Type of Representation (Pick one): Public Defender

Charging Department: LSPD

Date & Time of Incident(s): 21/SEP/2024 @ 00:48 & 27/SEP/2024 @ 07:00
Charge(s):
  • VM02 - Operating a Vehicle with a Suspended License (Misdemeanor $1500)
  • GM12 - Giving False Information to a Police Officer (Misdemeanor $1000)
Narrative:
I feel like I was wrongfully arrested by the arresting officer on the night of the 21st. The officer said that the reason for my arrest was "Lying to a police officer." when I had done nothing of the sort. I had asked several times for a Superior to be called, to which my request was met with "Sure, I will call one when you get out of the car." which instantly made me uneasy. I then called 911 to politely ask for a supervisor to assist on this call. The arresting officer backed away to talk on the radio and then said "The person just wants to file a complaint or something." which to me, completely downplays the situation. I had asked for a supervisor because I felt the officer was completely abusing his authority. In the end, I was told to IA it when I got out. My license was suspended when I was booked, and they left my car on the side of the road. They never even bothered to Securely impound it, knowing that I wouldn't be able to drive it when I was released.

After I served my sentence, I asked the same arresting officer if I could have my items back as my time in Jail was swiftly served. However, he just said, "Sorry I'm on a call now." And sped off. I waited in the lobby for almost an hour for another officer to arrive, and they gave me my stuff back. From there, I walked back to parking and took a cab to the airport to catch a flight out of town.

Fast forward to the 27th, I just pulled out my freshly washed car from the lot and began to drive off. Immediately I was pulled over, not even a block away. I pulled over, as I was confused because I had my cruise control on, so I knew I wasn't speeding. After a bit of chit-chat, I was told that I was under arrest for a warrant for driving on a suspended license. My license during the stop was in good standing. I had inquired on when, and by whom, and the officer confirmed that the same officer that arrested me for "Lying to a police officer", placed the warrant on me. I don't know how I could drive on a suspended license in the city when I am out of town on vacation. The officers said there was nothing that could be done as there was no higher-up on duty to look into it, so I just had to serve my sentence and take it up in the courts.

All in all, I feel like the original arresting officer was completely abusing the authority entrusted to him, and wrongfully arrested me. He also abused his power when he placed blind warrants on me when I was not even around to commit the crime that he accused me of doing!

I, Vahan Mirakian, hereby affirm that all information provided above is true and correct to the best of my knowledge, and understand that knowingly providing false information could result in additional charges and/or fines. The State of San Andreas, by and through the undersigned attorney, filed this Motion for Discovery, and presents the following as evidence;

  • Exhibit #1: Arrest Report - Vahan Mirakian, 21/SEP/2024

    Image

    Los Santos Police Department

    ARREST REPORT
    "TO PROTECT AND TO SERVE"

    MUGSHOT
    • SUSPECT DETAILS
      • Full Name: Vahan Mirakian
        Phone Number: 6969
        Licenses Suspended: Yes
        Officers Involved:
        • Police Officer II Carl Jacobs
        Charges:
        • VC10 - Unroadworthy Vehicle
        • GM12 - Giving False Information to a Police Officer
      INCIDENT NARRATIVE
      • Incident Date: 21/SEP/2024

Explain what happened, sufficient detail must be given to justify the placed charges, videos could be provided.
        • Officer Carl Jacobs was leaving Upper Pillbox when he identified a vehicle driving towards him with Orange headlights, LP: YOULOSE.
          Bodycam footage
          Image
A traffic stop was initiated, in which the driver was compliant. Officer Jacobs requested the license from the driver, identifying him as a Mr. Vahan Mirakian.
Mr. Mirakian was questioned as to whether he understood the Penal Code around Unroadworthy Vehicle and what colour reflectors/headlights are required. Mr. Mirakian responded saying "let's find out", turned the vehicle on and displayed white headlights, clearly toggling a switch to change the headlight colour.

Officer Jacobs responded, stating that he had witnessed the headlights being Orange in colour. Mr. Mirakian responded stating that Officer Jacobs must be confused and that it was likely the "underglow", "yellow lights" or the fact Mr. Mirakian was travelling in the opposite direction.
At this point, Officer Jacobs asked directly, "I'm asking if you had orange headlights at any point while driving", to which Mr. Mirakian responded "not today".

Officer Jacobs requested several times for Mr. Mirakian to exit his vehicle after this comment, with Mr. Mirakian flat out refusing to do so until a Supervisor was called and on scene. Officer Jacobs intended to get the individual into cuffs given the fact that Mr. Mirakian was in a high speed vehicle, and then get a Supervisor on scene, but this wasn't sufficient for Mr. Mirakian and he called for a supervisor via 911.

Officer Jacobs called for a Supervisor over the departmental frequency and was informed there would be no supervisor available to respond to the call and to let Mr. Mirakian know that a complaint may be filed via Internal Affairs, to which Officer Jacobs relayed this information along with his badge number to Mr. Mirakian.

Mr. Mirakian then exited his vehicle, placed into cuffs by Officer Jacobs, mirandised twice and then searched of his possessions. At this point, Officer Jacobs transported Mr. Mirakian to Mission Row where he was processed, along with his possessions. During the transport back, Mr. Mirakian claimed that he was just joking with Officer Jacobs with regards to his answers about the orange lights.

Mr. Mirakian received a demerit for the Unroadworthy Vehicle citation which resulted in a 24 hour drivers license suspension.

A decision was reached in the above case on the 25th day of November, 2024.

Due to a lack of response from the defendant in the above case, the case will now be involuntarily dismissed. The defendant was given ample time to interact and file availability. If any of the dates and times did not align with the schedule of the defendant, they were able to contact the courts stating the like.
