Narrative:
When in the backseat of a vehicle that was not owned by me, going the speed limit, 3 cop cars pulled us over and dragged us out the vehicle lining us up, they detained me and put me in a cruiser before searching the vehicle, it wasnt only until after i was detained that they found the gun thus placing a 1st class firearm possession charge on me.

- Incident Date: 09/AUG/2024
Explain what happened, sufficient detail must be given to justify the placed charges, videos could be provided.
- The suspect had an outstanding warrant but was arrested as part of a traffic stop on a Buffalo in which a pistol was found - nobody claiming the ownership of it.
EVIDENCE DETAILS
- Document the possessions confiscated from the arrested suspect.
Possessions are to be documented individually, examples of documented illegal possessions are "Pistol .50" or "12 grams of Cocaine". Legal possessions that can be categorized may be grouped, eg. "Clothing" to describe all clothing items. Body camera footage/pictures may be attached as an evidence exhibit.
Where possible, the serial number of each firearm seized as evidence should be noted.

- A grey Buffalo STX was seen impeding traffic on Alta Street outside of Arcadius and was pulled over on San Andreas Avenue. The vehicle was four (4) times occupied and when all occupants were identified, officers realized that one of the passengers (Ace Aethernite) had a warrant out for his arrest. The occupants were asked to step out of the vehicle and they all complied. Upon searching the vehicle, an illegal pistol .50 was found inside the car. Detectives looked for fingerprints on the firearm but they could not find any. When all suspects were asked in regards of the firearm, nobody claimed it was theirs. All four (4) suspects were given multiple chances to admit the ownership of the firearm or they could be liable for the possession charge.
All four (4) suspects still claimed they had no idea who the firearm belonged to and how it got inside the vehicle so eventually they were all charged for WM02 including Ace Aethernite.

- Police Officer Skylar Dawson was in a unit with Lieutenant Jason Steel and Detective Zoey Deul when a call for backup came over the radio for a traffic stop of a vehicle containing four individuals because it was impeding traffic. We arrived a block ahead of the stop and prepared to pursue the vehicle if it tried to flee from the traffic stop.
As Lieutenant Steel, Detective Deul and Officer Dawson waited it was discovered that one of the occupants of the vehicle had a warrant out for his arrest by one of the officers on scene. The occupants of the vehicle were asked to exit the vehicle and stand on the side walk, which they did indeed do. At this point Lieutenant Steel, Detective Deul and Officer Dawson's unit moved to the scene as there was no more chance of the vehicle fleeing the scene.
Once on scene Officer Dawson took control of one of the other suspects from the vehicle, detaining him as Detective Cyrus Carver searched the vehicle. Detective Carver found an illegal Pistol .50 in the glove box of the vehicle, and after trying to dust for prints to which he couldn't find any on the weapon, he came over and asked all four as to who owned the gun, but no one confessed to owning it.
Because the gun was located in the glovebox, thus making it easy for anyone to reach over and take it out and use the weapon to harm someone, all four of the detained parties were charged with WM02 - Possession of a Class 1 Firearm and taken to Mission Row Precinct to be processed.

The exact details I can not recall as I was only there as a backup officer not handling any suspects, however all of the occupants of the vehicle were placed under arrest as none of the occupants would admit to that it was their firearm they had placed into the vehicle that the firearm was found.

- Detective Carver responded to a traffic stop on a vehicle occupied four times. As Detective Carver approached the vehicle, he noticed most if not all of the occupants shuffling through the vehicle and reaching around the inside of the car suspiciously.
One of the occupants (Ace Aethernite) was identified as a wanted individual and everyone stepped out of the car. During a search of the vehicle, a handgun was found.
Detective Carver asked all four individuals who the handgun belongs to MULTIPLE TIMES. None of the individuals owned up to the gun. Detective Carver again asked many more times explaining that they were all in presence of the gun and in control of the handgun as it was in view and reach of all individuals. None of them wanted to claim it.
All individuals inside the vehicle were taken into custody and charged with the handgun. It was clear that the suspects had equal access to the handgun and any of them could have at any point grabbed it and used it, keeping them all in control of it.

- I apologize if I am vague, this situation partly exited my memory and I arrived a little late on the scene of the arrest. On the day of the event I was called up as an additional unit to assist with a traffic stop that was followed by an investigation. Following the said investigation a firearm was uncovered in the vehicle and one individual was found to have active warrants for their arrest. I believe there were three occupants in the vehicle, I am not certain, each of which individually had control of the firearm while each individual from my recollection claimed the firearm was not theirs. Following a conversation with the scene supervisor it was decided that all suspects should be charged for the firearm and processed.

A Motion for Voluntary Dismissal without Prejudice was filed in the above case on the 8th of September, 2024.
The State of San Andreas, by and through the undersigned attorney, filed this Motion for Voluntary Dismissal without Prejudice, and the reasoning for request is as follows;
- Reasoning: Decision made by prosecution to drop charges following the analysis of evidence.
- Detailed Explanation: Upon review of the evidence, it has been determined that the defendant, Ace Aethernite, was a passenger in a vehicle not registered to him. An unlicensed firearm was found in the glovebox, and while all four occupants of the vehicle denied ownership of the weapon, the charging agency elected to charge all individuals present. After careful consideration, the prosecution has decided to dismiss the charges against the defendant and will not be pursuing further action in this matter.

A decision was reached in the above case on the 1st day of October, 2024.
The prosecution's Motion for Voluntary Dismissal is hereby granted. The disputed charge WM02 Possession of a First Class Firearm shall be removed from the defendant's record. The defendant is, therefore, entitled to compensation in the amount of $8,000 for fines paid and time served for the now expunged charges and is directed to report to Rockford Hills City Hall to receive said compensation and to have his record updated by a qualified member of the Judicial Branch.
