A Notice of Activation was entered in the above case on 1st of October, 2024.


The case of the State of San Andreas v. Anthon Chapel (Vespucci) is hereby activated by this Court under #24-CM-0068.

At this time the Defendant has adequate representation, however, a State Prosecutor has not been assigned to this case. At this time the court will delay the Order for Discovery until adequate representation has been assigned and they inform the court they are ready to proceed.

    • I was operating under my primary unit callsign 3-U-17 when a backup call for a possibly armed 10-55 came in from 3-K-13. I responded. Upon being asked to step out of the vehicle, it took off, evading a pursuit ensued where the suspects tried to fit through tight alleyways by Decker Street going around towards the mall. At this point, the vehicle was blocked in, one of the suspects got out and into a dark red Elegy Retro Custom, which I then pursued with Captain Jessica Nash and Captain Jaxon Nash in front of me. The vehicle was firing at the vehicle in front of me, so shots were returned. The vehicle had its tire hit and it subsequently hit a wall. Then I stepped out of my vehicle to fire at the car before it evaded. We lost visual of it. I then started a trace on Tommy Bean which took us to the parking lot on Sinner St. I got the fingerprint test kit from my trunk, taking prints on the steering wheel of the car, and very clear prints from Anthon Vespucci were left behind on the steering wheel. Due to the combination of evidence, I placed the charges.

    • Fingerprints are left on surfaces due to the natural oils on humans skin, when a human touches a surface the oils transfer over leaving behind a 'fingerprint'.

      When collecting fingerprints from a scene Police Detectives are able to tell which fingerprint is most prominent. If someone then touches the evidence without a set of gloves their fingerprints will now be the most prominent. If someone touches evidence with gloves, the first set of fingerprints will be slightly disturbed however still enough to match through the database, while not leaving their own set of fingerprints due to the gloves.

      Detectives are trained to search for prints on items in a situation where there are multiple such as a steering wheel, they are trained to take the most prominent one as it will be the most conclusive print to use as probable cause for arrest

      ((On the server the script is limited to check for the last person to have left fingerprints on the item. While vehicles do not have the same script we use the same principle of checking the last user of the vehicle for fingerprint RP.

      In ECRP a print can still be left on an item while wearing gloves, which is dependent on multiple factors. Realistically this would not be possible however the server makes scripts to have a balance.))

The Defendant, Anthon Chapel, by and through the undersigned attorney, filed this Motion to Suppress, and requests to following be suppressed from evidence;


  • Exhibit #2: Warrant Report - Anthon Vespucci, 26/MAR/2024
    Requested Evidence to Suppress:
    • a red elegy retro custom registered to the suspect picking up another suspect (Tommy Bean)
    • Tommy then shot from the vehicle at officers pursuing officers then lost visual before getting a trace upon responding to the trace Tommy Bean was injured Officer Linton took prints from the vehicle which came back to the suspect
    • Detailed Reasoning:

      Lack of Specificity
      The first bulleted statement is very unclear. The "Red Elegy Retro Custom was registered to the suspect" but the only suspect named is Tommy Bean. It is unclear whether the warrant concerns my client or Mr.Bean. The lack of specificity could confuse the court and this statement should be removed from the warrant as such.

      The second bulleted point also lacks specificity. The warrant speaks of getting a trace but does not state who the trace was conducted on. It is unclear if the officer is speaking about Mr. Bean or my client. The officer speaks on the fingerprints coming back to a suspect but fails to mention who this suspect is. The warrant also has what is called a "run-on sentence." The lack of name use and grammar mistakes make this piece of evidence difficult to understand.

      Other than the topic that mentions the warrant is for Mr.Chapel, my client's name is not used at all in the actual description. The only names used are Officer Edward Linton and Tommy Bean, who is identified as a suspect in the warrant. This warrant report is poorly written, which could greatly confuse the court and raise the question of the warrant's probative value.

      Lack of Evidence
      There is no evidence that the vehicle from which the fingerprints were taken was the vehicle in which they evaded in. The warrant report states that they got into a pursuit with a red elegy retro custom. The officer only states that they ran a fingerprint test on the steering wheel of a vehicle, not an Elegy Retro Custom. With no bodycam footage being shown, there is no evidence that the fingerprints were taken from the Red Elegy Retro Custom.

  • Exhibit #3: Witness Statement - Police Officer III Edward Linton
    Requested Evidence to Suppress:
    • The vehicle was firing at the vehicle in front of me, so shots were returned. The vehicle had its tire hit and it subsequently hit a wall. Then I stepped out of my vehicle to fire at the car before it evaded.
    • We lost visual of it. Due to the combination of evidence, I placed the charges.
    • Detailed Reasoning:

      Lack of Specificity
      The defense would like to highlight the vague statements in this exhibit. The officer continues to talk about a "vehicle" and keeps switching to different "vehicles" in this statement but we do not understand what "vehicles" he is talking about. "The vehicle was firing at the vehicle in front of me..." This leads the question of what vehicle is firing at the vehicle in front of the officer. It is never specified, which should make this statement very questionable on its probative value.

      The second bulleted point speaks on the trace of Tommy Bean. The story jumps to the officer doing a fingerprint test "on the steering wheel of the car" but fails to specify which car fingerprints were taken on. The story jumps from losing visual to being at someone's vehicle and doing a fingerprint test. There is no statement saying thats where they found the Red Elegy Retro Custom on Sinner St. The lack of specification on the vehicle that was shooting and the vehicle that had been tested for fingerprints in this exhibit makes the defense question the validity of this witness statement.

      Lack of Evidence
      The defense would like to retain the same argument as in exhibit #2. The officer's statement speaks on losing visual and then running a trace on Tommy Bean which lead them to a parking lot on Sinner St. The officer does not state this is where he found the Elegy Retro Custom. The officer only explains how he ran a fingerprint test on "the" vehicle which could've been a vehicle different from the Elegy Retro Custom.

        • WF02 - Shooting from a Vehicle (Drive-By)
      INCIDENT NARRATIVE
      • Incident Date: 26/MAR/2024

        Explain what happened, sufficient detail must be given to justify the placed charges, videos could be provided.
        • A pursuit of a 4x occupied vehicle was called into TAC-1. Upon our unit (21-S-4) attaching to the call, the vehicle was said to be shooting at officers from inside and took an alleyway towards the mall from Movie Star Way.

          One of the occupants (Tommy Bean) exited the original vehicle and entered a red Elegy Retro Custom. At which point the Elegy began evading and Tommy continued to shoot from the vehicle at our unit, tires were taken and Mr. Bean was injured in the process, the vehicle crashed on San Andreas Ave bridge, however was able to take back off again and fled. The vehicle fled and was dumped in a parking garage near Mission Row with Mr. Bean injured inside.

A Rebuttal was filed in the above case on the 26th of October, 2024.


The State of San Andreas, by and through the undersigned attorney, presents a rebuttal to the recent motion;

  • Exhibit #2: Warrant Report - Anthon Vespucci, 26/MAR/2024
    Regarding lack of specificity
    • The Defense claims the warrant report lacks specificity on multiple issues. However, by simply reading through the exhibit everything is made clear.

      The first issue is in regard to which suspect is the main topic of the warrant report. However, the warrant report clearly states "Suspect details - Full name: Anthon Vespucci" at the top. Due to this information, there is no cause for confusion in the report. Which suspect is mentioned when is also not difficult to discern by applying logic. The first mention of an unnamed suspect is clearly about the defendant, Anthon Vespucci (now Chapel), as they are the topic of the warrant report. The report then mentions a second suspect, but this time names them as Tommy Bean. Following this, every time the warrant report references the second suspect, their name is used. Every time the report references the first suspect they remain unnamed, in clear reference to the topic of the warrant report, Anthon Vespucci. The defendant's name does not have to be explicitly stated in the warrant report more than is necessary when there are plenty of identifying factors to differentiate between individuals mentioned in the same report.

      The second issue concerns the trace and which suspect was the subject of the trace. Logical thinking is once again the solution. Until the fingerprint analysis had provided its results, law enforcement officers did not know the identity of the driver of the red Elegy Retro Custom which Tommy been initially escaped in. As such, they would not be able to do a trace on that individual. However, they knew the identity of Tommy Bean. This is also supported by the witness statement in Exhibit #3. In their statement, Detective Linton clearly states "I then started a trace on Tommy Bean" The Defense themselves mention the detective's trace on Tommy Bean when arguing to suppress Exhibit #3.

      Furthermore, the minor grammatical errors in the warrant report are inconsequential, despite the Defense's attempt at blowing them up. While attorneys are held to high standards in terms of linguistic capabilities, the same should not be expected of law enforcement officers as long as the evidence is easily understood, as I have just proven it to be. I could also point out several issues in the Defense's motion with various syntax errors, incorrect sentence structures, etc., but it should not be a point of contention in these arguments.

    Regarding lack of evidence
    • The Defense is also questioning the validity of the fingerprint analaysis actually having been done on the Elegy Retro Custom. While the report does not specifically states the Elegy was the vehicle analyzed, logic dictates it must be, as no other suspect vehicle is ever mentioned after the Elegy. Additionally, this is confirmed by the 5th exhibit just filed by the Prosecution.

  • Exhibit #3: Witness Statement - Police Officer III Edward Linton
    Regarding lack of specificity
    • The Defense is claiming the witness statement is vague in regard to which vehicle is being referenced, specifically "The vehicle was firing at the vehicle in front of me" However, just before the referenced phrase, the witness also states "At this point, the vehicle was blocked in, one of the suspects got out and into a dark red Elegy Retro Custom, which I then pursued with Captain Jessica Nash and Captain Jaxon Nash in front of me. The vehicle was firing at the vehicle in front of me, so shots were returned." From this part of the statement it is clear that the detective's unit was second in line behind the Elegy with the two shooting suspects, with another cruiser in between them. Thereby, the Elegy Retro Custom shoots at the vehicle right behind them and first in the pursuit line, the "vehicle in front of me".

      The Prosecution will again argue that the evidence is clear enough, using the same logic as the argument from Exhibit #2. Additionally, this is clarified by Exhibit #5, which state that Tommy Bean was found injured inside the Elegy Retro Custom.

    Regarding lack of evidence
    • The same argument for lack of specificity applies to the lack of evidence, with Exhibit #5 used for additional clarification.

A decision was reached in the above case on the 30th day of October, 2024.


Thank you to both parties for the arguments presented. The court will allow the inclusion of the arrest report in exhibit #5 due to the ability of the defense to review and object to any information contained within it prior to the scheduling of trial.

Exhibit #2

The defense argues that the evidence lacks specificity, specifically the statement "a red elegy retro custom registered to the suspect picking up another suspect (Tommy Bean)" for it's lack of reference to anyone besides Mr. Bean. However, the court would have to agree with the side of the prosecution. The warrant report clearly labels the individual in the report under "Suspect Details" as the defendant. The court would assume that based off the listed suspect, any reference to the suspect from thereon (unless otherwise noted) would be in reference to the defendant. We will deny suppression of the first bullet point.

As for the matter of the trace, the court will recognizes both the arguments of the defense and the prosecution. However, we fail to find probable cause for the trace on Mr. Bean. No narrative or evidence provided by the prosecution suggests how law enforcement were able to identify the suspect (Tommy Bean) to the point where there was sufficient probable cause to trace the individual. The court is giving the prosecution 7 days to gather evidence to this effect or face possible suppression of statements and reports in regards to the trace.
Exhibit #3

As for the overall arguments of the defense, which states that the designated bullet points are not specific enough for the court. They cite a lack of notation between vehicles and a possible misunderstanding by the court due to the lack of detail. The court agrees with the prosecution in this regard when they quote the earlier statement from the witness "At this point, the vehicle was blocked in, one of the suspects got out and into a dark red Elegy Retro Custom, which I then pursued with Captain Jessica Nash and Captain Jaxon Nash in front of me." The statement provided clearly notes which vehicle is being referenced and the court is able to infer from there. That being said, the court will be denying the suppression of exhibit #3.

For now, the courts will be denying the suppression in full. If the prosecution cannot provide probable cause for the trace the court will re-review the evidence for it's admissibility. Thank you to both parties for your patience.

The case is now pending a response from the prosecution. They have been given 7 days time to comply.

    • On the date in question, I was patrolling under my unit (3-U-17). As part of a pursuit, the individual was identified by others and relayed in TAC via his clothing, and subsequently by myself, visually, again via his clothing. The suspect was, at the time, well known to me, his appearance and clothing choices were documented in multiple arrest reports prior to the incident in question. Tommy Bean wore the same clothes, so a trace was conducted on him, finding him in a parking lot just off Sinner St, just north of Mission Row, before San Andreas Ave.

      The clothing identified by myself was his 'pajama' style outfit paired with a red Santa hat. Tommy had been seen and documented in the same outfit multiple times.

        • Detective Cyrus Carver saw wanted individual Tommy Bean alongside other members of the criminal organization known as "The Shadows" in the lobby of Mission Row. Detective Carver processed an active warrant placed by Chief Flores on Tommy Bean. One Mr. Beans associates, Sonny Vespucci started attacking Lieutenant Samuel Martin by striking and punching in order to help Tommy Bean escape. Tommy Bean surrendered to law enforcement with Sonny Vespucci having to be incapacitated by less-lethal means.

Where Tommy Bean was spotted with a pistol .50 on his back, then he drove away on his shinobi. We picked him up 20 minutes later with PC and attempted to detain them. They kind of resisted by trying to escape, but was apprehended and taken into custody. Possession of a class 1 Pistol .50.

        • Officer Ben Masseria responded to a backup from Officer Gary Woods referring to a situation at the Police Impound in the city. Mr Tommy Bean decided to punch Officer Woods and Act in an Aggressive Manner toward Officer Azalea, which resulted in Officers opening fire upon him after persistently displayed aggressive behaviour and acting on these emotions. When I arrived to the scene I treated Mr Beans GSW's and Placed him in my cruiser. I then transported Him to MRPD where he made many Crude Remarks about my and other officers mothers.
          Mr Bean is being charged with-
          GM02- Battery Of A Gov Employee.

A decision was reached in the above case on the 3rd day of October, 2024.


The court finds the evidence provided by the prosecution to be sufficient enough evidence to prove probable cause for the initial trace. That being said, as long as there are no planned appeals to any ruling, the court will move forward with scheduling.

An attempt to schedule was made and recorded by the court on 4h day of October, 2024.


All parties in this case are encouraged to complete the following Scheduling Tool in an attempt to schedule a trial on the above case. When the scheduling tool has been completed by either party, please post on the docket stating as such.

A trial date was set on the above case on 13th of November, 2024.


In accordance with the availability reported by both parties in response to the Notice of Scheduling, this trial shall take place at 9:30 PM on 16th of November, 2024 at Rockford Hills City Hall, Carcer Way, Metro Los Santos, SA.

Both parties are ordered to be present in the Judges Chambers no later than 15 minutes prior to the above listed date for pretrial arrangements. If complications occur that must result in a delay or cancellation of the trial, you are ordered to inform the court no later than 12 hours prior to the above listed date.

A Motion to Amend was filed in the above case on the 15th of November, 2024.


The State of San Andreas, by and through the undersigned attorney, filed this Motion to Amend, the original charges with the underlined amended charges.

    • WF02 - Accessory to Shooting from a Vehicle (Drive-By) of a Government Employee
    • GM14 - Obstruction of Justice

  • Amended Charges
    • VF01 - Evading an Officer
    • WF02 - Accessory to Shooting from a Vehicle (Drive-By) of a Government Employee
    • GM14 - Obstruction of Justice
    • GF16 - Tampering with Evidence
    • WM02 - Possession of a Class 1 Firearm

  • Detailed Explanation: The weapon used by the defendant's associate, Tommy Bean, to shoot at pursuing officers was missing from the suspect vehicle when it was apprehended alongside the injured shooter, Tommy Bean. With the defendant identified as the driver of the vehicle that picked up Tommy Bean and took the now-missing weapon, the Prosecution is filing to add these charges to the defendant's record.

NOTICE OF SCHEDULING


IN THE SUPERIOR COURT OF SAN ANDREAS

State of San Andreas v. Anthon Chapel (Vespucci)
#24-CM-0068

A second attempt to schedule was made and recorded by the court on 18h day of November, 2024.


All parties in this case are encouraged to complete the following Scheduling Tool in an attempt to schedule a trial on the above case. When the scheduling tool has been completed by either party, please post on the docket stating as such.

In the event all parties have overlapping availability the Presiding Judge will determine the best date and time to have a trial take place and post a Notice of Trial informing all of the upcoming proceeding.

In the event some or all parties do not have overlapping availability, the Presiding Judge will continue to attempt to schedule the proceeding or seek alternative avenues to conclude the case.

If either party has the intentions of calling a witness to the stand during the proceeding they must inform the court by filing a Witness List at the time of filing their availability. If no Witness List is filed before the Notice of Trial is filed you will be unable to call a witness during the proceeding.
