        Explain what happened, sufficient detail must be given to justify the placed charges, videos could be provided.
        • Police Detective III Carver witnessed the suspect at a drug lab location along with multiple affiliates. A 10-66 was conducted along SD units on the suspect's vehicle and relative occupants and she was arrested according to the earlier events. Once at Mission Row, the suspect lied in multiple instances about possessing a glasses prescription, behaving erratically pretending not to see the surroundings, and actively disrupting a scene in which law enforcement officers were processing 7 other affiliates of Mrs Porter.
      EVIDENCE DETAILS
      • Document the possessions confiscated from the arrested suspect.
        Possessions are to be documented individually, examples of documented illegal possessions are "Pistol .50" or "12 grams of Cocaine". Legal possessions that can be categorized may be grouped, eg. "Clothing" to describe all clothing items. Body camera footage/pictures may be attached as an evidence exhibit.

        Where possible, the serial number of each firearm seized as evidence should be noted.

    Witness Statement
    • Detective Cyrus Carver was operating undercover, in plainclothes and masked. Detective Cyrus Carver witnessed multiple individuals including but not limited to Nellie Porter at the location of a drug manufacturing lab northeast of the Alamo Sea. Upon Detective Carver entering the area, all the suspects quickly mounted up into vehicles. Ricky Swartz started packing up the drugs that were cooking on the tables, quickly gathering materials and narcotics in a rush. He then ran into Nellie Porter's vehicle and they fled the scene. Detective Carver called out all the vehicles fleeing and a stop was performed on the Kamacho with Nellie Porter in it. A drag fled the scene and led half the officers on scene in a chase.

      Nellie Porter was uncompliant the entire arrest and lied multiple times about have a prescription for her glasses.

The purpose of this subpoena is to ensure that all relevant evidence is reviewed. The recording is essential to evaluate whether law enforcement officers lawfully conducted the search, gave appropriate instructions, and properly distinguished Ms. Porter's behavior from that of others at the scene. Without access to this footage, defense can not properly challenge the general allegations made in the arrest report, risking violating our defendants due process rights under the 5th Amendment.

A decision was reached in the above case on the 30th day of May, 2025.


The court will be denying the subpoena request, as police bodycam should be requested via Motion to Compel Discovery. The court also notes the prosecution's notice that they were unable to obtain any bodycam in preparation, and as such while the defense is welcome to post the correct motion they should be prepared to move forward with the fact the body-camera footage is unfortunately corrupt at this point in time.

Furthermore, the court will be formally granting the prosecution's motion to amend charges as the defense has not objected and would reasonably not object to lesser charges.

A decision was reached in the above case on the 13th day of July, 2025.


The Court has come to a decision in regards to the Motion to Compel Discovery filed by the defense on the 1st day of June, 2025.

While the Court has no issue with the Motion to Compel Evidence, we do recognise the prior responses from the Prosecution stating the evidence is unavailable. With that in mind, the Court does not wish to unduly burden the Prosecution with attempting to retrieve the evidence they have already stated is unavailable.

Given that all matters on the docket are now formally responded to, the Court would like to see this case be scheduled.

"EQUAL JUSTICE UNDER LAW"

  • Parties,

    This is to serve as a SECOND notice to the defendant that bench trials are currently scheduled on multiple days throughout the week. Please notify the court if these times do not work for you. The expectation of the court is that each defendant file a notice for availability in the next 7 days. Date, times, and formatting shown here. The courts will only provide the defendant three notices prior to involuntarily dismissing the case in favor of prosecution due to lack of response from the defendant.

    Please note there is the possibility of a trial happening if defendants show up to City Hall and both a judge and defense attorney are available.

COURT DECISION


IN THE SUPERIOR COURT OF SAN ANDREAS

State of San Andreas v. Nellie Porter
#25-BT-0022

A decision was reached in the above case on the 3rd day of August, 2025.


Due to a lack of response from the defendant in the above case, the case will now be accepting the plea of guilty from the defendant. The defendant was given ample time to interact with the courts and file availability. If any of the dates and times did not align with the schedule of the defendant, they were able to contact the courts stating the like. As little to no contact has been made with the courts in the past 3-4 weeks, this case will now be archived and the charges will remain on the record of the defendant.
