Explain what happened, sufficient detail must be given to justify the placed charges, videos could be provided.
- Mr. Alistair Vespucci (hereinafter 'the suspect') was witnessed by Police Captain Jason Steel in the restricted area on Joshua Rd, in between two clearly marked law enforcement blockades with lights engaged. Police Captain Jason Steel approached the suspect with emergency lights on his departmental vehicle engaged and ordered him to vacate the area, towards the West and on the outside of the line of DOC vehicles providing scene security. The suspect refused to do so, stating that he is on public grounds; on or around the same time shots rang out from the heavily armed group. Captain Steel had to use force to detain the suspect who remained belligerent verbally towards peace officers.

- Mr. Alistair Vespucci (hereinafter 'the suspect') was found to be within the restricted area on Joshua Rd alongside other individuals. After approaching the suspects with lights and sirens, at least some of them were cooperating with law enforcement but the suspect refused to do so on grounds of 'public street'. On the East and West of the suspect vehicles with lights and sirens clearly demarcated restricted access. Police Captain Jason Steel ordered the suspect to go West, on the other side of the 'line' of DOC vehicles providing the aforementioned scene security. The suspect refused to do so verbally, and further more, stationed himself on top of a motor vehicle that was also ordered to leave, therefore also impeding the vehicle from complying with the order safely.
The overall situation was that of a consortium of gangs being belligerent and unresponsive towards peace officers, and shots rang out in the Valley, rendering any population between the two zones unsafe, and a possible target for the gangs, and a possible unintentional casualty in cross fire. It was imperative for public safety that part of Joshua Rd. involved in the situation to be cleared out.
Below you will find a snapshot of the police blockades, the congregation of police vechicles and in the same context, I will describe the approximate location of the suspect.
With the aforementioned snapshot in mind, the suspect positioned himself approximately at the Westmost intersection of Marina Dr. with Joshua Rd, on the Joshua Rd side; clearly still within the area restricted by DOC vehicles.

IN THE SUPERIOR COURT OF SAN ANDREAS

A decision was reached in the above case on the 04th day of January, 2025.
Exhibit #1 outlines Mr. Vespucci's refusal to comply with a lawful order to vacate the area. His claim of being on "public grounds" does not negate the lawful command given by officers to leave a restricted, actively monitored scene. His actions, as described, demonstrate a clear failure to comply with a lawful command.
It is with the above considerations that I issue the following verdict:
- On the count of GM10 - Failure to Comply / Identify, I find the defendant, Alistair Vespucci, guilty.
The basis of the charge of GM14 - Obstruction of Justice comes down to whether Mr. Vespucci interfered, delayed, or obstructed law enforcement officers doing their work. Whether or not the defendant was aware of the specific nature of what they were obstructing is not relevant to this charge. Obstruction charges focus on the act of interference itself, regardless of whether the individual knew the full details of the scene. The defendants actions to refuse to comply with orders to vacate and positioning himself the way he did hindered law enforcements ability to secure the scene.
A point raised during trial was that the defendant apparently was not aware of what was going on, however, Exhibit #2 shows the set up of 7 SADOC vehicles, 10+ LSPD/LSSD vehicles in a cluster, and 3 other LSPD/LSSD vehicles scattered around. The exact location of the defendant was contested, however statements made in Exhibits #1 and #3, as well as by the prosecution, and the defendant himself, paint the picture that the defendant was absolutely in the "general area" of the situation. The court believes that a situation with blockades, emergency lights, large law enforcement presence, would typically signal to any reasonable person that an official operation was in progress. These visible indicators should suffice to show the defendant should have reasonably known compliance was necessary.
It was established that the described context of potential danger (shots fired, gang activity), law enforcement's need to clear the area was critical and the defendants refusal to comply would still constitute obstruction as it hindered the officer's ability to manage the situation effectively, regardless of the defendants specific knowledge of the risks.
It is with the above considerations that I issue the following verdict:
- On the count of GM14 - Obstruction of Justice, I find the defendant, Alistair Vespucci, guilty.
