State of San Andreas v. Alistair Vespucci

The court has hereby received and acknowledged the above case on the 28th of September, 2024.

The Superior Court of San Andreas has received your filing and the case is now pending activation. Be advised that the court system runs on a first-come, first-served basis and will only activate cases out of order for special circumstances.

COURT DECISION

IN THE APPEALS COURT OF SAN ANDREAS

Alistair Vespucci v. State of San Andreas
#24-AP-0009

A decision was reached in the above case on the 14th day of December, 2024.

The court was informed by the Justice who placed the charge that they are retiring from the legal profession. The Appeals Court requires that paperwork be submitted on the pertaining docket when an individual is charged with contempt of court. Unfortunately, no notice was filed by the assigned judge. Therefore the disputed charge of GF25 - Felony Contempt of Court will be removed from the record of the defendant due to a judiciary failure to follow proper procedure. Thank you to all involved for your patience.

The plaintiff should make their way to City Hall at their earliest convenience to have the change to their record noted as well as the payment of $17,000 returned to them for fines, time, and other expenses/inconveniences incurred from the contested charges.

So ordered,

    • Attorney General Williams,

I am going through my pending work and I received this plea agreement from Alistair Vespucci. Particularly I am concerned because of two reasons:
      1. The charges proposed and the new charges after the plea bargain seem distinctively different. Is it because the prosecution has very weak or little to no evidence?
      2. Also, it is regular procedure for the Prosecution to present plea deals usually, since this is a prerogative that is afforded to the Office of the Attorney General. The other case is the defense presenting them, after they've been already signed by the Prosecution. However in this case Mr. Vespucci is self-representing. I would feel more comfortable if the e-mail/proposition came from you.

With this being said, could you perhaps fill me in a bit in regards to this plea agreement and how it came to be?

      Best regards,

I sat down on the 13th to process the plea agreement. It is procedure within the Judicial Branch that the prosecution reaches out to the judge to present the plea deal, given that plea agreements are within prosecutorial discretion. Since I received it from Mr. Vespucci, I forwarded it to Terry Williams as it had his alleged signature. Shortly after sending an e-mail to make sure everything was in order so that I could process the plea deal (find e-mail attached) and have some concerns answered. After that, Terry Williams reached out to me in person.

After meeting with me, Mr. Williams affirmed to me that the signature was not his and that it was forged as he did not fill a plea agreement of such nature. I requested him to also inform me of this through e-mail to keep a paper trail of such circumstance and later on proceeded to file the charges against Alistair Vespucci for forging the signature of AG Williams and then presenting it to the Court as an official document, not only lying in the process but also interfering with an ongoing case.

Docket Notice

"EQUAL JUSTICE UNDER LAW"

  • Parties,

This is to serve as a FIRST notice to the defendant that bench trials are currently scheduled on multiple days throughout the week. Please notify the court if these times do not work for you. The expectation of the court is that each defendant file a notice for availability in the next 7 days. Date, times, and formatting shown here. The courts will only provide the defendant three notices prior to involuntarily dismissing the case in favor of prosecution due to lack of response from the defendant.

Please note there is the possibility of a trial happening if defendants show up to City Hall and both a judge and defense attorney are available.

    Respectfully,
