CHARGES BEING APPEALED: SF02 - Murder

DEFENDANTS STORY/OPENING STATEMENTS: On February 13th, 2021, an inmate had escaped containment from solitary and had assaulted two Corrections Guards to the point of serious injury. This inmate had been a major aggression issue for most of the known evening, having already committed to two-three violent attacks previous to this incident. The Defendant in response to a cry for help from the officers, entered the area of operation and by way of force aligning with that of the DOC's Force Matrix, utilized a firearm to neutralize the attacker before any more serious injury could be brought upon the injured guards.

However, the situation escalated when the defendant shot the inmate to the point of death when the force matrix did not call for such action, and the fatality could have been avoided. Upon official inquiry from the correctional Warden Team, in addition to the LSPD's Deputy Chief Philipe Sanchez, it was concluded that this was now a criminal case to be carried out against the Defendant. After a review of the evidence, Deputy Chief Sanchez expressed that by the lines of the Penal Code, the only charge that could be placed in this instance was SF02 - Murder. Deputy Chief Sanchez stated that while a lesser charge was attempted and preferred in this case, the Penal Code could not be budged in this way.

It came to light soon after repetitive CRU meetings, that the defendant had suffered from a chronic, traumatic episode during the incident which was later diagnosed to be PTSD, which served as a catalyst for the February 13th incident, and overall cause of the unfortunate loss of life, by circumstances outside of the defendant's control. Because of this, the Defendant wishes to take this case to Appeals for an attempt at a reconvention of the case to determine if the charge can be reduced as was once originally intended or expunged from her record, based upon substantial evidence up to and including: Past service record, several witness testimonies/vouches that includes colleagues from both DOC in addition to those in the LSPD, and evidence from the LSEMS of a medical nature that will determine the incident on the 13th to be not of a purposeful or premeditated nature.

As it stands by current statues, the Penal Code does not offer any sort of determination factors, adjustments, or considerations as it applies to psychological conditions or causes to be taken into account when it comes to the application of charges or investigational SOP's. By IA-standards in this case, the charge cannot be appealed or considered under the LSPD's current standard operating protocols.

This now couples into the point of time passed after the incident. As the current appeal parameters state: Additionally, you have thirty (30) days from the occurred incident to submit an application appealing the criminal charges. Any letter or email to the government agency that had filed the charges will be considered the start of the thirty day count from the conclusionary received.

The official email that was sent to Deputy Chief Philipe Sanchez is time-dated August 7th, 2021 in regards to the charges placed as seen below, with a reply received the following morning on the 8th. No other email or letter was sent to the government agency concerning the charges. Thus we believe that this falls under the current 30 day allowance from the email's original date and time.

In terms of evidence of a sensitive scale, it has been requested of LSES's high command staff for the original assessment as well as a newly conducted assessment that is to take place that will confirm the diagnosis of Post Traumatic Stress Disorder, which coupled with testimony will serve as the basis for the reduction or removal of SF02 - Murder on the record. However, in response to the request, LSES's high command state that by the nature of doctor-patient confidentiality and the sensitive nature of the material, a formal inquiry by the Judicial Branch must be made to receive such information as it pertains to this case.

A list of witnesses has also been prepared, though for their safety we request their identities be redacted or withheld from this public record until an official inquiry is made as to their identification.

  • Ms. Reina Moraine,

    These charges came prior to the implantation of the Court Of Appeals. As such it would be unreasonable to request law enforcement to adhere to any request of the court prior to the development of their Internal Policy's for evidence gathering and statement collection. The wording for the announcement will be corrected. Though this is meant to be a reply from Internal Affairs in regards to a case. The conclusion being the verdict from Internal Affairs. This could be a referral to the court and so forth. The appeal will be rejected and the prior ruling made by Judge Hyland will be upheld by the Supreme Court of San Andreas.

Chief Justice Mayfield,

If your concern here is the fairness of the request to the department, I have no concerns. I have all the evidence still and am more than happy to present that within the appeal. It might be nice to lay this case to rest with a full and proper conclusion.
