Narrative:
I wish to contest being charged twice for the possession of a controlled substance and also possesion of a controlled substance while armed, I feel as though this charge has been stacked upon me as I am alleged to be in possesion of a fire arm then why not just charge me with the possesion of a controlled substance while armed, even then I was not physically armed with the .50 as it was not found on my person.
I also wish to contest the charge of failure to comply as I feel that would be covered under the evading part of the charges.
I also feel that although I did evade, I want to also contest the charge of public endangerment as I did not endanger any members of the public as it was a quiet time of the day (about 5am) and there was no vehicles on the road apart from 1 which I came across. I did not recklessly drive through any oncoming traffic or public sidewalks, and the chase mostly led through the highways of the city.

INCIDENT NARRATIVE
- Incident Date: 09/FEB/2025
Explain what happened, sufficient detail must be given to justify the placed charges, videos could be provided.
- While driving on palamino Fwy Detective Knight witnessed a vehicle stopping by a dead body and another person out of the vehicle leaning on the deadbody (AKA the suspect), Detective Knight decided to make a U-turn and check the situation. Once started U-turning the suspect got in their vehicle and drove through the grass cutting from a side to another through the highway. Detective Knight then followed them with Lights and sirens in order to pull them over.
Detective Knight than started a traffic stop on the suspect, Detective Knight started by identifying the suspect which they complied with, but then Detective Knight asked the suspect to step out of the vehicle informing them that they are part of an investigation relating to the dead body. The suspect did not comply at all and refused to step out of the vehicle after multiple attempts. Detective Knight stated again that he is lawfully requesting the suspect to step out of the vehicle as part of their detainment regarding the dead body on the road. The suspect refused again for the 5th time. Detective Knight escalated the force to hold a tazer on them and start to call for backup units. At that moment the suspect started to evade.
During the evasion the suspect went on high rates of speed on incorrect lane of travel and cutting through side walks to finally have a major traffic collision on the middle part on elgin avenue. The suspect from there was arrested and processed at DOC.

Possessions are to be documented individually, examples of documented illegal possessions are "Pistol .50" or "12 grams of Cocaine". Legal possessions that can be categorized may be grouped, eg. - I would like to state that in the case of Ms. Devalera, I did not place her charges and that I only handled the arrest and evidence along with Detective Knight. I searched Ms. Devalera's car on scene after she had evaded driving through the city at speeds higher than most cruisers could reach which I would consider dangerous and reckless. In Ms. Devalera's car, I found a loaded pistol in the glovebox and in her trunk I found a bag containing 38 Marijuana plants and many more ingredients for other drugs including sulfuric acid, powdered lime and sodium. Once Ms. Devalera was in the cruiser to be transported she seemed very agitated and impatient. Ms. Devalera was shouting at not only me but Detective Knight also. Ms. Devalera was compliant but very aggressive throughout this arrest.

A decision was reached in the above case on the 31st day of May, 2025.
The case brought to the court today has no dispute on how the situation started. The defendant, Ms. Olivia DeValera was pulled over, identified by police, and then evaded when stepped out of the vehicle. There is a dispute on what precisely happened during the ensuing pursuit, specifically with regards to whether the defendant's actions meet the standard of VF04, namely State Government wrote: ↑putting a major risk to public safety through unsafe operation of a motor vehicle.
While the actions shown through evidence of the defendant were reckless, the court finds that they do not meet the mentioned threshold for VF04.
Defense has brought up the Lesser Included Offense Doctrine, with regards to the charges of GM10 and DM03, as they argue that they stem from the same incident and the same pieces of evidence. While the prosecution notes that with DM03 the "greater" charge is also a misdemeanor, the doctrine is not limited to just felonies and is applicable to all charges. The defendant has constructive possession of their firearm in the glovebox without the relevant licensing, as noted in the charge of WM02. Moreover, the defendant also has constructive possession of the controlled substances in their car's trunk at the same time. However, the court finds that the narcotics evidence used to justify the charge of DM04 - Possession of a Controlled Substance while Armed cannot also be used to justify the charge of DM03 - Possession of a Schedule III Controlled Substance.
It is with the above considerations that I issue the following verdict:
- On the count of VF01 - Evading an Officer, I find the defendant, Olivia DeValera, guilty.
- On the count of VF04 - Felony Public Endangerment, I find the defendant, Olivia DeValera, not guilty.
- On the count of DM03 - Possession of a Schedule III Controlled Substance, I find the defendant, Olivia DeValera, not guilty.
- On the count of DM04 - Possession of a Controlled Substance while Armed, I find the defendant, Olivia DeValera, guilty.
- On the count of WM02 - Possession of a Class 1 Firearm, I find the defendant, Olivia DeValera, guilty.
- On the count of GM10 - Failure to Comply / Identify, I find the defendant, Olivia DeValera, not guilty.
The defendant should make their way to City Hall at their earliest convenience to have the change to their record noted as well as the payment of $23,500 returned to them for fines, time, and other expenses/inconveniences incurred from the contested charges.
