Both the State and Defendant in this case are still awaiting adequate representation.     • My involvement in the traffic stop was limited as I was in the passenger seat of our unit and was otherwise occupied completing paperwork until the end, when I assisted officer McLaughlin with his arrests. Mr. Hawk made multiple statements to officer McLaughlin that he was a law enforcement officer and authorized as such to violate basic traffic laws (the stop was initiated due to him operating his vehicle in the incorrect lane). I overheard some of this from my position, but not the entirety of the conversation. My interpretation of the conversation between them followed officer McLaughlin's train of thought that he was attempting to impersonate a police officer in order to avoid receiving a traffic citation.

      First I would like to start by attaching this arrest report from his accomplice that was arrested in the same situation as I feel it provides a more indepth recounting of events. viewtopic.php?p=813669#p813669

      The situation started with a simple traffic stop involving the complainant and his partner Perseus Cable. They were driving on the wrong side of the road erratically and were pulled over accordingly. Upon issuing the citation to Mr Cable as I was handing it over they both informed me they were only conducting the jobs they were authorized by GOV/JB to do. They both also informed me that they had been given special military issued gear to conduct arrests in the area they were "patrolling". I told them none of that made sense and they told me to contact GOV/JB and verify their credentials. With both names (Justice Hawk and Perseus Cable) I called over departmental radio to verify their credentials. Obviously JB/GOV stated that neither were deputized or authorized to be conducting themselves in any sort of official capacity at all. When I informed the two men of this both of them told me I had not talked to anyone high enough up and that I needed to contact the head of the government. Clearly these two were misrepresenting themselves and were caught doing so. They were both charged accordingly.

While giving the driver a ticket both occupants stated they were authorized by JB/GOV to be conducting arrests in the area and that they had been given specialized military gear to do so. Officer Mclaughlin reached out to JB/GOV and was informed that neither of the individuals were authorized to be doing anything of the sort. Both men were arrested and taken to DOC for portraying themselves as government sponsored operatives. At DOC Mr Cable decided to batter a SD deputy.

The Defendant, Justice Hawk, by and through the undersigned attorney, filed this Motion to Suppress, and requests to following be suppressed from evidence;

    • Detailed Reasoning: Within the Witness statement, Officer Fury states, "My involvement in the traffic stop was limited as I was in the passenger seat of our unit and was otherwise occupied completing paperwork until the end". This makes this witness statement speculation and cannot be seen as fact; Officer Fury was clearly not present for the conversation in which he is producing a witness statement for.

      Futhermore, the final statement, "My interpretation of the conversation between them followed officer McLaughlin's train of thought that he was attempting to impersonate a police officer in order to avoid receiving a traffic citation." is more speculation as it is his "interpretation" of another officers train of thought; this can only be personal opinion and not fact.

    Requested Evidence, Rebuttal:
    I overheard some of this from my position, but not the entirety of the conversation. My interpretation of the conversation between them followed Officer McLaughlin's train of thought that he was attempting to impersonate a police officer in order to avoid receiving a traffic citation.
    • Detailed Reasoning: The prosecution believes this piece of evidence is necessary for our case as the officer states he has overheard the conversation between the officer and the Defendant. For the part of speculation, The officer is merely stating their own thoughts on why the defendant did what they did was the same as their partners, not that they think about what their partner thought.

A decision was reached in the above case on the 23th day of December, 2024.


The court has reviewed the statements from both parties in regards to the suppression of exhibits 3, 4, and 5.

Exhibit 3:
The court considers simply suppressing the evidence that might be speculative in nature, however at the end of the suppression, the court finds there to be a singular sentence remaining. To that effect, the court rules in accordance with previous precedence set in #24-CM-0018, State of San Andreas v. John Chapel (Pauls). The retired Justice McFornell stated, "due to their vagueness and the contents within them, are unable to provide the court with sufficient elements that would allow it to obtain more or less certainty regarding the case". The court agrees with the defense that the individual was only aware of the situation for a limited amount of time.

The court will rule out of order and move onto exhibit #5.


Exhibit 5:
Exhibit 5 is an arrest report of the driver of the vehicle, during the exact situation that the defendant where the defendant was arrested. If the individual had filed a court case, it is likely these individuals would be considered co-defendants. With the above considerations, the court rules to deny the suppression request of the defense and side with the prosecution to allow the exhibit to remain and be heard at court.

Exhibit 4:
As the court has already ruled to allow exhibit 5 to remain, we will bypass the initial request of the defense to suppress the reference to the arrest report of Perseus Cable. While it might not be explicitly stated that it is the arrest report of the accomplice, the court is able to see the referenced information in exhibit #5.

As for the second statement given by the officer, "clearly these two were misrepresenting themselves and were caught doing so." The court defines misrepresentation as the act of making a false statement of fact, either intentionally, negligently, or innocently, that leads another party to rely on that statement to their detriment. In this case, that would be the officers believing the statement of the individual. The court finds, based off the bodycam evidence in exhibit #2, that the individuals were attempting to misrepresent themselves. However, he evidence does not fully support the officer’s characterization, and the court therefore rules to suppress the statement completely.
