Narrative:
Detective Mikael Cowell inititated a traffic stop on a vehicle I was in to perform mask enforcement. I had immediately prior switched got out of a terminus that I was the passenger of, and into the drivers seat of said vehicle.

I was immediately stopped, and when I dared to question what cause Cowell had to pull me over, he pulled me out of the vehicle and arrested me for Failure to Comply and cited me for face concealment.

I, Frank Haswell, hereby affirm that all information provided above is true and correct to the best of my knowledge, and understand that knowingly providing false information could result in additional charges and/or fines. (( I affirm that all information submitted has been obtained via In-Character means. ))

        Explain what happened, sufficient detail must be given to justify the placed charges, videos could be provided.
        • During normal patrol duties at the parking lot, I witnessed a masked male enter a vehicle whose owner had a suspended license.

          I drove up to the vehicle, telling the driver that I would like to see their drivers license. To this, he replied: "To bad, that doesn't constitute reasonable suspicion of a crime".

          I then followed the vehicle out from the parking lot, initiated a traffic stop and got several units on standby, as I assessed the risk for a potential pursuit to be high. I walked up to the driver side door, ordered the driver to lower the window, remove his mask and to provide me with his drivers license. Once the driver removed his face concealment, he did not hand over any ID or license, but questioned the basis of the stop. I told him that there was an active investigation, and that I needed to identify him in the course of the investigation. He again, did not comply with the order, but continued to question it and to tell me that I was wrong with the whole stop. At this point, I had issued him the order to identify himself several times. I had even disclosed on what basis I was requesting this (an ongoing investigation). I then chose to issue a final order to identify himself and when it was not complied with, I ordered him to step out of the vehicle and placed him into custody.

      EVIDENCE DETAILS
      • Document the possessions confiscated from the arrested suspect.
        Possessions are to be documented individually, examples of documented illegal possessions are "Pistol .50" or "12 grams of Cocaine". Legal possessions that can be categorized may be grouped, eg. "Clothing" to describe all clothing items. Body camera footage/pictures may be attached as an evidence exhibit.

        Where possible, the serial number of each firearm seized as evidence should be noted.

I then chose to issue a final order to identify himself and when it was not complied with, I ordered him to step out of the vehicle and placed him into custody.

      As a conclusion, the suspect was masked in the public. He got into a vehicle of who the owner did not have a valid drivers license. During the traffic stop, refused to identify himself to me, as according to him, I did not have reason to. I issued the order several times and made it clear that the ID was requested for the following;
      Failure to comply with a lawful command by a law enforcement officer including when he requests you to identify who you are during the course of an investigation.
      As the order was not complied with, despite several attempts, I made the choice to place the defendant under arrest.

    A Motion to Compel Discovery was filed in the above case on the Day of Month, Year.


    The State of San Andreas/Defendant, name, by and through the undersigned attorney, filed this Motion to Compel Discovery, and requests as follows;


    • Requested Discovery: Officer Worn Bodycamera footage of the incident from Detective III Mikael Cowell
      • Detailed Reasoning: Thorugh Sworn Testimony, Detective Cowell has lied. There was no active investigation present at the time, as the registered owner of the vehicle was present, unmasked, and sat in the passenger seat of the vehicle. The Registered owner of the vehicle in question also gave me a set of keys to the vehicle, well within the view of Detective Cowell.

        There was no merit to the traffic stop conducted by Detective Cowell and the Officer Worn Bodycamera footage will indicate as such.

    COURT DECISION


    IN THE SUPERIOR COURT OF SAN ANDREAS

    State of San Andreas v. Frank Haswell

    A decision was reached in the above case on the 1st day of October, 2024.


    The court thanks both counsel for their time and presentation. This ruling specifically addresses the defense's motion to compel discovery.

    At the outset, the court cautions the defendant to exercise precision in the language used in official court documents, particularly when making allegations. It is one matter to allege that an individual may have provided false information to the court and another to directly assert that an individual has lied. Any such statements must be substantiated by evidence. The defense could request that the individual, Anakin Bringer, appear as a witness or submit a witness statement for use in the defense’s case-in-chief.

    Turning to the motion to compel discovery, the court acknowledges that additional motions are not typically entertained in bench trials unless there is compelling reason to do so. In this instance, considering the potential benefit of the requested information to the defendant, the court hereby orders the prosecution, if such information exists, to provide a video record of the relevant events.

    (( Should such footage not exist, we can accept proof of bodycam RP. Then the defendant and prosecution can conduct /me and /do RP. ))

    The prosecution is granted 7 days to comply with this order or to submit a justification explaining why compliance is not feasible.

    A Motion for Discovery was filed in the above case on the 9th of October, 2024.


    The State of San Andreas, by and through the undersigned attorney, filed this Motion for Discovery, and presents the following as evidence;


    • Exhibit #5: Bodycam footage - Mikael Cowell, 13/AUG/2024
      * In the attached footage, you would see Mikael Cowell inside of a police cruiser in the parking lot. There would be a male getting out of a vehicle masked, then approaching the Scout. Cowell would drive up to the vehicle, telling the driver that he would like to see their drivers license. To this, Frank replies: "To bad, that doesn't constitute reasonable suspicion of a crime". Frank leaves the parking lot and is pulled over shortly. When Cowell walks up to the car, the suspect is still masked. Cowell requests the male to unmask himself and to provide him with a drivers license. The suspect would not comply and question the legitimacy of the stop. After a while of discussion (of the suspect no complying), Frank is ordered out of the vehicle and placed under arrest.
