Your Honor,
With all due respect, as the Defense has requested the Motion for Summary Judgement, they are the designated party to submit the written response in first instance, with the Prosecution being allowed a singular response to this written brief.
Nevertheless, we do fully agree with the Defense the facts of the case are clear - in our opinion the Defendant is clearly guilty beyond a reasonable doubt.

- Dear Justice Mason,
Given that Attorney Modi has resigned and AG Marchisio is on LOA, please allow this communication to be notice that (i) I will act as primary counsel for the remainder of this case and (ii) in this communication you will find our arguments in favor of the summary judgment.
It has been agreed by the parties that the facts of this case are undisputed, however, I believe it is necesary to go over them again to better explain why the defendant should be declared guilty.
- On February 13th, a Fleeca Bank SOS Alarm went off and units of the Police Department arrived on scene, where they found 5 packets of money left behind, inside of the breached vault.
- The packets of money that were to be stolen and ultimately were left behind were taken by the PD to conduct forensics tests, in which they checked for fingerprints.
- The fingerprint scans carried out on the packets returned in one of the five packets a hit on the defendant, meaning that their fingerprints were found along the money that was left behind.
- The defendant was charged, however, they were not apprehended at the date in which the events took place, which led to them being arrested at a later date since there was a warrant out for his arrest.
Now, the Penal Code states that SF07 - Bank Robbery consists on entering or attempting to enter a bank with the intent to deprive it of any item with monetary value, with or without force..
Money packets are essentially special packages of money that are stored safely inside of the safes of every bank. Under normal circumstances, there would be no way for the defendant to have obtained access to these packets of money, or even gain access to the vault of a bank. With that in mind, it is undisputed that the defendant had to enter the vault of Fleeca Bank (which was found opened and where the packages of money laid on the floor).
The crime, however, requires not only entering or attempting to enter a bank, but also the intent to deprive it of any item. With this in mind, the prosecution argues that the fingerprints left on the money packets that were presumably in the process of being stolen serve as sufficient means to prove that the defendant was, in fact, inside the vault with the intent to extract and steal the money found within it.
With this in mind, then, there was a clear intent from the defendant to deprive the bank of the money packages.
As an additional note, it is important to point out that while there might not be evidence of whether the defendant actually ran out of the bank with money packets in their posession, the penal code requires one to simply enter or attempt to enter a bank with the intent to deprive it, which means that being sucessful in the theft attempt is not a requirement for this charge to be applied.
With this in mind, we respectfully request that the defendant is found guilty through summary judgment.
Best regards,

Deputy Attorney General
Director of the San Andreas Bar Association
