• NM01 - Inciting a Riot

Narrative:
I was at DOC watching someone getting tazed over and over again. They took the inmate to a cell and locked them up. I decided to say "I think we should start a riot" - I was clearly joking as I wasn't involved in any hostile acts prior to saying this. Badge Number "888" aimed their tazed at me and started yelling, so as a natural reflex, I punched the guard. I then got tazed by her and was locked up in a cell. Note that there was no "riot" within the cellblock; it was just them dealing with me, as an inmate, and the other inmate was already locked up in a cell. I was then charged with Battery of a Gov. and Inciting a Riot.

I'm fine with the Battery charge but Inciting a Riot is not valid. I just said that as a joke, I didn't start any riot nor attempted to. And I wasn't involved in any hostile activities prior. I was bored and decided to say that. Her claims of Inciting a riot is baseless as no physical acts were done to incite this nonexistent riot.

The description of the charge is: "The attempt or fulfillment of causing a riot." - There were no reasonable attempts whatsoever.

• Reasoning: Inability to Prove charge of inciting a Riot.

The charge of NM01 - Inciting a Riot shall be removed from the defendant's record and the defendant is entitled to $11,500 in compensation for fines paid and time served.
