Superior Court of San Andreas - Civil Court Filing Information

Citizens who find themselves in a disagreement with another party involving contractual obligations, written or verbal agreements, or are facing certain family law matters may petition the courts to hear their case, where one of the Judicial Branch's Judges will review all relevant evidence and testimony in a professional, impartial and timely manner, ensuring that each party's legal arguments are considered so that proper justice may be upheld.

As a citizen of San Andreas, you have the right to seek legal counsel from an attorney licensed by the San Andreas Bar Association. Your attorney may assist you throughout the civil court process, helping you understand your rights, help you form arguments, and present or defend your case.

The Civil Court will accept cases involving breaches of contract, interpretation or enforcement of contractual terms, failure to perform agreed-upon contractual duties, disputes over written or verbal agreements, and matters related to contract recission, reformation, or restitution. Certain family law matters, such as divorce proceedings, may also be heard before the Civil Court.

However, at this time the Civil Court will not be hearing tort claims such as negligence or defamation, property disputes unrelated to a contractual agreement, employment matters lacking a specific contract, constitutional or administrative claims, or any case seeking criminal penalties. It is important to ensure that, before filing, your case meets the criteria and jurisdiction that the Civil Court operates.

To ensure that all Civil Court matters are processed in a fair, efficient, and unbiased manner, the Civil Court requires that all filings meet certain minimum standards. These requirements will enable the Court to evaluate the nature of the dispute, confirm that the case falls within the jurisdiction of the Civil Court, and prepare all parties for the case.

Any individual citizen or registered business entity within the State of San Andreas may file a civil claim, provided that the matter falls within the defined accepted cases as per the previous section. An authorised representative of a registered business entity may also file the claim on behalf of the business entity.

All Civil Court filings must be complete and accurate at the time of submission. A valid filing must include the following:
  • A fully complete Civil Case Application
  • A clear written statement outlining the nature of the claim
  • A copy of the written contract, if one exists
  • Proof that parties have attempted dispute resolution, when required by the terms of the agreement
  • A detailed list of the remedies being requested
  • A list of all evidence and witnesses to be presented
While the Civil Court strives to hear all valid contractual disputes, Judicial Branch Judges retain their discretion to reject any case submitted so late that the fairness of the proceedings may be in jeopardy. Once the Civil Court has accepted a case, both parties will be granted fourteen (14) days to provide discovery.

All Civil Court cases will follow the format of a Bench Trial. Either side may retain a bar-licensed representative to represent them during the trial; however, self-representation is always an option. It is important to note that while Judicial Branch attorneys who have completed appropriate training can provide representation in the Civil Court, this representation will not be free, unlike the Criminal Court.

While Civil Court cases follow the Bench Trial format, there are slight differences compared to the Criminal Court Bench Trials. Both sides will begin by presenting their Opening Statements, then the Plaintiff will present their case and evidence, followed by the Defendant presenting their case and evidence. Once all evidence has been presented, the presiding Judge will then ask any questions of both parties, before the Plaintiff and then the Defendant move into their closing statements.

Once the trial has been concluded, the Judge will retire for deliberations before presenting the oral verdict. The Judge will then have seven (7) days to provide the written verdict to the docket; however, at that time, the oral verdict is binding.

The standard for the Burden of Proof in Civil Court contract litigation is that there must be a preponderance of evidence for the plaintiff to prove their case (which equates to more than a fifty percent certainty).

As contract disputes can be complex, the Civil Court will provide a brief list of definitions for uncommon terms. A San Andreas Bar Licensed Attorney should be contacted if you need assistance with filing a Civil Court claim.
  • Dispute: A disagreement between parties regarding specific details, obligations, or performance under a contract. This may include differences in interpretation of the terms, alleged breaches of the contract, or potential issues related to payment, delivery, or quality of work provided under a contract agreement.
  • Remediation: The corrective action to be taken by the at-fault party to resolve the dispute. This may take the form of repayment of funds, returning possessions transferred under contract, potential financial penalties, or other suitable methods. This will be unique among the different disputes.
  • Recission: A form of decision that a Judge can enforce: Essentially cancelling the contract and returning both parties to the position they were in before an agreement was made. This would typically remove and return any benefit either party received.
  • Reformation: A form of decision that a Judge can enforce: Upon coming to an understanding on what the interpretation of a contract should have been, a contract may be rewritten to reflect the parties' true intentions when a contract may have errors or ambiguities.
  • Restitution: A form of decision that a Judge can enforce: This requires that a party return stated benefits or compensation that was received unjustly. This typically applies when a contract is voided or terms have been breached.

A Judicial Branch Judge will review your case based on the initial submission to determine whether or not it may proceed to trial, so incorrect or incomplete filings may result in the submission being rejected.
