INCIDENT NARRATIVE
- Incident Date: 08/MAR/2025
Explain what happened, sufficient detail must be given to justify the placed charges, videos could be provided.
- Officer Brian Dox was conducting a speedtrap on San Andreas Ave, where Marc Ericsson was speeding past him. Officer Brian Dox clocked his vehicle at 205 and he attempted to catch up. Officer Dox caught up and initiated a 10-55 where mr Ericsson was compliant and taken into custody at MRPD. Charged for his speed.
EVIDENCE DETAILS
- Document the possessions confiscated from the arrested suspect.
Possessions are to be documented individually, examples of documented illegal possessions are "Pistol .50" or "12 grams of Cocaine". Legal possessions that can be categorized may be grouped, eg. "Clothing" to describe all clothing items. Body camera footage/pictures may be attached as an evidence exhibit.
Where possible, the serial number of each firearm seized as evidence should be noted.

ISSUANCE OF VERDICT
IN THE SUPERIOR COURT OF SAN ANDREAS
State of San Andreas v. Marc Devil (Ericsson)

A decision was reached in the above case on the 20th day of April, 2025.
The appeals court in 25-AP-0001, State of San Andreas v. Roberto Sanchez notes that the difference between a 3rd-degree speeding citation and a reckless operation misdemeanor charge is at heart, officer discretion. However, regardless of discretion, there is no dispute that the vehicle's speed is 205 km/hr, meaning that it is driving 125 km/hr over the speed limit. This makes a 3rd-degree citation not applicable to this specific situation.
The court does not presume to be an arbiter of officer discretion when Law Enforcement acts in good faith towards the community. In the given case, the prosecution has provided ample justification for the discretion used, and as such the court finds the traffic stop and subsequent arrest to be performed in good faith. Furthermore, given the evidence available on the docket, the court finds the prosecution has met its burden of proof, and that the driver pulled over on Integrity Way is the same person speeding down San Andreas Ave.
It is with the above considerations that I issue the following verdict:
- On the count of VM03 - Reckless Operation of a Road or Marine Vehicle, I find the defendant, Marc Ericsson, guilty.
As with any given guilty verdict, the court reserves the right to seek court fees for time, effort, and resources expended on any case. As such, the court will be fining the defendant $5,000 for the court's time, effort, and resources for this case.
