I was arrested and taken to mission row on 05/FEB/2023. While I do admit to unlawfully branshing my firearm I did do it in a private area while citizens were not even a mile close to us. To whom it may concern,

The Los Santos Police Department's Legal Affairs Unit would like to highlight that the charging department involved in this case is the Los Santos County Sheriff's Department and not the Los Santos Police Department as the defendant has stated in their submission.

    • To whom it may concern,

During the Discovery investigation process, the Prosecution has received information that will most likely lead us to pursue additional charges against the Defendant. As such, taking into account the principles of due process that the courts should adhere, the Prosecution objects against the Motion for Voluntary Dismissal of the Defense and will be awaiting activation of the underlying case.

    • To whom it may concern,

As the prosecution is well aware, it is the Defendant's right to no longer pursue an appeal before it is activated by the superior court. To be clear, the motion for voluntary dismissal is a courtesy and serves as a notice rather than a request. It is not the Defendant or the Defense's concern what charges the prosecution might further pursue, they have avenues to follow if they wish to indict.

The Defendant is no longer pursuing this appeal.

    • To whom it may concern,

As the Prosecution has indicated, it is our belief that the Defendant has committed crimes that will be pursued. With reference to the State of San Andreas v. Tyreece Williams case, it is evident that the Prosecution in that case had no objections to the case being dismissed. As such, it is in our opinion now to the court whether they would like to dismiss this case before us starting a separate indictment up, thus breaking principles of due process as well as wasting additional resources (read: taxpayers' money) or simply continue on the docket that is already existing and has been received officially by the court.

    "EQUAL JUSTICE UNDER LAW"

    • To whom it may concern,

This case shall be dismissed with the defendant's decision to no longer pursue the dispute of charges.

Despite the fact that this case has been received by the court, it is not yet been activated and the prosecution is not entitled to file any Motion to Amend Charges to this specific case. This, however, does not bar the prosecution from seeking an indictment of the defendant on any crimes alleged, but this will have to be done through the normal process for prosecution initiated cases.
