Important Bar Association Notice for Attorneys
"EQUAL JUSTICE UNDER LAW"

    The San Andreas Bar Association issues this formal notice to all Defense Attorneys regarding compliance with Section III - Relationship to a Client of the Attorney Code of Ethics.

    Upon accepting representation and signing onto a case as counsel of record, an attorney assumes full ethical responsibility to represent their client without delay or hesitation, as required under Clause (b) of Section III:
    “An attorney shall exercise all his or her professional skill and conscientiousness to represent a client and render his or her legal assistance without delay or hesitation. Therefore, when undertaking a representation, an attorney must use proper care not to, because of excess work, jeopardize timeliness, thoroughness and conscientiousness when exercising his or her professional duty.”
    Attorneys who fail to schedule or appear for a bench trial they have accepted payment for, or have formally signed onto, are in direct violation of this ethical duty. Such conduct constitutes:
    • A failure to act with reasonable diligence;
    • Neglect of a client’s legal matter; and
    • A breach of the attorney’s duty of faithfulness to the client.
    This violation undermines the integrity of the defense process and jeopardizes the client’s right to timely verdict. Any attorney found to have accepted representation and subsequently failed to schedule or advance their client’s bench trial without approved justification will be subject to disciplinary review by the Board of Ethics.

    Attorneys are reminded that withdrawal from representation must follow proper procedure and may not occur through inaction or avoidance. Until such withdrawal is approved, counsel remains fully responsible for advancing the client’s case.

    Please note that this does not negate the defendants responsibility to appear in court when being represented by a public defender.
