A Motion for Voluntary Dismissal without Prejudice was filed in the above case on the 9th of October, 2025.
The State of San Andreas, by and through the undersigned attorney, filed this Motion for Voluntary Dismissal without Prejudice, and the reasoning for request is as follows;
- Reasoning: Lack of evidence
- Detailed Explanation: Following a corruption of several files across Judicial Branch and Prosecutor's Office servers, vital evidence has been corrupted and is no longer recoverable or able to be pulled from storage. After discussions with the arresting department, the Prosecution has decided to drop the case against the defendant without prejudice on the account that the investigation is still ongoing and may uncover more evidence. However, at this time the Prosecution does not see enough probable cause in the relevant evidence to maintain the charges.

MOTION FOR VOLUNTARY DISMISSAL
A Motion for Voluntary dismissal was filed for this case from the Prosecution and was accepted.
As the Prosecution holds the burden of proof, and the unfortunate corruption of files and loss of evidence and the impact as affirmed by the Prosecution, the Court finds the Prosecution unable to meet their burden of proof at this current time. The Court will therefore accept the motion to dismiss. Given the continued investigation, the Court will dismiss without prejudice. However, the Court does note any further filing of charges against this Defendant related to this case will need to follow existing law on statute of limitations.
The defendant should make their way to City Hall at their earliest convenience to have the change to their record noted as well as seeking a refund for fines, time, and other expenses/inconveniences incurred from the contested charges.
