Despite the defendants assertation of a temporarily loss of control of the vehicle, the defendants own admission under oath that he continued driving in the wrong lane of the highway intentionally establishes the deliverate disregard of public safety required under VM03. The court therefore finds that the defendant consciously disregarded the risks to others on the highway.
Regarding GM05, the court does recognise the theoretical possibility that the defendant was unaware the money was stolen. However, it was proven beyond a reasonable doubt that the marked bills were found on the person of Mr Bathsheba, and were also admitted to be on his person by the defendant himself. The law of GM05 states: "Buying, receiving, concealing, selling stolen property.", nowhere does it mention intent. In the absence of a credible, lawful explanation for possessing such currency substantiates guilt.
It is with the above considerations that I issue the following verdict:
- On the count of GM05 - Receiving Stolen Property, I find the defendant, Stelio Bathsheba, guilty.
- On the count of VM03 - Reckless Operation of a Road or Marine Vehicle, I find the defendant, Stelio Bathsheba, guilty.
