The court will be granting the prosecutions/defenses request to hear this as a Formal Criminal Trial. We are rescinding the order for discovery due to the transition of this case from bench trial to formal criminal trial. An Order for Discovery was entered in the above case on the 4th day of March, 2026.
The prosecution is hereby ordered to submit the majority of their evidence, including all evidence collected from the arresting Law Enforcement Agency and submit it to the Court via Motion for Discovery within seven (7) days. If additional time is needed, the prosecution can file a Motion for Continuance.
Additionally, the defense is also hereby ordered to provide all evidence intended for trial via a Motion for Discovery. Any remaining evidence or supplemental submissions by either party must be filed no later than seventy-two (72) hours prior to the scheduled Motions hearing.
Both parties are also ordered to provide an initial witness list to the Court. Any required amendments to the witness list shall be filed through a separate motion ahead of the Motions hearing.
Once evidence has been submitted to the official docket, parties can begin filing motions they intend to be heard at the Motions hearing. Parties should not be filing objections or rebuttals to Motions as this will be addressed during the Motions hearing.
All submissions to the docket must be filed filed no later than seventy-two (72) hours prior to the scheduled Motions hearing.

- On the 28th of February 2025, I, Commander John Kemp, partnered with Investigator Cole Lawless, operating under callsign OMEGA-2-3, conducted an undercover SIB operation after receiving information about heavy weaponry at Ace Liquor. While driving around in an undercover vehicle, we spotted multiple heavy weapons at Ace Liquor, giving us enough evidence to move in and attempt to seize them. Following this, multiple units were called into TAC 3, and a plan was set up to go in and block all entrances. We then breached Ace Liquor, which led into a full-blown shootout with the Sheriff's Department and a gang known as "Eastside Mob". One Deputy and an Investigator lost their lives as a result of the shootout. Once all threats were neutralized, we started moving the suspects outside the property and getting them treated. My suspect, later identified as Phil Russo, was found on the bottom floor by the staircase with body armor and a Pump Shotgun, Serial #1740193328770, on his back. I managed to get him out and provide basic life support until MD got on scene after reading him his rights and disarming him. All suspects with a weapon were charged with Murder of a GOV. on the scene as a blanket charge as they all were involved in the shootout and were complicit to the murder of deputies. The suspect, Phil Russo, was then transported by MD to the hospital and handed over to DOC before being transported to prison, where he would serve his sentence.

- On February 28, 2025, I, Commander John Kemp, along with Investigator Cole Lawless, conducted an undercover SIB operation following intelligence regarding the presence of heavy weaponry at Ace Liquor. While operating in an undercover capacity, we observed multiple individuals in possession of heavy weapons, providing sufficient grounds for further action.
Subsequently, multiple units were called into TAC 3, and a coordinated plan was devised to secure the premises and prevent any potential escape routes. Upon executing the breach into Ace Liquor, a confrontation ensued between law enforcement personnel, including members of the Sheriff’s Department, and two groups identified as Eastside Mob and Zero Tolerance. This resulted in an exchange of gunfire, during which a Sheriff’s Deputy and an Investigator sustained fatal injuries.
Following the engagement, law enforcement personnel secured the scene, apprehended suspects, and ensured medical treatment for the injured. One of the individuals, later identified as Phil Russo, was located on the bottom floor near the staircase. At the time of his detention, he was wearing body armor and was found with a Pump Shotgun (Serial #1740193328770). After conducting a search and advising him of his rights, I provided basic life support until medical personnel arrived.
Due to the nature of the incident, all suspects found in possession of firearms were detained and charged on the scene with Murder of a Government Employee, given their presence and involvement in the shootout that resulted in the deaths of law enforcement officers. Mr. Russo was subsequently transported to the hospital by medical personnel and, upon clearance, transferred into the custody of the Department of Corrections.
