- I responded to a 911 call for a man smashing an ATM with a crowbar. When arriving on the scene I saw a man leaving on a BF400 and I turned around to pursue. The man evaded pursuit, heading up a mountain I couldn't drive up with my Buffalo cruiser. He was traced and found again in the city, wearing different clothes. He jumped off a ledge with his bike and stalled it. He tried running and punching me after being cuffed. I found the clothes on him he wore and compared it to bodycam footage of him, and it matched. He also had a crowbar and 2849 dollars of marked money on him. I was unable to suspend his license as he ran off inside DOC and hid before I could complete the process.

- I responded to a 911 call from a civillian seeing a man smashing an ATM. When I arrived near the scene, I saw a man leaving the scene on a BF400. I chased him and he evaded pursuit. We found a man on the same motorcycle, but with a different outfit on, still evading pursuit.
When we arrested him, we found a crowbar, marked money (value $2849) and the clothes I saw on the man leaving the scene, on him. We held the clothes up to him to match the outfit to what was seen on the scene. The license plate matched the bike that fled the scene. His confirmed presence at the scene, the marked money and crowbar on him, as well as his repeated decisions to evade pursuit and resist arrest solidified that he was the man who smashed and robbed the ATM. I charged him with the below charges, as discussed with Chief Lex Roth.

- Lack of Relevance:
I do not believe that it adds anything important to the case at hand. I also believe that this could be considered Prejudicial, I believe that it is trying to get the judge to have bias against my client by trying to suggest that he is a dishonest man.
Speculation
This section has speculated that the man was specifically leaving the scene. This explanation of the incident is also contradictory to the witness testimony given by the same officer. In his Witness Statement, the officer claims that when he was "near" the scene, he saw the suspect leaving. Whereas in this evidence this evidence suggests that, upon arriving on the scene, he observed the suspect leaving. The bodycam footage referenced also shows how this piece of evidence slightly contradicts what occurred. This is significant as it implies that the officer observed the suspect at the scene of the crime, before the suspect had left.

- Speculation
If the officer was only near the scene when he saw the suspect, is it right to assume that the suspect was coming from the ATM. Route 68, the road that the ATM is situated on, is a well used road, therefore I think that the suspect could have easily just been driving down Route 68 at an unfortunate time. I do not think it is fair to assume that the man was leaving the scene of a crime, when the officer was only "near" the scene of the crime itself.

The court will start with a review of the
speculation claims from the defense. To begin, speculation occurs when an individual testifies to information or observations that could not have been gained with any of their 5 senses: sight, haring, smell, taste, and touch. As the officer in question was testifying to what he saw, and that claim is backed up by bodycam footage of the BF400 leaving the area that a 9-1-1 call was reported. The court will be
denying this suppression request in regards to speculation.
As for the statement quoted in reference to

All parties in this case are encouraged to complete the following Scheduling Tool in an attempt to schedule a trial on the above case. When the scheduling tool has been completed by either party, please post on the docket stating as such.
In the event all parties have overlapping availability the Presiding Judge will determine the best date and time to have a trial take place and post a Notice of Trial informing all of the upcoming proceeding.
In the event some or all parties do not have overlapping availability, the Presiding Judge will continue to attempt to schedule the proceeding or seek alternative avenues to conclude the case.
If either party has the intentions of calling a witness to the stand during the proceeding they must inform the court by filing a Witness List at the time of filing their availability. If no Witness List is filed before the Notice of Trial is filed you will be unable to call a witness during the proceeding.
