      Provide details of the incident leading up to the arrest
      • There was an active hostage situation at city hall involving multiple VIP's. While this situation was going on there was a murmured voice coming from the vents feeding the hostage takers information. Because of this I went to the roof of city hall using the ladder and found waldo marshal on the roof calming to be asleep. We could not link the fact that he was the one supplying information to the hostage taker because of the amount of vents at city hall. But he was charged with trespassing, although he was not in the gated helipad of city hall just at the top of the ladder by the vent. He was then taken to MRPD and requested a supervisor who where all 10-9 in the hostage situation. Fillmoore Grayson said there is no supervisor avaliable and to process him, I provided Waldo Marshall with my badge number and Fillmoore Grayson's.

ISSUANCE OF VERDICT

IN THE SUPERIOR COURT OF SAN ANDREAS

The State of San Andreas v. Waldo Marshall
#26-BT-0006

A decision was reached in the above case on the 26th day of April, 2026.


Facts

  • The defendant was found after units went up a ladder at the back of City Hall following reports of an individual providing information through the ventilation.

Arguments From Either Side

The prosecution argues that the defendant was somewhere he was not supposed to be, that individuals are not allowed onto the roof of City Hall or up the ladder at the back, and that this is common knowledge.

The defense argues that the individual accessed a publicly accessible ladder where there is no signage surrounding the area. They state there was no evidence of criminal intent or involvement in criminal activity.
Verdict

The Court finds that the defendant did make their way onto the roof of City Hall. As presented in the exhibit, the defendant did not pass through the locked gate but remained in an accessible area of City Hall.

The Court notes the distinct lack of signage presented today. Trespass, as a law in our state, requires that there be notice to the individual. This can be done via signage, verbally by law enforcement or a licensed manager, or through written documentation accepted by the courts, known as a Written Notice of Trespass.

With the lack of notice to the defendant, either by signage or verbally by officers on scene, as well as no record of the defendant using this access to further criminal activities, the Court cannot determine whether this was done with malicious intent or with the knowledge that the defendant was not allowed to access the area.

It is with the above considerations that I issue the following verdict:
  • On the count of NM06 - Trespassing, I find the defendant, Waldo Marshall, not guilty.
The defendant should make their way to City Hall at their earliest convenience to have the change to their record noted, as well as the payment of $4,500 returned to them for fines, time, and other expenses or inconveniences incurred from the contested charges.
