- Approx 02:15 AM we passed by a masked individual on the side of the road in the process of chopping an RV. The individual failed to stop and put her hands up, moving towards her vehicle and was tazed. She tried to move away while being cuffed and had to be tazed again. After her rights were read she tried to move away from being frisked and was tazed once again. Once she was successfully searched she was identified as Ms. Green and found with multiple tools and car parts in her possession. She was transported to DOC and refused to move inside the building, asking to use the atm repeatedly despite being told no and to move inside under threat of being charged with failure to comply.

- While on patrol, we came upon an RV that was jacked up on the side of the road and heard it being worked on. We stepped out and surrounded the masked individual who was working on the vehicle. We ordered her to stop when she started moving towards her vehicle, a green surge parked nearby. She failed to stop until she was tazed, tried to move away when I tried to cuff her, and then continued to try to move away when I attempted to frisk her. Eventually I was able to search her and found multiple mechanic tools and car parts in her possession. She was transported to DOC and repeatedly requested to use the ATM, we told her if she did not move inside she would be charged with failure to comply, but she still continued to ask to use the atm a few more times before finally complying. She was taken into processing and handed off to DOC.

* Bodycam footage from the incident would show the unit approaching an RV tilted to the side towards the unit and have sounds of tools being used. The deputies would exit the vehicle and split up to round the RV, surrounding the masked individual working on the RVtaking the car jack down from the RV. The individual would move away towards a green surge despite orders to stop until she was tazed near the green surge. It would then show Behr trying to cuff the individual who would get up from being tazed and try to continue towards the vehicle but was successfully cuffed and read her rights. Behr would try to frisk her and the suspect would continue trying to move away and was tazed again. Behr would frisk her, remove her mask, and remove her tools and stolen items, and find her ID. Green would be placed in the cruiser and transported to DOC. Upon arrival she would move to the atm, repeatedly asking to use it and repeatedly being denied. She would continue this behavior after being told by multiple deputies to move inside or she'd receive failure to comply. She further continued to ask to use the atm, but eventually moved into DOC for processing.

ISSUANCE OF VERDICT
IN THE SUPERIOR COURT OF SAN ANDREAS

A decision was reached in the above case on the 13th day of July, 2025.
The court notes the facts in the case. The defendant was found in possession of car parts, next to a vehicle that was in the process of or had already been disassembled. The court notes the defendant was also in possession of the tools necessary to dismember a vehicle. Additionally, the defendant was noted as being disobedient to law enforcement direction.
The court notes the facts still up for debate. Starting with the vehicle and whether or not the defendant had permission to drive and or use the vehicle. Secondly the defense argued that the defendant was not intending to gain anything monetary from the breakdown of the RV.
The court finds the lack of evidence to show the defendant did not have legal access to the vehicle to be the biggest factor in the case. We note that checking for keys, calling the registered owner of the vehicle, reviewing prior BOLO's, etc. were not procedures taken during the arrest or engaged in after arrest. While the circumstances surrounding the arrest give enough reasonable suspicion for detainment and investigation, without investigation into whether or not the individual had legal access to the vehicle or the car parts in their possession, the court cannot make a reasonable determination that the individual was in fact chopping the vehicle with the intent to sell.
However we do affirm the right of deputies to investigate suspicious actions and find the non-compliance of the defendant on scene and at SADOC to be enough to prove beyond a reasonable doubt for the application of GM04 - Resisting Arrest.
It is with the above considerations that I issue the following verdict:
- On the count of VF03 - Operating a Chop Shop, I find the defendant, Synthia Green, not guilty.
- On the count of GM04 - Resisting Arrest, I find the defendant, Synthia Green, guilty.
The defendant should make their way to City Hall at their earliest convenience to have the change to their record noted as well as the payment of $16,000 returned to them for fines, time, and other expenses/inconveniences incurred from the contested charges.
