MODIFIERS
  • The charges set forth in this handbook are subject to the following modifications in certain circumstances:

    Accessory to a Crime - [Modifier] 0.5x
    Any person assisting with the completion of a crime may be charged with 'Accessory to' the crime.

    Attempt of a Crime - [Modifier] 0.5x
    Any person who attempts a crime may be charged with the 'Attempted' crime.

    Aggravated Crime - [Modifier] 1.5x
    Any person who commits a crime where any victim requires hospitalization as a direct result of the crime.

    Crime against a Government Employee - [Modifier] 1.5x
    Any person(s) who commits a crime against an on-duty peace officer, paramedic, firefighter, correctional officer, executive, judicial, or legislative branch official, or their property.
SPEED LIMITS
  • The following speed limits are considered when used in relation to any traffic related offenses:
    Del Perro Pier - 50km/h
    City Speed Limit - 80 km/h
    County Roads - 120 km/h
    Highway Speed Limit - 145 km/h

  • Charges are met with BOTH jail time & fines for legal fees and penalties.
    If a suspension is currently issued, and a new crime is committed, the player will receive an additional suspension of up to 10 days.
    • Intact - License remains in place as is.
    • Suspend If Used - Only suspend if the suspect actively used the license or the permissions the license grants during the act of the crime.
    • Suspend - Depending on the roleplay, if they commit the crime and own a license of this type, it will be suspended per the penal code time listed.

VC04 - Illegal Parking
A person commits the offense of Illegal Parking if the person parks or leaves standing a vehicle in a place where parking is prohibited, including:
  • In a space where parking meters are enforced, without paying for parking.
  • At any place a 'No Parking' sign is posted.
  • Wherever the curb is painted red or on a safety zone, where the roadway is painted with stripes.
  • In any intersection or on a crosswalk or sidewalk, except on the curb itself.
  • In front of/blocking a public or private road, driveway, or alley.
  • On a freeway, except in an emergency.
  • In a tunnel or on a bridge, except where permitted by signs.
  • Within 10 feet of a fire hydrant, fire station driveway, or railroad track.
  • Facing the wrong direction, against the flow of traffic.
  • At any other place where parking will obstruct the free flow of traffic.
Exemptions to this violation include:
  • Vehicles standing or parked when an on-duty law enforcement officer lawfully orders a stop.
  • Vehicles standing or parked momentarily for the purpose of and while actually engaged in loading or unloading of property or passengers.
  • Vehicles owned or operated by the state or city when standing or parking is necessary to: perform maintenance or repair work on the roadway; or collect solid waste, recyclable material, or yard debris.
  • Commercial or government-owned vehicles with an 'SA EXEMPT' license plate, indicating an exemption to minor parking infractions.
  • Vehicles, owned by state and city employees, standing or parked at properties owned by the State of San Andreas.
Law enforcement officers may move, require to be moved, or impound a vehicle that is standing or parked in violation of this section.

VC05 - Improper Traffic Maneuvers
Improper traffic and road usage can include any of the following.
  • Illegal U-turn by performing a U-turn that crosses lanes of traffic in a reckless manner, without yielding prior to performing the turn, or in an area where U-turns are prohibited.
    • On a divided highway by crossing a dividing section, curb, strip of land, or two sets of double yellow lines.
    • Where a “No U-turn” sign is posted.
    • When other vehicles may hit you.
    • On a one-way street.
    • Where you cannot see clearly 60 meters in each direction because of a curve, hill, rain, fog, or other reason.
  • Failing to maintain a lane while commencing with the normal flow of traffic.
  • Tailing or closely following another vehicle in which could result in an accident or injury.
  • Failure to Yield for appropriate Traffic Control Devices defined as any sign, marking or device intended to direct road usage, such as but not limited to: stop signs, yield signs, speed limit signs, signs directing traffic flow, no passing signs, one-way signs, no parking signs, traffic lights, etc.
San Andreas defines yielding as slowing down before a traffic control device and making sure that the intersection is clear. The first vehicle at an intersection has right of way.

VC10 - Unroadworthy Vehicle
Vehicles are defined as unroadworthy when they fail to meet Minimum Safety Requirements. At the discretion of the handling officer, if your vehicle is deemed unsafe it might be towed to an impound.

A vehicle operating on public roads must meet following criteria:
  • Must have WHITE or YELLOW color on lamps and reflectors, to be visible for those in front of the vehicle. *
  • Indicators, lamps, side & rear view mirrors, and seatbelts must be present and undamaged.
  • The vehicle must be registered with the State of San Andreas.
  • The vehicle must not cause damage to road surface or structures.
* The colors that emit from your lamps and reflectors may be in a different color if the vehicle is due to attend a vehicle-related event. The vehicle may then only travel from its home destination to the event, and back. Proof of attendance should be presented to officers upon request.

Utility vehicle operators are expected to be conscious about road accessibility and to operate with as little harm to traffic flow by keeping to the right most lane possible, driving within safe speeds, and waving traffic around them in the event they are causing a disturbance. Utility vehicles causing traffic issues may face fines for misuse. Utility Vehicles are defined as Money Transporters, Delivery Services, Waste Transports, Tractors, etc.

VC11 - Failure to Pay a Toll
It is unlawful for a vehicle to go through a toll without paying the toll or other charges on any vehicular crossing or toll highway. Drivers may not drive through a toll on another driver's cost. Its is the responsibility of the occupants of the vehicle (I.E. the driver or passengers) to pay the toll on each crossing. Vehicles with a special permit from the San Andreas State Government may cross a toll without paying, but must present the permit to the toll booth operator.

GC04 - Face Concealment
An individual may not be present on foot and wear facial concealment in public or on the property of San Andreas. Exemptions apply when facial concealment is worn during masquerades and other entertainment events that are deemed appropriate by the city (such as Halloween), or where there's reasonable cause e.g. motorcycle protection or medical reasons (with documentation from a registered medical practitioner).
  • Private Property owners have the right to refuse and/or allow attendants who wear facial concealment within the boundaries of their property.
  • Individuals who defy a lawful request to remove and/or keep their facial concealment off or fail to identify themselves after removing the face covering are liable for GM-10 and a subsequent upgrade of GC-04 to GM-19.
  • GM-19 will apply instead of GC-04 for individuals who wear facial concealment in relation to other criminal acts.
  • Individuals who have been cited and/or arrested for facial concealment in the past 7 days are liable for prosecution under GM-10 at the discretion of the handling law enforcement officer.

GF22 - Breach of Trust
  1. The offense of Breach of Trust occurs when a trustee exercises control over information gained during employment with a government agency in a manner that exceeds their authorized role.
  2. It shall be unlawful for any trustee to disclose, transfer, or utilize entrusted information for personal gain or any purpose other than that for which it was entrusted.
  3. Trustees shall not convert their limited control over entrusted information into full ownership while the information remains under their stewardship.
Definitions
  1. Trustee: Any individual or entity entrusted with confidential information.
  2. Trustor: The entity or person conferring confidential information to a trustee.
  3. Government Agency: Shall be defined by the executive branch, with a changing list of organizations that evolves with time.
  4. Exercising Control Over Information: Actions by a trustee that involve making decisions about the use, distribution, or modification of the confidential information that go beyond the scope of their authorized role. This includes, but is not limited to, unauthorized copying, altering, or retaining the information for purposes not sanctioned by the trustor.
  5. Utilize Entrusted Information: The act of using confidential information for any purpose other than that for which it was entrusted. This includes, but is not limited to, using the information for personal gain, sharing it with unauthorized parties, or leveraging it for competitive advantage.

Whistleblower Protections

  4. Trial Process:
    1. The accused whistleblower shall have the right to a fair and public hearing by an impartial tribunal.
    2. Evidence shall be presented by both the prosecution and defense, with the opportunity for cross-examination.
    3. The court shall consider the intent behind the disclosure, the relevance to uncovering corruption or malfeasance, and whether the disclosure was made in good faith.
    4. The burden of proof lies with the prosecution to establish that the disclosure was not made in good faith and was not intended to expose wrongdoing.
    5. If the court finds the disclosure was made in good faith and intended to uncover corruption or malfeasance, the individual shall not be convicted of breach of trust.
  5. If the court determines that the individual was not trying to expose wrongdoing, they may be prosecuted for breach of trust.
  6. Examples of disclosures that would not be considered exposing wrongdoing include, but are not limited to:
    1. Disclosing confidential information for personal gain, such as selling information to a third party.
    2. Sharing information with competitors or other unauthorized parties to gain a competitive advantage.
    3. Leaking information out of spite or revenge against the trustor or another individual.
    4. Disclosing information that is irrelevant to public interest or does not reveal any corruption or malfeasance.
Enforcement
  1. Law enforcement agencies shall be empowered to investigate allegations of breach of trust. However they will not be empowered to apply this charge to individuals.
  2. The burden of proof shall lie with the prosecution to establish the guilt of the accused beyond a reasonable doubt.

  1. The statute may stand if the goal of carrying out an armed assault was successfully orchestrated or not. An attempt to carry out an assault would constitute willfully gathering with the goal of carrying out the assault, meaning there can be no "attempted" modifier on this crime.
  2. Every person who operates as an accessory to the assault or attempted assault as outlined in the statute would be considered to be willfully gathering with co-conspirators, meaning there can be no "accessory" modifier on this crime.
  3. As the charge is already considered to be targeting government officials, there can be no "of a Government Employee" modifier on this crime.
  4. As this charge is defined as a group congregating to commit a subsequent crime, there can be no "Aggravated" modifier on this crime.
  5. A person must not be in physical proximity to co-conspirators to be considered willfully gathering with them, they merely need to be coordinating to carry out the same assault.
  6. A person may be considered a participant if they have taken part in or been audience to written, verbal, visual, or electronic communication used to organize the assault.
  7. A person may be considered a willful participant if they have not faced any undue impediment to remove themselves from the situation and contact law enforcement.

  • All charges within this section shall ONLY be issued by authorized members of the Business Licensing Bureau, the Attorney General as directed by the Business Licensing Bureau, or by the head of the Executive Government.
  • When required or called upon to execute the authority of the laws in question, Law Enforcement agencies may interact with the charged individual only for the purposes of detainment (Including the procedures required for detainment) or legal questioning.
