  • Parties,

    This is to serve as a FIRST notice to the defendant that bench trials are currently scheduled on multiple days throughout the week. Please notify the court if these times do not work for you. The expectation of the court is that each defendant file a notice for availability in the next 7 days. Date, times, and formatting shown here. MOTION TO COMPEL DISCOVERY

IN THE SUPERIOR COURT OF SAN ANDREAS

State of San Andreas v. Lillliana Howell
#N/A

A Motion to Compel Discovery was filed in the above case on the 13th of March, 2025.

The Defendant, by and through the undersigned attorney, filed this Motion to Compel Discovery, and requests as follows;

  • Requested Discovery: Body-camera footage from Lieutenant Dale Ashcroft
    • Detailed Reasoning: The requested body camera footage will provide further context not mentioned in the provided witness statements.

      Namely, it will show that I wasn't merely asked to step out of the vehicle for an investigation, but rather was told I would be searched and to step out for said search to be conducted with the only reasoning given being that Lieutenant Ashcroft felt I was involved in the store robbery. Something that seems intentionally left out of the provided witness statements, with the detectives' story changing after the fact to make the order seem more lawful.

  • Parties,

    Defense, your motion to compel discovery request has been noted. The court will be waiting for the prosecution to submit their response. The prosecution has 3 days to submit a response or motion for continuance or the court will make a decision based off the current facts.

    Furthermore, given the state has significantly more public defense attorneys than last month, the defendant is encouraged to attempt to reach out again to find representation. However, they are within their rights to continue down the path of self-representation.

    As part of the Prosecution's general handling of cases, bodycam footage was requested from the officers involved in the defendant's arrest when first filing our information request with the LSPD. The Prosecution received a video file, however, it was corrupted, and we were not able to recover the footage, and thus are unable to confirm or deny the allegations made by the defendant in their motion to compel.

A Motion for Involuntary Dismissal was filed in the above case on the 18th of April, 2025.

The Defendant, by and through the undersigned attorney, filed this Motion for Involuntary Dismissal, and the reasoning for request is as follows;

  • Reasoning: No legal ground for the charge provided, and breach of the Lesser Included Offense Doctrine
    • Detailed Explanation: Police Lieutenant II Dale Aschroft, in their own statement, claims that I was only asked to step out, not ordered to. As such there are no legal grounds for Failure to Comply as no lawful order or demand was given at the time. At no point in the statement is there a lawful order established that I failed to follow.

      Additionally, by fleeing the traffic stop, I was charged with a greater charge of "VF01 - Evading an Officer", the act of fleeing the request to step out of my vehicle would already be contained under the charge of " VF01- Evading an Officer ", as by definition, I willingly fled from an officer in the same vein as I failed to comply with the officers "demand"

  • Honorable Judge Yukimura and pertaining parties,

    The Prosecution would like to know whether or not the defendant wants to move for an involuntary dismissal, or move ahead with the case and request that some of the submitted evidence be suppressed. The defendant cannot have it both ways, and needs to decide which direction they want to take this case, as the Prosecution believes it to be improper to post the above motions jointly when each motion's ruling would negate the other. The Prosecution has responses prepared for each motion, whenever a notice has been given from the defendant.

Hello

The defendant believes that the motion to suppress builds on the motion for involuntary dismissal and as such should be considered in conjunction.

Further more if this is considered improper trial proceeding, they would also urge the SAJB to have more public resources made available for defendants who don't get assigned a public defender and can't reach out to one under threat of gunpoint by GSB.

Thanks

ISSUANCE OF VERDICT

IN THE SUPERIOR COURT OF SAN ANDREAS

State of San Andreas v. Lillliana Howell
#25-BT-0021

A decision was reached in the above case on the 7th day of May, 2025.

The court will be granting Ms. Howell's request for summary judgment (filed as involuntary dismissal), as there is no dispute about the facts of this case. Ms. Howell pulled away from Lieutenant Ashcroft while still in their vehicle during a traffic stop, where lawful orders were given and disobeyed. However, as the entire situation happened in the vehicle, the court will be agreeing that GM10 - Failure to Comply / Identify is included under VF01 - Evading an Officer, under the Lesser Included Offense Doctrine.

It is with the above considerations that I issue the following verdict:
  • On the count of GM10 - Failure to Comply / Identify, I find the defendant, Lillliana Howell, not guilty.

The defendant should make their way to City Hall at their earliest convenience to have the change to their record noted as well as the payment of $5,000 returned to them for fines, time, and other expenses/inconveniences incurred from the contested charges.
