MOTION FOR SUMMARY JUDGMENT
IN THE SUPERIOR COURT OF SAN ANDREAS
State of San Andreas v. Marc Ericsson
#25-BT-0121
A Motion for Summary Judgment was filed in the above case on the 16th of October, 2025.
The State of San Andreas, by and through the undersigned attorney, filed this Motion for Summary Judgment, and the reasoning for the request is as follows;
- Reasoning: Guilt beyond reasonable doubt
- Detailed Explanation: The discovery provided by the Prosecution against the defendant, Marc Ericsson, includes an arrest report for the incident in which the details are, that the defendant was witnessed by the arresting deputy from the Sheriff's Department as speeding excessively, clocked on the deputy's radar as being 233kmph while driving in an 80 zone; this is 153kmph over the regular speed limit of 80kmph, and 73kmph over the upper limit of 160kmph to be valid for VC03 - Speeding 3rd Degree. Case precedent continuously ruled upon in both the Superior Court and Court of Appeals, including but not limited to #23-CM-0086, State of San Andreas v. Bongo Haze and #25-AP-0001, State of San Andreas v. Roberto Sanchez, where it was ruled that the difference between a citation for speeding of the 3rd degree and a misdemeanour charge for reckless operation was up to the individual law enforcement officer and, ultimately, at their discretion. The court cannot deny this precedent, first established in the Superior Court and then upheld in the Court of Appeals; eye-witness testimony in the shape of an arrest report state that the defendant as clocked on a speed radard by a deputy, driving at nearly three (3) times the legal speed limit. The discretionary speeding citation is out of bounds, and the deputy was well within their legal right to charge the defendant as they did, and this court should do everything to uphold the charge as is.

MOTION TO COMPEL DISCOVERY
IN THE SUPERIOR COURT OF SAN ANDREAS
State of San Andreas v. Marc Ericsson
#25-BT-0121
A Motion to Compel Discovery was filed in the above case on the 16 of September, 2025.
The Defendant, by and through the undersigned attorney, filed this Motion to Compel Discovery, and requests as follows;
- Requested Discovery: Original, unaltered, and time-stamped Arrest Report submitted by the arresting officer, for the arrest on September 7, 2025, as submitted to the San Andreas Sheriff’s Department arrest report collection.
- Detailed Reasoning:
The prosecution has provided an arrest report containing several redactions and incomplete metadata. The report does not have the original submission timestamp, metadata, and digital filing details typically associated with standard SD reports. I.e the stamp that states, John Doe wrote: ↑ Day Month Date, Year Time.
The Defendant has reason to believe that the arrest report was not filed on the same day as the date of arrest but was instead created or modified several days later to be more specific, an entire week after the arrest date. This raises a material question regarding the accuracy, authenticity, and potential alteration of factual details included in the current version of the report. We see no reason why information from the arrest report needs to be redacted, as the information is already public in many places.
Again, the Defendant seeks production of the original, unedited report as first submitted by the arresting deputy, including the file’s creation and submission timestamps and author metadata.

OBJECTION
IN THE SUPERIOR COURT OF SAN ANDREAS
State of San Andreas v. Marc Ericsson
#25-BT-0121
- The Defense does not agree with the motion, nor does it concede to the factual basis presented by the Prosecution.
The Defendant expressly disputes the facts as stated within the arrest report, including the alleged speed, the circumstances of the stop, and the accuracy of the report’s contents. There are clear factual disputes that must be examined and proven through proper evidentiary procedure at trial.
As such, this matter is not suitable for summary judgment, as issues of material fact remain in dispute. As the courts know, summary judgments require that there be no dispute about the facts of the case, and only a determination about how the situation applies to the law will be made. As established, the defense is disputing the facts of the arrest report. The Defense therefore requests that the Court deny the State’s Motion for Summary Judgment and proceed to a full bench trial where all evidence and testimony can be presented and properly evaluated.
Should the Court review the existing motions within the next few days, the Defense respectfully requests that a trial date be set for this coming weekend so there is no further delays.

COURT DECISION
IN THE SUPERIOR COURT OF SAN ANDREAS
State of San Andreas v. Marc Ericsson
#25-BT-0121
A decision was reached in the above case on the 16th day of October, 2025.
The court has looked over the submissions from both the prosecution and defense. Given the defense counsels objection to the Motion for Summary Judgement, the court will be denying the prosecutions motion. Summary Judgements by definition, as the defense correctly stated, require that there be no dispute about the facts of the case, and only a determination about how the situation applies to the law will be made. As the defense has expressed and shown a possibility that the facts could be in dispute, the court must allow them a chance to accurately defend in court.
In regards to the defenses Motion to Compel Discovery, the court will be ordering the prosecution to provide a quoted version of the arrest report to be submitted on the docket. In addition to that, we will be requesting the answer to the follow question: Could you please explain why the vehicle information has been redacted?
You have 7 days to comply with the above order.
Respectfully,
