In the matter of Case 24-CM-0086, the defendant, Mr. Maximiliaan Calliope, contested the charge of GM10: Failure to Comply/Identify. The case narrative indicates that Mr. Calliope was approached by an LSPD officer and asked multiple times to provide his identification as part of an active investigation. This is corroborated by the arrest report and the defendant’s own statement.
The defense argued that the arrest report was inaccurate in claiming Mr. Calliope was operating the vehicle, and further noted ambiguities about whether he was in or near the vehicle at the time. However, the court finds this distinction irrelevant to the charge, as the defendant was in sufficient proximity to the vehicle to reasonably warrant the officer's inquiry.
It is well-established through precedent that requesting identification in the course of issuing citations is lawful. Additionally, while full details of probable cause are not required at the time, it is necessary to inform an individual that an investigation is underway.
It is with the above considerations that I issue the following verdict:
- On the count of GM10: Failure to Comply/Identify, I find the defendant, Maximiliaan Calliope, guilty.
