        Explain what happened, sufficient detail must be given to justify the placed charges, videos could be provided.
        • When operating westbound on Vespucci Blvd and turning northbound to merge onto Alta St the suspect crossed onto the incorrect lane of travel with at least 2 of his wheels. When pulled over, the suspect drove away from the traffic stop.
      EVIDENCE DETAILS
      • Document the possessions confiscated from the arrested suspect.
        Possessions are to be documented individually, examples of documented illegal possessions are "Pistol .50" or "12 grams of Cocaine". Legal possessions that can be categorized may be grouped, eg. "Clothing" to describe all clothing items. Body camera footage/pictures may be attached as an evidence exhibit.

        Where possible, the serial number of each firearm seized as evidence should be noted.

    Witness Statement
    • Mr. Ronny Miguel evaded as a result of a traffic stop. His vehicle became disabled at the intersection between Lower Pw. Street and San Andreas Avenue, at which point he was taken into custody and cuffed. Few seconds later, Mr. Miguel escaped from the METRO's officer hold and proceeded to run all the way to Parking Lot in the attempt to enter an affiliate's Elegy, which was unlocked at the time, therefore resisting arrest.

      In addition to the facts laid out in the arrest report, during processing in the parking lot at Mission Row; Mr. Miguel refused to step out of the back of the police vehicle and when I approached to take him out of the vehicle, I witnessed Mr. Miguel pointing a firearm at myself; he was cuffed with his hands behind his back and he seemed to have reached for a firearm from his person, therefore Brandishing a firearm.

      (( Due to the fact that Ronny already faced a lengthy prison sentence, I added the Attempted modifier to the charge in order to ensure that the player wasn't "punished" as severely for doing uncommon roleplay. ))

      After he was no longer a threat, Police Officer Russell Sinclair searched Mr. Miguel and found the firearm (Exhibit A) in his possession.

A trial date was set on the above case on 21st of March, 2025.


In accordance with the availability reported by both parties in response to the Notice of Scheduling, this trial shall take place at 09:00 PM on the 29th of March, 2025 at Rockford Hills City Hall, Carcer Way, Metro Los Santos, SA.

Both parties are ordered to be present in the Judges Chambers no later than 15 minutes prior to the above listed date for pretrial arrangements. If complications occur that must result in a delay or cancellation of the trial, you are ordered to inform the court no later than 12 hours prior to the above listed date.

ISSUANCE OF VERDICT


IN THE SUPERIOR COURT OF SAN ANDREAS

A decision was reached in the above case on the 29th day of March, 2025.


While the defense argues that the compensator can be legally purchased, and also does not fit the relevant firearm, based on the evidence provided, the suspect had it on his person at the same time as a firearm that he is not licensed for. Given the way the law is written today, Mr. Miguel is clearly in violation of the third provision of WM03,
State Government wrote: If modifications are in their possession at the time one receives "WM02 - Possession of a Class 1 Firearm" or any Weapons Felony as defined by the penal code as "WFXX"
as he is also charged with WM02 in the arrest report for the possession of a Pistol .50 of which he was not licensed for.

As for the charge of WM01 - Attempted Unlawful Brandishing of a Firearm or Weapon of a Gov. Employee, the lack of information provided in the arrest report as well as the limited information provided in the witness statement has not sufficiently met the burden of proof for this charge. As established in #22-CM-0040, State of San Andreas v. Gregory Gregov, insufficient evidence such as this should result in a not guilty verdict.

It is with the above considerations that I issue the following verdict:
  • On the count of WM03 - Criminal Use of Weapon Modifications, I find the defendant, Ronny Miguel, guilty.
  • On the count of WM01 - Attempted Unlawful Brandishing of a Firearm or Weapon of a Gov. Employee, I find the defendant, Ronny Miguel, not guilty.

The defendant should make their way to City Hall at their earliest convenience to have the change to their record noted as well as the payment of $5,000 returned to them for fines, time, and other expenses/inconveniences incurred from the contested charges.
