INCIDENT NARRATIVE
- Incident Date: 30/NOV/2024
Explain what happened, sufficient detail must be given to justify the placed charges, videos could be provided.
- An attempt was made to pull over a 2x occupied B400 but they evaded and initiated pursuit. The bike crashed and the driver and passenger fell off, they both tried getting back on however the passenger was tased off and detained. The driver then came back to try pick up the passenger but fell off the bike again and was also detained. The passenger was Identified as Maximiliaan Calliope and was charged with evading and when searched had a bag of 14K in packed cash and a licenced firearm. Scott suspended his driver and trucker licence and also his firearm licence and filed for a removal. The driver and Maximiliaan Calliope were then transported to DOC and self processed

- I was the initiating officer, as I had spotted the BF400 driving at highspeeds over medians and into the incorrect to make a turn. I pulled them over and while I was waiting for backup, both individuals kept speaking to each other and then took off before I exited my vehicle. Throughout the pursuit, Mr. Maximiliaan Calliope had multiple opportunities to step off of the evading motorcycle as it had come to a stop a few times. At one point, the driver crashed the bike, causing him and Mr. Calliope to fall off. This is when Mr. Calliope then tried to hop back onto the bike with the driver, but the driver locked the bike too fast, resulting in Mr. Calliope attempting to run away. The driver of the bike then circled back and Mr. Maximiliaan Calliope then hopped onto the back of the bike once more, but was quickly tased off as they were surrounded by units. This shows his clear intent and willingness to participating in the evasion.

- I was on an ADAM patrol with Officer Ashley Flores and we responded to a backup request on a pursuit with a BF400 2x occupied. By the time Ashley and I had joined the pursuit the driver of the BF400 had crashed and both occupants had fallen off. It was told over radio that the suspects were trying to get back on the bike and so the passenger was tased off and detained and read his rights (The passenger being Maximiliaan Calliope). As a cadet I was asked to take the arrest for my training, I was told that the charges would be Evading because he was willingly on the bike and also willingly attempted to get back on the bike after falling off. I was also to charge with any possession charges which was receiving stolen property as he had stolen packed cash on him. Me and Ashley then transported Maximiliaan to DOC along with the driver who was also caught. My bodycam footage was uploaded to the PD database.

- On the day of the incident I was patrolling with Cadet Scott and we saw that there was a pursuit involving Maximiliaan Calliope and another male. Myself and Cadet Scott followed a backup to where the pursuit ended and I asked if Cadet Scott could help with the arrest. Cadet Scott and I arrested the driver of the motorbike and Maximiliaan Calliope. Cadet Scott arrested Maximiliaan Calliope while I arrested the driver. Maximiliaan was charged with Evading an Officer as he was the passenger of the motorbike and was witnessed willingly getting off and on the bike during the pursuit at one point, and was still on the bike by the end of the pursuit.
Maximiliaan was upset about being charged as a passenger of the bike and argued with me and Cadet Scott saying he shouldn't have been charged. Cadet Scott read the description of the charge VF01 - Evading an Officer to Maximiliaan Calliope and the driver of the bike. Maximiliaan ignored Cadet Scott and insisted quite aggressively that he shouldn't be charged as a passenger and asked me "how do you know I didn't unwillingly get on the bike?". Cadet Scott and I advised him that if he was upset with the charge that he can appeal it but we had already read him the description of the charge and explained why he was charged as a passenger. Cadet Scott and I transported Maximiliaan Calliope and the driver of the motorbike to DOC and processed them and that was the end of it.

- If I recall correctly, I believe I was AIR-1 at the time of the arrest of Maximiliaan Calliope. Providing callouts of a 2x occupied BF400, which was evading law enforcement from an attempted traffic stop. As the report made by Cadet Hailey Scott states, both occupants fell off the BF400 and both made attempts to remount the motorcycle to continue evading law enforcement. The passenger, Maximiliaan Calliope, unsuccessfully doing so as he was tased and detained.

COURT DECISION
IN THE SUPERIOR COURT OF SAN ANDREAS
State of San Andreas v. Maximiliaan Calliope
A decision was reached in the above case on the 16th day of February, 2025.
While we appreciate and accept the defenses motion for voluntary dismissal with prejudice. We acknowledge the spirit behind the request and the charges will remain on the record of the defendant.
However we'd like to take this time to inform. When an individual submits their criminal case submission form to the court, they are essentially pleading not guilty to the crimes alleged.
If a defendant then decides to plead guilty to the charges, they do not need to file a motion for dismissal. At that point in time, the defendant would then be pleading guilty to the charges.
Moving forward, the defense no longer needs to submit a motion when their defendant no longer wishes to pursue their court case. They only need to inform the courts the defendant is pleading guilty to all charges.
