      • While conducting surveillance on a known gang member near Integrity Apartments, I observed an individual dismount from a black Drauger registered to Kyle Vice. The individual appeared to have a Class 1 firearm mounted on his hip. As I was operating in an undercover capacity, I requested marked backup units to initiate a traffic stop.

        Upon the stop being conducted, the individual identified as Kyle Vice was found to be in possession of a modified Class 2 firearm, as well as controlled substances.

ISSUANCE OF VERDICT


IN THE SUPERIOR COURT OF SAN ANDREAS

State of San Andreas v. Kyle Vice

A decision was reached in the above case on the 15th day of December, 2025.


The Court has reviewed the entirety of the evidence, testimony, and arguments presented by both the Prosecution and the Defense during the on-the-spot bench trial conducted in this matter. The Court notes that the trial proceeded with Tim Sutton as representation for the prosecution, and Kyle Vice self-representing himself.

The evidence presented included the arrest report authored by Deputy Miles Logan, body-worn camera footage from Deputy Logan and Detective Tim Sutton, and photographic evidence of the firearm, weapon modifications, vehicle, and controlled substances recovered during the incident.

The incident occurred on the 15th of December, 2025, following surveillance operations conducted by members of the Los Santos Sheriff’s Department near Integrity Apartments. Deputy Logan testified that he observed the defendant, Kyle Vice, dismount from a black Drauger registered in his name while visibly armed. Due to the undercover nature of the surveillance, marked units were requested to initiate a lawful traffic stop.

Upon execution of the stop, deputies discovered the defendant to be in possession of a modified Class 2 firearm. Further investigation revealed the presence of controlled substances while the defendant was armed, later identified as approximately twenty five (25) marijuana seeds. Evidence further demonstrated unlawful weapon modifications consistent with the charged offense.

The Defense argued that the search of the defendant and his vehicle violated the defendant’s constitutional protection against unreasonable searches and seizures, asserting that deputies lacked probable cause to initiate the stop and conduct the subsequent search. The Defense contended that the evidence obtained should therefore be excluded.

The Court rejects this argument. The Court finds that Deputy Logan’s direct observation of the defendant in public view while visibly armed provided reasonable suspicion, and upon confirmation of the firearm and subsequent discovery of unlawful modifications, established probable cause for the search and seizure. The presence of a visible firearm, combined with the circumstances of the stop and officer safety concerns, justified the deputies’ actions under established constitutional standards. Along with the defendants outburst stating he was in possession of the firearm.

Furthermore, the recovery of contraband occurred pursuant to a lawful stop and search incident to arrest. The Court finds no constitutional violation in the deputies’ conduct.

The Court finds that the Prosecution established, beyond a reasonable doubt, that the defendant knowingly possessed a Class 2 firearm, that the firearm was unlawfully modified, and that the defendant possessed a controlled substance while armed. The Defense did not present evidence sufficient to rebut the State’s case.

Accordingly, the Court finds the defendant Kyle Vice:

  • WF03 – Possession of a Class 2 Firearm, guilty
  • DM04 – Possession of a Controlled Substance While Armed, guilty
  • WM03 – Criminal Use of Weapon Modifications, guilty


Additionally, during the course of the bench trial proceedings, the defendant engaged in repeated and unprecedented disruptive outbursts within the courthouse. Despite multiple warnings from the Court, the defendant continued behavior that materially disrupted court operations and demonstrated a willful disregard for the authority and decorum of this Court.

The Court finds that such conduct satisfies the elements of Contempt of Court, as the defendant’s actions were intentional, obstructive, and undermined the orderly administration of justice.

Therefore, it is the judgment of this Court that we see:

  • GM22 – Contempt of Court, guilty
