The San Andreas Judicial Branch has released an updated and streamlined guide to filing appeals, replacing the previous version with clearer rules, expanded explanations, and improved public accessibility.
Some of the most important updates for individuals and attorneys:- Simplified explanation for when an appeal can be filed to challenge motions, correct egregious judicial errors, or present new evidence. It now includes a more formal definition of what qualifies as an “egregious error”.
- The timeline to file an appeal after a verdict has been expanded from 72 hours to 7 days. The update also notes an exception for late filings when new evidence of innocence is discovered.
- Defines the possible results of an appeal, such as affirming, reversing, modifying, remanding, or dismissing an appeal.
- The submission form no longer places a maximum word count on the appealing party. Instead the court welcomes the first post submitted to the Court of Appeals to be akin to an initial written brief.
