        Explain what happened, sufficient detail must be given to justify the placed charges, videos could be provided.
        • Billy Pappalardo walked into Burger Shot whilst wearing a mask. Captain Luigi approached Billy Pappalardo inside of Burger Shot ordering them to remove the mask. Billy Pappalardo initially refused to do so beginning to walk out of the store before Captain Luigi informed Billy Pappalardo they were detained. Billy Pappalardo removed their mask but continued to walk towards their black Terminus, LP: ESSIELG1.

          Billy Pappalardo was again told to stop walking away as they were not free to leave as they had to provide identification. Billy Pappalardo continued to refused to provide identification before getting in their vehicle and locking the doors. Captain Luigi continued to order Billy Pappalardo to provide identification warning them GM10 would be placed if he did not. Billy Pappalardo continued to refused before being told they were now under arrest. Billy Pappalardo then continued to refuse to exit their vehicle as officers ordered them out. Officer Butoslav attempted to picklock the vehicle to gain entry before Billy Pappalardo turned on the vehicle and drove it backwards and forward to stop their attempt of entry.

          Billy Pappalardo then exited the vehicle before moving towards Burger Shot once more. Billy Pappalardo was tackled and tased by officers before eventually being detained in a cruiser.
      EVIDENCE DETAILS
      • Document the possessions confiscated from the arrested suspect.
        Possessions are to be documented individually, examples of documented illegal possessions are "Pistol .50" or "12 grams of Cocaine". Legal possessions that can be categorized may be grouped, eg. "Clothing" to describe all clothing items. Body camera footage/pictures may be attached as an evidence exhibit.

        Where possible, the serial number of each firearm seized as evidence should be noted.

    ISSUANCE OF VERDICT


    IN THE SUPERIOR COURT OF SAN ANDREAS

    State of San Andreas v. Billy Pappalardo
    #24-CM-0069

    A decision was reached in the above case on the 7th day of October, 2024.

    Pre-Trial Review

    The case began with a ruling to suppress exhibits 2 and 3 from the case. The previous precedent has always been with the stipulation that the defense needed sufficient time to review the evidence. Given the evidence was submitted 2 days prior and the defense counsel had only started to review the case that day, the court does not feel it designates sufficient time to adequately review and prepare a case for exhibits 2 and 3. One was a lengthy witness statement and the other was bodycam evidence.

    After this ruling the defendant specifically requested for exhibit #3 to be included at trial. Given that both parties agreed to the inclusion, the evidence was permitted. Exhibit #2 remained suppressed due to the reasoning given in the above paragraph.

    Trial Review

    The prosecution presented their case arguing the following facts:
    • The defendant was seen with a mask at Burgershot.
    • The defendant was requested to remove his mask.
    • The defendant failed to remove his mask upon multiple requests.
    • The defendant removed his mask upon leaving Burgershot.
    • The defendant entered his car and proceeded to contest the mask citation with the officer.
    • The defendant failed to provide identification upon multiple requests.
    • The defendant moved his car forwards one time and then backwards to stop an officer from lock picking his vehicle.
    • The defendant eventually walked onto the sidewalk after getting out of his car.
    The defense argued that the property of burger shot is private property. They also cited the lesser included offense doctrine, stating that the charge of GM04 - Resisting Arrest and GM10 - Failure to Comply / Identify cover the charge GM14 - Obstruction of Justice.

    To this the prosecution argued that the movement of the car forward and then back to prevent the lockpicking of the vehicle constituted interference with a lawful investigation.
    Verdict

    When reviewing this case, one must also review the citation for face concealment, which states “An individual may not be present on foot and wear facial concealment in public or on the property of San Andreas.” As there is no listed owner for the property that the courts can specifically define, the assumption of this judge is that the property is property of the state and therefore would qualify an individual for the citation GC04 - Face Concealment.

    The facts show the defendant failed to adhere to numerous commands by the officer, who gave him ample opportunity to comply prior to attempting to arrest the individual. At this point the defendant moved into his own vehicle, the defendant expressed disagreement with the charge and appeared to resist arrest by entering his vehicle and moving it back and forth when officers attempted to breach.

    The defense correctly argued the lesser included offense doctrine when they stated that GM14 - Obstruction of Justice is not applicable as the movement of the vehicle, noted in bodycam footage as being a singular movement forward and a singular movement backwards, stemmed from the officers attempting to arrest the defendant and the defendant attempting to resist that arrest.

    Additionally due to the inebriated state of the defendant and his failure to adhere to the scheduled court time, a charge of GM22- Contempt of Court will be applied to his record.

    It is with the above considerations that I issue the following verdict:
    • On the count of GM04 - Resisting Arrest, I find the defendant, Billy Pappalardo, guilty.
    • On the count of GM10 - Failure to Comply / Identify, I find the defendant, Billy Pappalardo, guilty.
    • On the count of GM22- Contempt of Court, I find the defendant, Billy Pappalardo, guilty.
    • On the count of GM14 - Obstruction of Justice, I find the defendant, Billy Pappalardo, not guilty.
    The defendant may come by city hall at any time to have his record changed and the amount of $6,000 to be paid for time served and fines.
