INTERNAL AFFAIRS DIVISION
  • The Internal Affairs Division acts as the investigative arm of the Chief of Police (COP) with respect to employee misconduct and serves the Department by handling complaints made against employees. It is primarily tasked with the thorough investigations of complaints filed by citizens, employees, or employees of other agencies or organizations.

    Internal Affairs Division is responsible for investigating complaints of misconduct of LSPD employees that are either administrative in nature, or have potential criminal elements associated with the complaints.

    To ensure and maintain integrity and public trust, the Internal Affairs Division operates directly under the Office of the Chief of Police and reports to the Commanding Officer, Professional Standards Bureau, and the Chief of Police. The Internal Affairs Division investigates complaints on all department employees, irrespective of the rank of the employee.
COMPLAINT PROCESS
  • A complaint may be filed physically at any police station or digitally via the online portal by submitting a letter to Internal Affairs. Once a complaint has been filed, it will be subject to preliminary review by Internal Affairs Division Commanding Officers to determine the credibility and nature thereof.

    If you do not wish to report your complaint in person, you may obtain a “Complaint of Employee Misconduct” form from any police facility. Complaints may also be filed online, with the form attached below. Reports must be filed within 7 days of the incident in question, to ensure a clean and fair investigation.

    Anonymous and third-party complaints are also accepted and will be investigated to the extent that sufficient information is provided. However, if you choose to not provide your contact information, the investigators will be unable to ask you follow-up questions that might be needed for a thorough, complete investigation.

    If a complaint is accepted, it will be moved to a private section, given a reference number, and based on the allegations in the complaint, assigned to an investigator. If a complaint fails to pass the preliminary review stage, the complainant will be provided written correspondence to inform them.

    Reporting parties are encouraged to include evidence of their allegations in the complaints and reports they submit. The Internal Affairs Division will investigate to the best of their ability in the event of lack of evidence provided by the reporting party, but may not be able to conduct as exhaustive of an investigation as it would if evidence was provided.

    In the event that financial damages occurred, such as damages to personal property, reporting parties are advised to keep, attach, and include evidence of payments to rectify the damages, such as a copy of the receipt for vehicle repairs, when submitting a report of misconduct. If a receipt or other evidence is not attached to the report, the Internal Affairs Division may request it be submitted once the investigation is completed.
INVESTIGATION PROCESS
  • The Internal Affairs Division conducts thorough investigations of all forwarded complaints that have passed the preliminary review stage and will review all evidence pertaining to the incident.

    Your complaint will be investigated by a trained supervisor. The investigation may include interviews of witnesses and officers; a review of Department records, policies, and procedures; an inspection of medical records, photographs, and other evidence; and legal analysis.

    Completed investigations are submitted to the Commanding Officer, Internal Affairs Division for review, but may be submitted to other relevant and appropriate authorities, including the Chief of Police if required. If deemed necessary, investigations with criminal aspects may also be presented to the Office of the Attorney General of the San Andreas Judicial Branch.

    Internal Affairs aims to complete investigations within 30 days from the date the complaint was received. Upon completion and final review by the Commanding Officer, Internal Affairs Division, or the Chief of Police, the complainant (reporting party) and the reported employee(s) will receive official correspondence from Internal Affairs detailing the disposition of the investigation. Note that the reporting party may not be informed of disciplinary action taken against the reported employee(s) in sustained complaints.

    Depending on circumstances, the Department and the Internal Affairs Division may offer compensation to the reporting party depending on the disposition of the complaint. However, if the reporting party has attempted to withdraw their report or complaint, they will not be awarded any compensation if it were otherwise applicable.
MEDIATION PROGRAM AND ALTERNATIVE COMPLAINT RESOLUTION PROCESS
  • Some complaints are eligible to be resolved through Mediation or the Alternative Complaint Resolution (ACR) process rather than the traditional, fact-finding investigation. These alternative complaint procedures, which take place in an informal setting, were developed to resolve complaints through dialogue and with the intent to strengthen relations between the community and the LSPD.

    Similarly, for the ACR process, the parties meet to resolve the complaint through a discussion. The conversation is facilitated by an LSPD supervisor, and the ACR process is also confidential. If your complaint is determined to be appropriate for mediation or the ACR process, you will be notified. However, your participation would be completely voluntary.
