- We were doing an investigation on Bratva members and arrested one of them with a heavy gun. Following that, we stopped a 2-stacked Itali GTO when a unit spotted a gun in their hand. So units responded for the 10-55, and before the units arrived there, the driver, Richard Forth, started shooting at the units that were conducting the traffic stop, and the passenger remained in the vehicle while the driver was shooting. So the unit started shooting back, resulting in injuries to both occupants. Later on, illegal possessions were found on both suspects, that is listed below. Then they got treated and transported to prison.

COURT DECISION
IN THE SUPERIOR COURT OF SAN ANDREAS
State of San Andreas v. Jordan Capone

A decision was reached in the above case on the 2nd day of November, 2025.
The Court has reviewed all facts surrounding the incident that took place on the 7th day of September, 2025.
The Prosecution has argued that the Defendant in question was a willful participant in the act of Evading an Officer, as demonstrated by the Arrest Report and possessions found upon the Defendant during their arrest. Prosecution has also argued that the Defendant had ample time to exit the vehicle safely before becoming incapacitated, due to the vehicle being either stationary or driven at low speeds for a period of five to ten seconds.
The Defense has argued that the Defendant was not reasonably able to exit the vehicle safely, due to the nature of the driver operating the vehicle at speed, the actions taken by the Deputy in an attempt to physically block the vehicle, and finally, the act of the Deputy opening fire towards the vehicle.
The Court has to review the facts of the case as to whether a) the Defendant was a willful participant in the act of Evading an Officer, and b) whether the Defendant had the appropriate opportunity to safely exit the vehicle, with the appropriate amount of time as set in previous precedents.
The Court finds that while the Prosecution has correctly pointed out that the Defendant was in fact armed adds to the motive of the Defendant to evade, however, the lack of violent action from the Defendant, and the fact that there was no further documented resistance or interference from the Defendant, in conjunction with the fact that the Court believes the Defendant had no safe opporunity to exit the vehicle, all act in mitigation to this point.
It is with the above considerations that I issue the following verdict:
- On the count of VF01 - Evading an Officer, I find the defendant, Jordan Capone, not guilty.
The defendant should make their way to City Hall at their earliest convenience to have the change to their record noted, as well as the payment of $15,000 returned to them for fines, time, and other expenses/inconveniences incurred from the contested charges.
