Both the State and Defendant in this case are still awaiting adequate representation.         Explain what happened, sufficient detail must be given to justify the placed charges, videos could be provided.
        • The Suspect attempted to help another suspect evade at a 'Car Drop' location at Arcadias (The typical Drop Spot). My suspect was in an Elegy Retro Custom and was waiting below Arcadias, before the individual could make it to the suspect vehicle he was tased and then after that Jade pulled away and began to flee, AIR-1 followed her as she travelled in incorrect lanes of travel while also going at high rates of speed.

          I caught up to her just before she was able to park her car at double apartments. When searching her I found the exact items of clothing that was used in the store robbery which her friend that she was trying to pick up was also involved in, she perfectly matched the description of the robbery while also being on frequency and trying to help the other store robber to escape. I was instructed due to these reasons by Chief Roth and other supervisors to charge her with Armed Robbery and Face Concealment.

        • Andre Howard was on a LINCOLN unit when a masked individual on BF was seen speeding away from a scene of a store robbery, Andre Howard, performed a 10-55 on the suspect, the individual then evaded after being asked to identify themselves, after a 10 minute chase, the suspect stepped off his BF and attempted to jump off a bridge to another suspect who was setup, ready for the suspect to be picked up in an elegy, the suspect was tazed before they could get in the elegy.

          After he was tazed, the suspect stood back up with a .50 in his hands, after being given demands to drop the weapon, the individual then pointed the .50 at the officers on scene, he was then gunned down by the officers and tazed by Andre again, Andre Howard took the .50 off the suspect and BLSed the suspect then MD arrived on scene and treated the suspect, Andre Howard went ahead with the cuffing, Miranda rights, patting down, ID'ing the suspect who was ID'ed as Carlos Chavez, he was then transported to Pillbox by MD, Andre Howard then transported him to DOC for the arrest.

    • There was a pursuit of Carlos Chavez in relation to a string of robberies across the city, he had an accomplice and we had video and picture evidence of being with him inside the store robberies. While chasing Carlos he headed for the Arcadias Drop Spot which is frequently used by criminals to try and get away from us via getting into another vehicle with the driver continuing to flee with him in the passenger seat, this was exactly what he attempted to do with Jade, Jade was waiting on Del Perro Freeway in her Elegy to pick Carlos up, however, we managed to stop Carlos from entering the vehicle and when this happened Jade in her elegy Sped away from the scene and broke traffic laws while travelling at high speed in incorrect lanes of travel, we saw all this and was able to follow her due to AIR-1 following the vehicle the whole time, she was not aware of this and attempted to park her vehicle but before she could I caught her at the entrance of the garage at double apartments.

      She was charged with Felony Public Endangerment and Obstruction of Justice as she attempted to help Carlos getaway at the Arcadias drop spot and then fled at high rates of speed to attempt to get away and park her vehicle.

      The suspect also had the exact same clothing in her pockets as the woman on the CCTV camera alongside the same tattoo on her arm. I was instructed by the supervisors on scene and in TAC to charge her with Armed Robbery and Face Concealment.

    • From my understanding of the situation, this BF was seen leaving the scene of a store robbery and I conducted a traffic stop on this individual, when asking the individual to identify himself on his bike, he started evading on his bike which lead to a 10 minute chase where he was eventually caught after attempting to run to another vehicle which was ready to pick him up.

      Regarding the Armed Robbery charge I cannot confirm whether he was the individual who did the armed robbery as I did not check cctv, I was informed by another officer which unfortunately I cannot remember who, to place the charge of armed robbery on the suspect and am unsure if there was any evidence linking him to the armed robbery of the store.

    MOTION TO SUPPRESS

    A Motion to Suppress was filed in the above case on the 26th of March, 2025.


    The Defendant, by and through the undersigned attorney, filed this Motion to Suppress, and requests to following be suppressed from evidence;


    • Exhibit #4: Officer Witness Statement - Andre Howard
      Requested Evidence to Suppress:
      The entire exhibit
      • Detailed Reasoning:
        The officer starts his witness statement with "From my understanding of the situation" meaning this officer was not there first hand. This officer did not see any of this happen, he only states that this is what he understands from what other officers have told him. This officer is making speculative claims and isn't even a witness.

        The officer continues,
        "Regarding the Armed Robbery charge I cannot confirm whether he was the individual who did the armed robbery as I did not check cctv, I was informed by another officer which unfortunately I cannot remember who, to place the charge of armed robbery on the suspect and am unsure if there was any evidence linking him to the armed robbery of the store."

        This clearly states that the officer had no clue what happened. The officer doesn't seem to remember this arrest at all. To have a "witness statement" from an officer who didn't witness the event unfold is absurd. The officer fails to mention anything that he actually witnessed. Instead he speaks on things other officers had told him and has no evidence to back up that he saw this scene first hand. I request that this exhibit in its entirety be removed as it is all speculation and hearsay.

    Rebuttal


    IN THE SUPERIOR COURT OF SAN ANDREAS

    State of San Andreas v. Carlos Chavez and Jade Parker


    A Rebuttal was filed in the above case on the 2nd of April, 2025.


    The State of San Andreas, by and through the undersigned attorney, presents a rebuttal to the defendant's recent Motion to Suppress;

    • Exhibit #4: Officer Witness Statement-Andre Howard


      Regarding suppression
      The Defense's contention that Officer Howard's statement is speculative is not accurate, since Officer Hower was directly involved in the pursuit, tasing, and arrest of Carlos Chavez, and thus Officer Hower's testimony would be firsthand knowledge and not hearsay. Officer Hower plainly stated,
      "I did a 10-55 on the suspect, the subject then fled after being ordered to identify himself, after a 10-minute pursuit, the suspect got off his BF and attempted to jump off a bridge to another suspect who was waiting, holding the suspect to be picked up in an elegy, the suspect was tazed before they could get into the elegy."
      This confirms that Officer Hower personally witnessed and took part in the arrest. Furthermore, in their arrest report for Carlos Chavez, Officer Hower described how
      "After he was tazed, the suspect stood back up with a.50 in his hands, after being given demands to drop the weapon, the individual then pointed the.50 at the officers on scene, he was then gunned down by the officers and tazed by me again, I took the.50 off the suspect and BLSed the suspect."
      This indicates Officer Hower's direct involvement in disarming Chavez, which is contradictory to the argument that Officer Hower's statement is speculative. Further, Officer Hower stated,
      "I continued with cuffing, Miranda rights, patting down, ID'ing the suspect who was ID'ed as Carlos Chavez, he was then transported to Pillbox by MD, I then transported him to DOC for the arrest,"
      indicating Officer Hower participated in every phase of the arrest. Officer Hower's testimony is also corroborated by bodycam video and Officer Draco's report confirming Jade Parker's participation in the escape attempt. Since Officer Hower's report agrees with multiple independent sources of evidence, it is not speculation but an accurate and admissible law enforcement record, and the motion to suppress must be denied.

    Surrebuttal

    A Rebuttal was filed in the above case on the 6th of April, 2025


    The Defendant, by and through the undersigned attorney, filed this Surrebuttal;

    The prosecution is correct with one thing in this exhibit, Officer Howard was there for the arrest. The other two statements are written by an unknown officer. There is not a single statement in the arrest report saying that this is from Mr. Howard's perspective. The prosecution states " Officer Hower plainly stated," yet it is not plainly stated anywhere that Mr.Howard is the one to make this statement in the arrest report. It is clearly stated that multiple officers were involved and the arrest report should include all perspectives as well. To say that these few statements are made purely by Officer Howard is speculation in itself.

    I would like to point out one last issue with both arrest reports. Both arrest reports have a section for the "Officers Involved" to be stated. In both of these exhibits Officer Andre Howard is not mentioned in either.

    The prosecution likes to tie the arrest report to the witness statement for some reason. We are speaking about Exhibit #4 in this suppression, not Exhibit #1. With the lack of description and speculation in this exhibit, the defense requests that this exhibit be removed from discovery.

    A Plea Agreement was filed by the Prosecution and accepted by the court. Within the agreement, the first defendant pled guilty to the charge(s) of VF01 - Evading an Officer.
