Summary: The suspect was running around and talking to people including members of SASG, he then began tackling a Bayview employee, we asked the employee if he wished to press charges he declined. I informed Theo he needed to stop or he would be charged. sometime later he ran up to the Bayview employee and the governor once more and began talking, mid-sentence he removed his genitalia from his pants and pressed it against Governor Langley's leg while holding it in his hands, he then began to urinate down the governor's leg before suddenly announcing oops wrong person, he then turned to the Bayview mechanic genitalia still in hand and began to urinate on the mechanic's leg.
When ordered to stop he put his genitalia back into his pants, I attempted to cuff the individual he then ran from me for a short time before I was able to cuff him and read him his rights. When trying to take a mugshot he refused to sit still and deliberately tried to move to avoid the picture until I held him in place to get the shot.
After taking the picture he then began to run on foot from me again around the Bayview parking lot before I grabbed his cuffs and escorted him to a SASG vehicle that was nearby putting the child lock on.
At this time another suspect appeared and began causing issues, While dealing with her Theo somehow managed to get out of the vehicle and ran on foot from Bayview down the highway towards Single Toll, when seeing this I radioed it in and informed Agent Murphy who took his car and began to pursue the suspect, He was able to successfully get him into the car and bring him back whilst I handled the other 10-15
Both 10-15s were then handed over to Deputy Sheriff Gavin Sands along with their legal possessions, they were then transported to SADOC

The assault charge was placed due to him urinating on both Governor Langley and a Bayview mechanic, the sexual assault charge was for taking out his genitalia and pressing it against/rubbing it on the Governor's leg

- On October 8, 2024, Agent Murphy was with Lester Conway and Lewis Langley near the entrance of Bayview. Agent Murphy observed Theo Flee (hereafter referred to as "the suspect") running around and tackling people who had formed a circle near Lewis Langley and Lester Conway. The suspect tackled a Bayview employee, at which point Lester Conway asked the employee if he wanted to press charges, but the employee declined. GSB then ordered the suspect to stop or face charges. The suspect ignored the order and continued tackling people around Lewis Langley and GSB.
Agent Murphy witnessed the suspect undo his pants, expose his genitalia, and press himself against Lewis Langley. The suspect then began urinating on the governor's leg. Lester Conway ordered the suspect to stop and attempted to detain him, but the suspect resisted arrest. He was eventually apprehended and placed in a GOV cruiser. However, the suspect somehow managed to escape the cruiser and fled on foot from GSB out of the Bayview parking lot, heading north on Great Ocean Highway. During his escape, the suspect was picked up by a passerby’s vehicle.
Agent Murphy pursued the vehicle in a GOV cruiser and spotted it traveling southbound on Senora Freeway. Murphy ordered the suspect to stop and instructed the driver to pull over. The suspect exited the vehicle and complied, getting back into the GOV cruiser to return to Bayview. Upon arrival, Murphy handed the suspect over to Lester Conway for charges and transfer to SADOC by SD.

Defense, by and through the undersigned attorney, respectfully submits this Motion to Impeach Witnesses in the case above and requests the Court to consider the following:

Grounds for Exclusion: False Statement
Detailed Reasoning:
The prosecution has presented an arrest report and two witness statements to which is all proved to be incorrect. The defense has posted security camera footage of the incident on October 8th of 2024. This footage was received from managers at Bayview Auto Center who generously helped the court see what actually happened on this day. This evidence has been posted by the defense in
Exhibit #4: Security Footage - 08/OCT/2024, Bayview.
We will start with Lester Conway's witness statement,
Exhibit 2 - Security Director Lester Conway. This exhibit shows that my client, Theo Flee, had indeed tackled the employees at Bayview, but as said in the witness statements and arrest reports, this was consensual. The witness Lester Conway states, "he then began tackling a Bayview employee, we asked the employee if he wished to press charges he declined." (Paragraph 1, line 1) Moving forward in this witness statement, Mr. Conway states, "mid-sentence he removed his genitalia from his pants and pressed it against Governor Langley's leg while holding it in his hands, he then began to urinate down the governor's leg before suddenly announcing oops wrong person, he then turned to the Bayview mechanic genitalia still in hand and began to urinate on the mechanic's leg." (Paragraph 1, Line 4). This is not shown in this security footage in any form. With the video proof being shown it is obvious that the Security Director Lester Conway is spreading false information about my client Theo Flee. If this Agent is able to lie about two of the charges, then what makes the rest of his statement hold any value? When giving witness statements, you are told that you must tell the truth, the whole truth, and nothing but the truth. This agent decided to break that, showing that he either has no knowledge of this situation or is lying about it.
We will be moving on to Tristan Murphy's statement shown in
Exhibit #3: Witness statement - Senior Agent Tristan Murphy. We would like to point out once again that Mr.Murphy states my client had tackled a Bayview employee, but the Bayview employee did not mind this part of the situation. "The suspect tackled a Bayview employee, at which point Lester Conway asked the employee if he wanted to press charges, but the employee declined." (Paragraph 1, Line 3) Now moving on to the second paragraph, we must note that this statement is written as Tristan Murphys statement, but it seems that he starts to speak in third person, almost like he is not the one speaking in this witness statement. "Agent Murphy witnessed the suspect undo his pants, expose his genitalia, and press himself against Lewis Langley. The suspect then began urinating on the governor's leg." (Paragraph 2, Line 7) Now, this exhibit states that this is Tristan Murphy's witness statement, meaning that this is what Mr.Murphy states that he saw. The issue here is, once again, the defenses
Exhibit #4: Security Footage - 08/OCT/2024, Bayview. shows that my client, Theo Flee, had not done any of this. This shows that Mr.Murphy is also blatantly lying in a witness statement. Again, if he is able to lie about two charges then what stops him from lying about anything else that has been stated in this exhibit?
The defense has pointed out a main flaw for these two witnesses and they were both caught spreading false information in witness statements and arrest reports. To allow these two agents to keep their witness statements in this case would be unjust. It truly is upsetting to witness agents who are sworn to protect us spread false information to this extent. The defense asks that these two agents be impeached, as they were caught spreading false information.

The case of the State of San Andreas v. Theo Flee is hereby activated by this Court under #25-CM-0030 as a Formal Criminal Trial.

I informed Theo he needed to stop or he would be charged. sometime later he ran up to the Bayview employee and the governor once more and began talking, mid-sentence he removed his genitalia from his pants and pressed it against Governor Langley's leg while holding it in his hands, he then began to urinate down the governor's leg before suddenly announcing oops wrong person, he then turned to the Bayview mechanic genitalia still in hand and began to urinate on the mechanic's leg.
When ordered to stop he put his genitalia back into his pants, I attempted to cuff the individual he then ran from me for a short time before I was able to cuff him and read him his rights. When trying to take a mugshot he refused to sit still and deliberately tried to move to avoid the picture until I held him in place to get the shot.
After taking the picture he then began to run on foot from me again around the Bayview parking lot before I grabbed his cuffs and escorted him to a SASG vehicle that was nearby putting the child lock on.
At this time another suspect appeared and began causing issues, While dealing with her Theo somehow managed to get out of the vehicle and ran on foot from Bayview down the highway towards Single Toll, when seeing this I radioed it in and informed Agent Murphy who took his car and began to pursue the suspect, He was able to successfully get him into the car and bring him back whilst I handled the other 10-15
Both 10-15s were then handed over to Deputy Sheriff Gavin Sands along with their legal possessions, they were then transported to SADOC
The assault charge was placed due to him urinating on both Governor Langley and a Bayview mechanic, the sexual assault charge was for taking out his genitalia and pressing it against/rubbing it on the Governor's leg

- On October 8, 2024, Agent Murphy was with Lester Conway and Lewis Langley near the entrance of Bayview. Agent Murphy observed Theo Flee (hereafter referred to as "the suspect") running around and tackling people who had formed a circle near Lewis Langley and Lester Conway. The suspect tackled a Bayview employee, at which point Lester Conway asked the employee if he wanted to press charges, but the employee declined. GSB then ordered the suspect to stop or face charges. The suspect ignored the order and continued tackling people around Lewis Langley and GSB.
Agent Murphy witnessed the suspect undo his pants, expose his genitalia, and press himself against Lewis Langley. The suspect then began urinating on the governor's leg. Lester Conway ordered the suspect to stop and attempted to detain him, but the suspect resisted arrest. He was eventually apprehended and placed in a GOV cruiser. However, the suspect somehow managed to escape the cruiser and fled on foot from GSB out of the Bayview parking lot, heading north on Great Ocean Highway. During his escape, the suspect was picked up by a passerby’s vehicle.
Agent Murphy pursued the vehicle in a GOV cruiser and spotted it traveling southbound on Senora Freeway. Murphy ordered the suspect to stop and instructed the driver to pull over. The suspect exited the vehicle and complied, getting back into the GOV cruiser to return to Bayview. Upon arrival, Murphy handed the suspect over to Lester Conway for charges and transfer to SADOC by SD.

The State of San Andreas, by and through the undersigned attorney, filed this objection, and requests to following be stricken from the record;
- Statement being objected to:
Defendant’s motion to impeach the testimony of Security Director Lester Conway and Senior Agent Tristan Murphy on the grounds of inconsistencies in their statements and discovery evidence.
- Detailed Reasoning: The Motion by the Defense is procedurally improper and represents an unorthodox attempt to bypass standard legal procedures. Any challenges to witness credibility, including impeachment, are generally taken up during cross-exmination, at trial, and not through a stand-alone motion. The present motion attempts to use discovery materials, including incident video, so that the Defense can mount a wholesale impeachment without providing sufficient evidence of perjury or intentional falsehood.
The agent was present with representatives to discuss the matter with the parties in the process, one party specifically, who declined to make a statement because they were previously obligated to appear on behalf of someone else. The relevant documents were then examined by the appropriate authority following proper investigative procedure.
Eyewitness testimony may inherently possess minor differences in recall that do not equate to falsehoods. The Defense's selective usage of discovery evidence disregards context, and it is simply unfair, unreasonable, and unconscionable to stereotypically define minor inconsistencies as grounds for impeachment. If the motion were to succeed, it would set a dangerous precedent in which every minor inconsistency could stand as the basis for improper impeachment.
As a result, the State objects to the Defendant's motion and requests that the entire exhibit be stricken from the record.

A Motion for Involuntary Dismissal was filed in the above case on the 8th of September, 2025.
The Defendant, by and through the undersigned attorney, filed this Motion for Involuntary Dismissal, and the reasoning for request is as follows;
- Reasoning: Lack of Evidence
- Detailed Explanation: The Prosecution has posted three (3) exhibits all claiming that my client has committed the crimes listed: Sexual Assualt, Assault and resisting arrest. The defense has posted an exhibit showing exactly what had occurred on October 8th, 2024. The witnesses has now been proven to spread false information. This leads the court to wonder what else these agents would lie about.
The defense has proven through our exhibit that my client did not commit any of these crimes. There is no reason to keep this case moving any further. The arrest report was written by the arresting officer, Lester Conway, who has now been proven to lie in witness statements. He has blatantly lied to the court in his witness statements which makes all of this evidence very questionable. It is impossible to state that my client had committed these crimes without a reasonable doubt, as there has been evidence posted raising a lot of doubt in this case. The defense moves to dismiss this case. My client, Theo Flee, is not guilty of all contested charges, and it is shown in the security camera footage from Bayview Auto Center.
