- During the above proceeding, multiple motions were posted by the defendant in succession of one another. Due to the nature of the motions, a docket notice was written by the Prosecution asking for a decision to be made on how to proceed with the motions. Following this notice, no court decisions were issued by the presiding judge on how to proceed. Rather, the judge proceeded to issue a verdict on the case as a whole, without ruling on any of the presented motions. This verdict and lack of court decision did not allow for any rebuttals to the presented motions, nor any arguments to be made regarding the contents of the presented motions. By not ruling on the presented motions or issuing a court decision before the verdict, the judge ruled on the case summarily as if a Motion for Summary Judgment had been presented, which it had not. This lack of response from the presiding judge on the docket notice and pending motions meant that a verdict was issued in accordance with certain legal principles without the Prosecution having been afforded its required chance at making a counter-argument to those principles.
This appeal is not filed with the purpose of getting a verdict overturned, but rather to set a precedent that will force the judiciary to follow a certain order of action when issuing court decisions and/or verdicts.
