  • Detailed information of your request:
    • I have a question in relation to the very progressive and refreshing FLD changes that the LSPD has announced. The question surrounds one troubling set of requirements that have carried over from the FORM C licence, that states:
      • You will be subject to random stops and searches by San Andreas Law Enforcement.
      • You will be subject to random visitations at any or all of your registered properties to ensure you are remaining faithful to the San Andreas Penal Code.
      This now appears to any individual who has ever had their firearm licence revoked for any reason. This includes anyone who has ever met the standard of"General Breach of FLD Regulations" which includes individuals who have brought a gun into a premise that sells alcohol. Can you confirm that my understanding is correct and that an individual who has their firearm revoked for one month for a mistake will then be subject to forfeiting their basic human rights in order to reobtain their firearm licence?

      Can the LSPD comment on how they feel this regulation set out by the FLD in regard to random visitations and searches is allowed when considered against the 4th Amendment of the San Andreas Constitution?

      Can the LSPD comment and justify this requirement now being blanket to all individuals who reapply for a firearms licence and explain how this is not a gross misuse of unfair requirements that can, and most likely will, lead to a disproportionately large number of individuals now having wavered their constitutional rights?

  • Mr. Wolff,

    First of all, thank you for your kind words on the changes to the Firearm Licensing Division.

    In regards to your first question, I don't consider the ability to stop and search or visit the properties of license holders to be a forfeit of basic human rights, at all. Possessing a firearm license is a personal choice and an individual applying is aware of what is expected of them.

    I'd like to clear up your comment about the general breach of firearm license regulations as well. Breaching firearm license regulations, in of itself, is not a criminal charge, it is purely an administrative one. So, while these regulations would see you lose your license for a period of at least a month, you would not be considered a criminal and as such, would not be liable for stop and search or visit to properties.

    Now regarding why we feel the random visitations and searches are allowed for licensees with a criminal history, the answer is a simple one. These ex-criminals have already broken the law once and while we're willing to give them the opportunity to legally possess firearms in the State, we don't feel given the high reoffence rate in the State, allowing ex-criminals holding legal firearms to go completely unchecked is the responsible thing to do.

    I'd argue that an ex-criminal who is truly committed to changing their life around, the sort of individual our reform seeks to reward and support, will not have any issue with these regulations being applied, in moderation and in service of maintaining firearm license regulations and security of the populace of the State.

    With all respect to the Constitution of San Andreas, it doesn't stop people from abusing legal firearms for criminal enterprise nor does it provide a shield for our people who may be subject to that abuse. We take a person's rights very seriously in the Los Santos Police Department. At the same time though, we put equal priority on protecting and serving all our citizens.
