I would like to quote precedence from State of San Andreas v. John Chapel #24-CM-0018.

"This Court also determines that for the misdemeanor of unlawful assembly to take place, it is not enough for there to be a plural number of participants in the commission of an illegal act. Said circumstance requires at least proving an intent, willingness, or otherwise premeditated desire to disobey the law—or law enforcement instructions—with an ulterior motive."

    • Deputy Sutton responded to a shots fired call at the lumber mill in Paleto forest. the suspect was found injured with multiple gunshot wounds. the suspect was detained and provided medical treatment. the suspect was then taken into custody.
      
      NM03 is being applied due to the suspect actively involved at a scene where ESM and Highrollers were having a conflict, the suspect is a known affiliate of ESM, and was found with other injured and deceased ESM members at the location of active gunfire.

  Witness Statement

  • On the morning of March 13th, I was patrolling Great Ocean Highway when, just outside Paleto Forest, I heard a major shootout coming from the Lumber Mill involving multiple types of firearms. Being alone, I called for assistance and waited several minutes.
    
    After sufficient backup arrived on the scene, we moved in and found injured and deceased individuals, appearing to be from two different gangs—one of them noticeably the East Side Mobs.
    
    There weren’t many suspects alive, though I don’t recall the exact number. Given the delay before we could move in, there was ample time for individuals to remove contraband from injured associates and flee the scene. So we weren't able to pursue possession charges on many.
    
    We ultimately decided to charge individuals with unlawful assembly as a blanket charge due to the clear gang presence at the Lumber Mill. These individuals were not employees of the mill and had gathered in large numbers for unknown reasons, engaging in combat and illegal activities.
