A Notice of Activation was entered in the above case on 15th of January, 2025.


The case of the State of San Andreas v. Cortez Rivera is hereby activated by this Court under #25-CM-0004.

Both the State and Defendant in this case are still awaiting adequate representation. At this time the court will delay the Order for Discovery until adequate representation has been assigned for the Defendant and a State Prosecutor has been assigned to the case and both parties inform the court they are ready to proceed.

In accordance with guidelines set forth by the Supreme Court of San Andreas, this case shall require an in-person trial. Once all pretrial matters have been resolved, a Notice of Scheduling will be issued to arrange an appropriate time for trial.

    • PD called for 10-70 I believe it was DB for a 10-55 outside of sandy shores on a Black Juglar. I was the 1st backup unit so primary pursuit unit. After stepping out of the vehicle and DB IDing the driver the driver evaded along with a female in the passenger seat (I cannot re-call the females name but she is known to me and well known).

      I maintained primary up to when we reached the city where the Black Jugular span out colliding with a tree but not stalling. The female jumped from the vehicle which is when I left my vehicle and cuffed her as she tried to flee on foot.

      I began frisking the female at which point Mr Rivera arrived on his BF400 stopped and withdrew a silenced .50 from his vehicle storage box. He then dismounted the bike and a gun fight ensued with myself as the lone unit in which multiple shots were fired from both sides.

      Luckily I was able to injure Mr Rivera without sustaining any wounds. However during the gun fight the female suspect fled and jumped into the passenger seat of a car and left the scene.

      Shortly after I went over to secure Mr Rivera's weapon however his gang including Tommy Bean and others were circling the area. Luckily backup arrived and the scene was secured. It is at this point the female returned to the scene cuffed stating she feared for her life hence her fleeing. It is my belief that the female may have had illegal items which she was then able to store as a result of Mr Rivera's actions allowing her to flee resulting in obstruction.

      The female was not charged with anything and was let go. the firearm with silencer was confiscated and placed in evidence and Mr Cortez was in high spirits somewhat on the way to DOC.

  • Exhibit #3: Bodycam Footage - Sergeant Mathew Handley, 06/JUN/2024
    * The footage would show the deputy as primary pursuit on a 10-55 with DB talking to the driver.

    * The driver would then speed of and a chase would Ensure.

    * The pursuit would lead to Elgin Avenue where the Jugular would spin out and crash. The female would jump from the car and start to run away.

    * The deputy would exit the vehicle and cuff the female. The female would be complaining she did nothing wrong and refer to the deputy by name. The deputy would say "Then you have nothing to worry about but I have to search you".

    * The deputy would have hands on the female about to search pockets after reading her rights but then glance over to the main road.

    * You would see a black BF400 pull up with a masked man driving. The masked man would reach into his storage box and take out a .50 silenced. He would exit the bike withdraw the weapon and aim at the deputy.

    * At this stage the deputy would have pulled his gun and aimed at the suspect and began to fire. The deputy would call Code 1 on the radio and press his panic alarm. The suspect would fall to the floor after a few shots fired the deputy would not have been hit. The deputy would look over towards the woman while hiding behind a tree on scene and see he entering the passenger seat of a black car.

    * The deputy would run over to the suspect with gun raise and be heard ordering a nearby vehicle to leave and also telling Mr Bean to get the hell out of here who was on foot at the scene. Shortly after PD would arrive on scene and the female would come back on foot.

The State of San Andreas, by and through the undersigned attorney, filed this Motion for Summary Judgement, and the reasoning for request is as follows;


  • Reasoning: Cortez Rivera attempted to murder Sergeant Matthew Handley with a suppressed pistol.50, thereby he obstructed the arrest of the suspect.
    • Detailed Explanation: It is clearly shown on the bodycam footage that Sergant Matthew Handley chased a black Jugular. The vehicle spun out and crashed, the suspect jumped from the vehicle and started to run out. The sergeant detained the suspect, read them the Miranda Rights and began frisking them. Then the masked Corter Rivera arrived on his BF400. He reached into his storage box and withdrew a suppressed pistol .50. He dismounted his bike and shots were fired. Sergant Matthew Handley injured the defendant Cortez Rivera. Mr. Cortez is guilty of Attempted Murder of a Gov. Employee, Obstruction of Justice, Possession of a Class 1 Firearm, Criminal Use of Weapon Modifications as written in the Arrest Report and shown on the bodycam footage provided to the court.

Cortez Rivera, by and through the undersigned attorney, filed this Motion for Involuntary Dismissal, and the reasoning for request is as follows;


  • Reasoning: Failure to sufficient prove the elements of the Defendant's alleged crime(s).
    • Detailed Explanation: The Defendant filed a "Criminal Case Submission Form" on 10/Jun/2024 wishing to dispute charge(s) received on the same date. On 18/Jan/2025, the Prosecution presents an arrest report and body camera from a Sergeant Matthew Handley dated 6/Jun/2024. From reading the statements and reports from 6/Jun/2024, it's clear Mr. Rivera was immediately arrested after those events described, and not several days later (e.g 10/Jun/2024).

      As the prosecution has not provided any evidence from 10/Jun/2024, despite having 7 months to do so. The Defense does not believe the State has sufficiently proven the elements of the crime(s) allegedly committed by the Defendant on 10/Jun/2024.

The defense's Motion for Involuntary is hereby granted. The disputed charge of SF02 - Murder will be removed from the record of the defendant. Thank you to both parties, this case is hereby dismissed.

The defendant should make their way to City Hall at their earliest convenience to have the change to their record noted as well as the payment of $37,000 returned to them for fines, time, and other expenses/inconveniences incurred from the contested charges.
