DEFENDANTS STORY/OPENING STATEMENTS: Monday the 27/12/2021, around 6 pm-ish, I was a bit joking around with my co-worker Adam Scotts, as we both were like to do the joke to zip tie him. And took him, with consent around the city. As that we both had the fun to call a police officer and tell them, without being serious that I had someone in my car and want to get some food or water. As the officer asked who I had, I just gave him the name of Adam without any thoughts. Because we were joking around. So we went to a friends house to get picklocks again to uncuff him. As we arrived, and I was going into the house, I just heard sirens behind me, and that was the point where I realised that went way to far. So I told the officer that it wasn't meant serious at all, we both were just joking around and all. At that point, he told me I have no choice anymore. My friend outside told them already that it consented, so the Felony of the Kidnapping is not true, due to the fact I have it on bodycam that he consented to it. Before they went inside the house, I had my hatchet and hurt myself cause I was so scared at that moment. I thought its the only way out to bleed out. The next thing I know is that I woke up in the hospital, and the police arrested me and escorted me to the DOC. So I was charged to Kidnapping and extortion of a government employee, cause I called the Officer and was told that I need food and water because I was hungry. But I didn't tell him he has to give it to me, just if he wants to. Besides that, my friend Adam was telling him that he doesn't want to press charges and agreed that we did it.

- Senior Attorney Hugh Allgood,
I have been approached by a couple of officers who told me that an LSC employee is being held hostage and they [the officers] were talking to the hostage-taker on the phone. The suspect was asking for food and one of the officers recognized the voice of the hostage-taker. I traced the phone of the hostage-taker while he was in an active phone call and reached the area of interest (Wild Oats Dr). There I found a blue muscle car with a zip-tied man in the back seat. The man, which I later identified to be the victim, said the hostage-taker ran inside and thinks that it was actually his friend.
The victim stated that he got picked up from LSC and thought it was some kind of prank. Once the hostage-taker called the police and demanded food, he asked to be released but the individual refused. At that point, the victim realized that he was a hostage and wasn't so sure about the real identity of the individual anymore (since William Taylor had his face concealed).
They arrived at the house in question and the hostage-taker ran inside, leaving the hostage in the car. We breached into the house, with METRO's assistance, and inside we found an almost naked William Taylor; bleeding out. The clothes that he was wearing and the great majority of his items, including lockpicks and zip ties, have been hidden in the shower. Apparently, he [William Taylor] hit himself with a hatchet and attempted suicide but we managed to save his life and EMTs assisted after being called.
The suspect said that he did not kidnap the individual and call the police because he was hungry. When he realized that the charges are going on his record, he pleaded guilty and asked to go easy on him because "it was a joke" and "he made a mistake".
The victim told us that he got kidnapped and has never asked explicitly for the charges to be dropped.
As a final statement, I believe that the individual should be charged with GF-24 Perjury since what he told us after his arrest does not match the official statement he has sent the Judicial Branch for this appeal, making it a false statement.

Detailed explanation:
Mr. Taylor was charged by the Los Santos Police Department for kidnapping and attempted extortion of a government employee. According to the San Andreas Penal code, kidnapping is defined under SF04 as, "The imprisonment or forcible acquisition of another person against their will and moving them within the county, state, or country."
and extortion is defined in the San Andreas Penal code under GF05 as, "Obtaining property from another person through force or intimidation".
In his appeal application, Mr. Taylor claims he took another person (Adam Scotts) with Mr. Scott's consent, which included the use of zip ties, and took Mr. Scotts around the city for "fun". Mr. Taylor claims he called a police officer to demand food and water. Not taking the call to law enforcement as a serious matter, Mr. Taylor alleges he proceeded to prepare to release Mr. Scotts, when he heard the arrival of law enforcement, at which time he told law enforcement it was a joke, which Mr. Scott's purportedly confirmed.
During the discovery period, I have obtained statements from the various members of the police department involved in the arrest and charging of Mr. Taylor. First off, I would argue that Mr. Taylor has been less than truthful with the court on his intent on taking Mr. Scott, and his intent to release Mr. Scott.
According to the statement from Officer Papadakis, the negotiations with Mr. Taylor went back and forth for some time, before METRO decided to breach the residence where Mr. Taylor was located with injuries he inflicted upon himself. In my humble opinion, this does not seem like an individual who took another person with their consent and as a joke. If this were the case, METRO would not have had to negotiate with Mr. Taylor, let alone breach the residence to get Mr. Taylor. In the statement from Officer Faust, when Mr. Scott was recovered, Mr. Scotts did not seem too alarmed, however, even stated he did not expect the situation to go as far as it did with police and metro involvement. Further, in the statement from Lieutenant Samuele Colonna, when Mr. Scotts was encountered zip-tied in the vehicle, he was not even entirely sure the "hostage-taker" was his friend and at some point after being taken asked to be released, and Mr. Taylor refused. This refusal to release him raised a level of doubt within Mr. Scotts that this was an innocent prank. No reasonable person would consent to being taken by an unknown person. It is also important to note Mr. Taylor pled guilty to these charges and Mr. Scotts considered himself as being kidnapped.
I also agree with Lieutenant Colonna, Mr. Taylor should be charged with GF-24 Perjury. Which as defined is,"Saying or writing something that is not true with intent to mislead during an official proceeding or trial whilst under oath
A person can only be guilty of perjury if they do any of the following in an official statement and whilst under oath.
(a)Knowingly and willfully provides false statements or information to mislead a judge and, or jury in official proceedings for or during a trial.
(b)Knowingly and willfully provides several inconsistent statements to mislead a judge and, or jury in official proceedings for or during a trial.
(c)Knowingly and willfully signs an affidavit under oath with statements that meet the criteria for (a) or (b)
A person can only be charged for perjury if the false statement provided is in direct relation to the trial and has the potential of affecting the outcome of the trial."
The charges as placed are appropriate. Mr. Taylor forcibly acquired Mr. Scotts against their will, and moved him about the city. This is clear from statements obtained by the police department, to include Mr. Scotts asking his captor for his release and being refused. Even if this was a joke, it lost its protection as a joke when Mr. Scotts asked for his release and was refused. Secondly, Mr. Taylor attempted to obtain property from the police department by intimidation; in this case, to secure the release and safety of a hostage. These charges are appropriate. I would also motion the court to consider adding the charge of perjury, as Mr. Taylor's statements in his appeal application are not true, and were delivered with the intent to mislead these proceedings, and Mr. Taylor was warned in this appeal application of the potential for receiving this charge by signing the application.

See attached statement received from the Officer. If this is true, it was a statement defense counsel requested, and therefore the State of San Andreas's potential inability to receive it should not be held against the State. I did speak with Officer Scott's supervisor, who will be speaking with Officer Scotts. This may or may not result in a statement being submitted, depending on the policies for the LSPD.

After conversing with other members of the supervisor team we have come to the conclusion that Officer Scotts is not required to provide a statement for the ongoing case.
" Adam Scotts was not an employee of the Los Santos Police Department at the time of the incident, therefore, he is not required to provide a statement.
At the time, Mr. Scotts was a civilian, and therefore, has the right to remain silent."

Detailed explanation:
While the State of San Andreas does not particular oppose the content of the evidence, the State of San Andreas contends this is an improperly submitted item of evidence. On 13/Apr/2022, defense counsel requested the discovery window to be reopened, and this request was granted. The court gave defense counsel three days, therefore, the discovery window closed on 16/Apr/2022.
On 14/Apr/2022, the defense requested the statement from Officer Scotts. The State attempted to obtain this statement, and Officer Scotts refused to provide the statement because he had already spoken with defense counsel. The State of San Andreas concedes being a few days late attempting to gather the evidence, but again, there is no loss to the case as the statement was ultimately refused.
To date, Mr. Taylor has had three different attorneys assigned to this case, and collectively no attorney has requested such a statement from Mr. Scotts, or attempted to secure the evidence defense counsel now intends to be considered.
Therefore, due to current counsel submitting this evidence nearly a week past the newly opened discovery period closing, and the fact this evidence was 'apparently' readily available this time, but none of Mr. Taylor's counsel attempting to acquire it, the State of San Andreas believes this evidence to be forfeited.
