A Notice of Activation was entered in the above case on 14th of August, 2024.


The case of the State of San Andreas v. John Chapel is hereby activated by this Court under #24-CM-0056.

Pursuant to the Defendant's request for a Bench Trial schedule, this case is hereby activated.

At this time, the Prosecution is ordered to provide the Arrest Report and/or any supporting documents to be utilized by the Court during the Bench Trial, and conduct the necessary efforts to ensure the presence of a State Representative (Legal Affairs Delegate, Arresting Officer, Prosecutor).

        Explain what happened, sufficient detail must be given to justify the placed charges, videos could be provided.
        • John Chapel (hereinafter referred to as 'the suspect') was witnessed by Police Lieutenant II Jason Steel and Police Detective II Cyrus Carver (hereinafter referred to as 'our unit') assembling together with a group of individuals at parking lot. The group of individuals was generally belligerent to law enforcement, shouting profanities and demands to violence, until the suspect shouted something to the effect of 'let's tackle them' (referring to our unit), then the suspect tackled Police Lieutenant II Jason Steel while in the performance of his duties as a peace officer. He then fled on foot while Police Detective II Cyrus Carver chased behind him. Once apprehended the suspect made threatening statements towards our unit, stating that he is in a dangerous criminal organization and that we can be touched, and we should be careful what we say, or words to that effect. Shortly afterwards, another individual from the same scene circled around and shot a firearm at our unit. This a person that was present when the suspect incited them to physical actions against peace officers. Several other presumed affiliates of his criminal organization approached him, and the suspect told them to "change freq", referring to the fact that he was captured with his active radio frquency, therefore it required change to avoid law enforcement surveillance.

      • Document the possessions confiscated from the arrested suspect.
        Possessions are to be documented individually, examples of documented illegal possessions are "Pistol .50" or "12 grams of Cocaine". Legal possessions that can be categorized may be grouped, eg. "Clothing" to describe all clothing items. Body camera footage/pictures may be attached as an evidence exhibit.

        Where possible, the serial number of each firearm seized as evidence should be noted.

    • Detective Cyrus Carver and Lieutenant Jason Steel were at Legion Square parking lot performing their duties as law enforcement when they spotted John Chapel and a large mob together. The mob and John Chapel were screaming and being a distraction or all law enforcement on scene. John Chapel being especially loud and obstructive. Eventually, John Chapel shouts something along the lines of "Come on tackle them!" or "Lets tackle them" (them being Law Enforcement). Moments after, John Chapel runs at Lieutenant Steel and tackles him. John Chapel immediately sprints away, Detective Cyrus Carver closely behind him screaming at the suspect (John Chapel) to stop running. John Chapel is taken into custody and starts spewing more profanity and threats stating that his gang/organization is a powerful entity and law enforcement is not immune to harm. John Chapel was very specific, referring to himself as dangerous and making it clear he had dangerous friends. John Chapel shouted at a nearby masked individual to take his car away from the scene and once the car was snagged John Chapel said "Oh there goes my gun, It just left the scene!" bragging that his friends were coordinated enough to steal evidence and a dangerous firearm from under law enforcements nose. Shortly after more threats, shots started flying at Lieutenant Steel from a nearby alley, specifically aimed at the Lieutenant while he was in his vehicle. The suspect shooting at the Lieutenant was dressed exactly like someone that was present at the scene prior when John Chapel was inciting violence toward law enforcement. John Chapel also informed members of his organization to change their radio frequency to let them know that the radio frequency John Chapel was on was compromised by law enforcement. The whole scene stemmed from John Chapel inciting violence against law enforcement and led to extreme aggression by several individuals.

ISSUANCE OF VERDICT


IN THE SUPERIOR COURT OF SAN ANDREAS

State of San Andreas v. John Chapel
#24-CM-0056

A decision was reached in the above case on the 18th of August, 2024.


On the 20th of July, 2024, the defendant John Chapel faced an arrest for the crimes of GM13 - Criminal Threats, NM01 - Inciting a Riot, NM03 - Unlawful Assembly, GM-02 Battery of a Gov. Employee and GM04 - Resisting Arrest. On the date of the events, the defendant tackled a police officer, after allegedly inciting his affiliates and people on-scene to disrupt police operations. After tackling the police officer, the defendant allegedly ran on foot in order to evade the repercussions of his actions. Before tackling the police officer, the defendant allegedly had expressed to the group of people with him "Let's tackle them". Once apprehended, the defendant made threathening statements to the police officers involved, stating that he was a member of a dangerous criminal organization, that his affiliates were dangerous and that the police was not exempt to the dangers that said organization could pose.

The Prosecution argued that the defendant willfully tackled a police officer moments after inciting his affiliates to carry out the same action. Furthermore, the defendant ran on foot with the intention to evade the effects or outcome of his actions -particularly, tackling a police officer-. The Prosecution added that shortly after the threats, shots were fired against the police officers by an unidentified person who was seen previously with the defendant and also wore the same apparel.

The defense argued that inciting a riot requires the acts of two or more people together, and insisted that the defendant acted alone and thus, there could not have been a riot. The defense also argued that, even if a group was present, they were not disobeying lawful orders. Finally, the defense added that John Chapel could not have resisted arrest on the basis that he was not aware of being under arrest when he began to run away from the police.

The Court believes that it was proven that the defendant did in fact commit violent acts against Lieutenant Steel, both willfully and unlawfully. The defense argued that the circumstances described couldn't lead to the charge of resisting arrest, particularly because the defendant had not been notified of their imminent arrest before beginning to run. However, it is clear to the Court that the defendant ran from the scene as soon as they got up from the attack performed against the officer in order to stop himself from being apprehended by the police, and thus, the charge of resisting arrest seems valid to the Court. Had the circumstances been different, like for instance the Police having reasonable and sufficient opportunity to notify the defendant of their arrest or detainment, and it not occurring.

The statements made towards the police, in the opinion of the Court, did constitute a threat -albeit future- of bodily harm to the receiving officers.

In regards to the alleged unlawful assembly and the RIOT charge, the Court has to recall previous precedent:
Superior Court of San Andreas, #24-CM-0018 wrote:This Court also determines that for the misdemeanor of unlawful assembly to take place, it is not enough for there to be a plural number of participants in the commission of an illegal act. Said circumstance requires at least proving an intent, willingness, or otherwise premeditated desire to disobey the law—or law enforcement instructions—with an ulterior motive.

The Court believes that the acts conducted by the defendant and the circumstances in which they occurred, do not fulfill the expectations set by the Superior Court in the quoted paragraph.

Finally, while the context within the description of participating in a RIOT might be descriptive and useful, the crime of inciting a RIOT requires the attempt or fulfillment. In this case, it is clear that a RIOT did not initiate, but the Court considers the defendant's actions to attempt the initiation of one.

It is with the above considerations that I issue the following verdict:
  • On the count of GM02 - Battery of a Gov. Employee, I find the defendant, John Chapel, guilty.
  • On the count of GM04 - Resisting Arrest, I find the defendant, John Chapel, guilty.
  • On the count of GM13 - Criminal Threats, I find the defendant, John Chapel, guilty.
  • On the count of NM01 - Inciting a Riot, I find the defendant, John Chapel, guilty.
  • On the count of NM03 - Unlawful Assembly, I find the defendant, John Chapel, not guilty.
