I am looking to speak with a member of the organization regarding an article I am working on. The article is on the benefits of legalizing marijuana in the state and I would like to get information on charges from possession and distribution are handled, the sentences and the stance on the matter from LSPD.

  • Dear @Ravyn Leroy,

I hope you are doing well first and foremost.

The State of San Andreas Penal Code defines all controlled substances as illegal unless a valid medicinal prescription is present, this includes marijuana. There is currently no legal way of obtaining marijuana. The Los Santos Police Department offers its officers the ability to utilize officer discretion when a subject is found in the possession of 7 grams or less of marijuana if their explanation and purpose is recreational or medical (the Los Santos Emergency Services does not give out marijuana prescriptions). An Officer can choose to confiscate marijuana and let the person go, or arrest them for DM-01 Controlled Substance Possession - meaning 8 grams or more will result in an arrest for the aforementioned crime. If the person has committed any other crimes in relation to possession, then Officer discretion is no longer valid and they should be charged with DM-01 Controlled Substance Possession. If the person is armed whilst being in the possession of marijuana, they should be arrested for DF-03 Possession of a Controlled Substance While Armed, regardless of the firearm being licensed or not, and regardless of how many grams they have in their possession.

In terms of distribution, if an individual is found in possession of an illegal drug greater than 20g or less than 20g in a way that would indicate use for sale and delivery they will be charged with DF01 - Illegal Drug Possession with Intent of Sales per the State of San Andreas Penal Code. DF05 - Drug Trafficking is brought up if an individual is found in possession of fifty (50) grams or more of an illegal drug per the State of San Andreas Penal Code.
