortez Rivera after incident
  • Detailed Reasoning:
    The Prosecution believes that the identification of the accused in the photograph is a clear fact, leaving no room for doubt. According to the Witness Statement;
    Additionally, a GPS device was found on the scene, with the CCTV footage capturing one of the suspects dropping it. The GPS device was examined for fingerprints, which matched Rivera Cortez
    Based on the CCTV footage and the photograph posted by Samuel Martin, it is clear that the individual involved in the bank robbery, who dropped a GPS device at the scene, was wearing the same clothing as during the encounter with Samuel Martin. Therefore, we have confirmation of Samuel's position, which leaves no doubt as to its authenticity.
    The following are a positive match from CCTV and the initial meeting after the bank robbery:

    • Grey button shirt
    • Bag
    • Right handed bracelet

    The prosecution believes that the picture is important to the case and should not be removed. The witness statement says that the individual who was identified by Samuel Martin matches the individual in the CCTV footage, who has been identified as the defendant Mr. Rivera.

The text message is not relevant to establishing the identity of the suspect, and there was no response from the recipient, to establish any sort of relevance. Therefore, the text message will be suppressed in full.

With regards to Exhibit #7: First interaction of Cortez Rivera after the incident, the court will be granting the defense's motion to suppress. In exhibit three, we can see the context behind the first photograph, as it was posted by Samuel Martin to the casefile, but there is no further context given. The court notes the prosecution's attempts to visually match the suspect, however the court finds it more prejudicial than probative to assume the identity of a masked individual without any further basis beyond visual clues. Given precedence set in #23-CM-0088, the State of San Andreas v. Wolfgang Bathsheba, it is noted that law enforcement officers are allowed to remove masks to identify people. Following this logic, a masked individual with very similar clothing is not sufficient for identification. In the future, prosecution is heavily encouraged to gather witness statements from all relevant parties to best give foundation to their arguments.

With regards to Exhibit #3: Witness Statement, Officer Hunter Parker, 02/JUL/2024, the court will be granting the defense's request as all statements have been previously suppressed above or now completely lack the relevant foundation given the suppressions above.

NOTICE OF SCHEDULING

An attempt to schedule was made and recorded by the court on 20th of March, 2025.


All parties in this case are encouraged to complete the following Scheduling Tool in an attempt to schedule a trial on the above case. When the scheduling tool has been completed by either party, please post on the docket stating as such.

In the event all parties have overlapping availability the Presiding Judge will determine the best date and time to have a trial take place and post a Notice of Trial informing all of the upcoming proceeding.

In the event some or all parties do not have overlapping availability, the Presiding Judge will continue to attempt to schedule the proceeding or seek alternative avenues to conclude the case.

If either party has the intentions of calling a witness to the stand during the proceeding they must inform the court by filing a Witness List at the time of filing their availability. If no Witness List is filed before the Notice of Trial is filed you will be unable to call a witness during the proceeding.

The Prosecution asks that scheduling be suspended until then, or until substitute counsel can be appointed; however, this would be difficult due to staffing issues within the Prosecution, which may delay this case being assigned until other cases are concluded.
