      INCIDENT NARRATIVE
      • Incident Date: 08/FEB/2025

        Explain what happened, sufficient detail must be given to justify the placed charges, videos could be provided.
        • Ms. Cj Malone (hereinafter 'the suspect') was witnessed by Police Captain Jason Steel arriving at her gang headquarters (Pink Cage Motel) at the same time or in close proximity to other affiliates of the same criminal organization, to wit, Waterfelons. The suspect was wearing the gang uniform, was in a gang colored vehicle owned by herself and had another gang affiliate as her passenger (to wit, Ophelia Kay). Captain Steel witnessed the vehicle depart Pink Cage shortly after arriving and immediately stop in the left-most lane of travel southbound towards Pillbox Hill. The vehicle operated by the suspect was obstructing the flow of traffic and failed to commence with the normal flow of traffic, therefore, Captain Steel elected to perform a traffic stop; during the course of the traffic stop, the Captain evaluated the suspect to be in a furtive state, and for officer safety ordered the driver to step out of the vehicle for the rest of the procedure. The suspect was eventually asked if they had any firearms on their person or in the motor vehicle, and Captain Steel evaluated their answer as suspicious when they answered "not on me" rather than no, with no qualifiers (implying that something may be in the vehicle). Sheriffs Department trained K9 handler Louise Hoffman arrived with her K9 and effected a regulation sniff of the motor vehicle. The K9 alerted the handler to the presence of gunpowder in the vehicle, and after a search, an AP Pistol was found in the glovebox. The suspect denied having any knowledge of the pistol in her glovebox.
      EVIDENCE DETAILS
      • Document the possessions confiscated from the arrested suspect.
        Possessions are to be documented individually, examples of documented illegal possessions are "Pistol .50" or "12 grams of Cocaine". Legal possessions that can be categorized may be grouped, eg. "Clothing" to describe all clothing items. Body camera footage/pictures may be attached as an evidence exhibit.

        Where possible, the serial number of each firearm seized as evidence should be noted.

ISSUANCE OF VERDICT


IN THE SUPERIOR COURT OF SAN ANDREAS

A decision was reached in the above case on the 29th day of June, 2025.


On the 8th of February, 2025, the Defendant was contacted on a traffic stop conducted by Captain Jason Steel of the LSPD. The reason for the traffic stop was cited as "obstructing the flow of traffic and failed to commence with the normal flow of traffic". During the traffic stop, the Captain determined the Defendant's actions and responses to be suspicious and contacted a K9 for an open air sniff of the vehicle. The K9 alerted to the presence of gunpowder in the vehicle. The vehicle was subsequently searched, and an AP pistol was located in the vehicle.

The prosecution argues the AP pistol is not sold by any licensed dealers in the State of San Andreas, and therefore cannot be lawfully possessed. The Defense argues the Defendant denied any knowledge of the weapon in her vehicle, and points to the fact there has been no forensic proof that the Defendant ever controlled the firearm. The prosecution rebuts this argument with the legal term "constructive possession". The Court does not note "constructive possession" has been upheld in San Andreas under the following conditions; (1) the individual has knowledge of such property, (2) has intent to possess such property, and (3) has the ability to possession such property at a certain point in time.

While the Court will not be making any conclusions as to the affiliation of the Defendant, as the alleged affiliation is not really important in this matter, the Court notes the Defendant was accompanied by another individual in the Defendant's owned vehicle. As outlined above, the Defendant need not be in direct possession of an illegal item to be held liable for the possession of the item if they have knowledge of the item. The evidence presented today suggests by the Defendant's statement the Defendant was likely aware of the item in their vehicle. And no evidence has been provided to suggest otherwise. Even if the weapon was placed in the glovebox by the passenger, this would have happened with the Defendant's knowledge - either through witnessing the passenger put it there or by allowing the passenger access to the vehicle. Therefore, the Court concludes the Defendant reasonably has knowledge of the presence of the AP pistol, had the ability to possess the item, and could have developed the intent to possess such property.

As far as the possession of the AP pistol, the Court does note an AP Pistol is not listed in the Roster of firearms certified for sale, and therefore, notes the firearm cannot be lawfully possessed, even with a firearms license.

It is with the above considerations that I issue the following verdict:
  • On the count of WF03 - Possession of a Class 2 Firearm, I find the defendant, CJ Malone, guilty.
