  • Honorable Judge Fitzgerald and All Pertinent Parties,

    The prosecution respectfully moves for the defendant to be held in contempt of court. While the prosecution recognizes the necessity of leniency in cases involving exigent circumstances or genuine accidents, the defendant has openly admitted to willfully skipping the scheduled trial date due to their state of intoxication.

    This trial date had been set well in advance, with over two weeks of notice, yet the defendant's actions reflect a disregard for the court's time and resources. Such behavior is, in the view of the prosecution, wholly unacceptable and warrants appropriate judicial response.

Hello Judge,

Do you require a statement from me at this time, regarding the states motion presented on 06/JAN/2025/? Or does the motion presented have no merit and does not require a statement from me?

I don't think this prosecutor is the sharpest tool in the tool shed, if you know what I mean. I think he reads at the level of a third grader.

NOTICE OF SCHEDULING


IN THE SUPERIOR COURT OF SAN ANDREAS

State of San Andreas v. Phil Russo
#24-CM-0060

An attempt to schedule was made and recorded by the court on 26th of January, 2025.


All parties in this case are encouraged to complete the following Scheduling Tool in an attempt to schedule a trial on the above case. When the scheduling tool has been completed by either party, please post on the docket stating as such.

In the event all parties have overlapping availability the Presiding Judge will determine the best date and time to have a trial take place and post a Notice of Trial informing all of the upcoming proceeding.

In the event some or all parties do not have overlapping availability, the Presiding Judge will continue to attempt to schedule the proceeding or seek alternative avenues to conclude the case.

If either party has the intentions of calling a witness to the stand during the proceeding they must inform the court by filing a Witness List at the time of filing their availability. If no Witness List is filed before the Notice of Trial is filed you will be unable to call a witness during the proceeding.

A trial date was set on the above case on 27th of January, 2025.


In accordance with the availability reported by both parties in response to the Notice of Scheduling, this trial shall take place at 19:00 PM on Saturday 1st of February, 2025 at Rockford Hills City Hall, Carcer Way, Metro Los Santos, SA.

Both parties are ordered to be present in the Judges Chambers no later than 15 minutes prior to the above listed date for pretrial arrangements. ISSUANCE OF VERDICT


IN THE SUPERIOR COURT OF SAN ANDREAS

State of San Andreas v. Phil Russo
#24-CM-0060

A decision was reached in the above case on the 01st day of February, 2025.


After reviewing the evidence and arguments presented, the court finds that the prosecution has met its burden of proof beyond a reasonable doubt in establishing that the defendant, Phil Russo, attempted to unlawfully take a government-owned vehicle.

Deputy James Valor, a direct eyewitness, observed the defendant actively lockpicking a Department of Corrections vehicle, and responding officers confirmed the presence of lockpicks and a screwdriver, tools commonly associated with vehicle theft. The defense’s objections regarding prejudicial evidence and witness credibility were considered; however, the court finds that Deputy Valor’s firsthand testimony, corroborated by physical evidence and expert analysis, sufficiently proves the defendant’s intent and actions.

As established in #24-CM-0018 State of San Andreas v. John Chapel, affirmed witness testimony must be taken as fact as they can not contain untruthful statements without finding their authors guilty of perjury. Given the clear attempt to take the vehicle without consent, the court believes the legal elements of Attempted Grand Theft Auto have been satisfied.

It is with the above considerations that I issue the following verdict:
  • On the count of GF11 - Attempted Grand Theft Auto of a Government Employee, I find the defendant, Phil Russo, guilty.
